Pennsylvania. 18107, 2, L V Ceiling & Panition Company (hereinafter "Claimant"). is a Pennsylvania corporation with offices in Annville. Pennsylvania, 3, Movants are the owners of real property situated part in the Borough of Carlisle and part in North Middleton Township. Cumberland County. and identified as Lots No, 27-32. Block 4 in the plan book of lots that is laid out and adopted by 1. H. Bloser and C. M, Bloser. trading as JH & CM B10ser and recorded in the Office of the Recorder of Deeds for Cumberland County in MisceUaneous Book 15. Page 514, Movants acquired title to the property by Deed dated November 7. 1996. a copy of which is recorded in the Office of the Recorder of Deeds for Cumberland County. Pennsylvania, in Deed Book Volume 149. Page 14, Said real property is hereinafter referred to as the "Property". 4, During November 1996. Movants entered into a contract \\oith Posh Construction Company whereby Posh Construction was to build a 10.000 square foot free standing CVS Drug Store on the Property, 5 During November 1996. Movants entered into a Stipulation Against Liens with Posh Construction Company, In November 14. 1996. this Stipulation Against Liens was filed with the Prothonotary for Cumberland County at Docket No 96-6269 and indexed against both Posh Construction Company and Movants A copy of said Stipulation Against liens is attached hereto and marked as Exhibit "A," 6, By proposal dated February 27, 1997 and accepted March 6. 1997, Claimant entered into a contract with Posh Construction Company and became a sub.contractor on the aforedescribed drug store construction, A change order to said contract was agreed to by the Movant and Claimant on April 28. 1997, 7 On or about July 28. 1997. Claimant filed a Mechanic's Lien claim against the Property based upon seMces or materials that Claimant provided on the drug store construction project, 8. WHEREAS, owner, of 2216 Willow Park Road, Bethlehem, pennsylvania, is about to execute contemporaneously herewith, a contract, with contractor of 2216 willow park Road, Bethlehem, pennsylvania, for the construction of a 10,000 square foot, free standing CVS Drug store at Lots Nos. 27, 28, 29, 30, 31 and 32, Block 4, Plan Book 15- 514, Carlisle Borough and North Middleton Township, cumberland County, Pennsylvania, as described in Deed Book Volume 28-L-515. Ceiling & Partition Company commenced this action by the filing of a Complaint against Defendant Posh Homes. Inc. to the above docket. 2. Through its Complaint PlaintifT seeks rt.'Covery of sums allegedly due it for work and materials furnished in connection with the construction of a CVS Drug Store on High Street in Carlisle. Cumberland County (the "Project"). 3. A default judgment was entered against Defendant Posh Homes. Inc. on October 23. 1997. for failure to file a responsive pleading. 4. This Petition to Open and/or Strike OfT Default Judgment was promptly filed on November 13. 1997. S. Defendant, Posh Homes. Inc.. is not a party to the contract under which PlaintifT seeks recovery and had no in\'ol\'~"Il1ent with the Proj~-ct and has ne\'er done business with PlaintilT. 6. The proposal!contra~1 attached to the Complaint names Posh Homes Construction. and the change order to said contract ref~'reIlc~"S Posh Construction Inc.. as the party to the ~'ontract in question. All payments made to PlaintilTunder the contract were issued by Posh Construction Inc. 10. Prior to the initiation of this action, on or about July 28, 1997, PlaintilT filed to Cumberland County docket No. 97-4095 MLD a Mechanic's Lien claim against Joseph T. and Lucille Posh, based upon the same claims as set forth in this case. A copy of said M~'Chanic's Lien Claim is attach~'ll hereto as Exhibit "A" and incorpor.lled herein by reference. 11. Joseph T. and Lucille Posh arc the owners of the real property upon which the CVS store was constnlcted. In response to the tiling of this claim, Joseph T. and Lucille Posh engaged the law linn of Manson, DeardorIT, Williams & OUo to defend against this claim. 12. In said Mechanic's Lien claim, PlaintilTalleged, contrary to that alleged in this action, that the party to the contract at issue was not Defendant, but was Joseph T. and Lucille Posh. Preliminary Objections and Motion to Strike was filed to the Mechanic's Lien Claim and is currently in litigation. \3. Though separate entities, Defendant Posh Homes, Inc. maintains an office in the same building as Posh Construction, Inc. 14. The Complaint and Notice in the above action were served upon the secretary for Posh Construction Inc. Defendant Posh Homes, Inc. was never served or advised of either the Complaint or Notice and, therefore, had no knowledge of this action. 15. Moreover, the representatives of Posh Construction Inc. believed that these papers related to PlaintifT's Mechanics Lien Claim, which they were aware was being defended by the undersigned law linn. 16. Subsequently, Joseph T. Posh received PlaintifT's First Set oflntcrrogatories In Aid of Execution To Defendant. Believing these also to be related to the Mechanic's Lien Claim. he forwarded them on to said legal counsel. 17. Upon receipt of these IntClTogatories by counsel, it was, on November 12, 1997. lirst detcnnined that PlaintilT had filed and obtained default judgment the above action, wh~-reaner this Petition was promptly tiled the following day.
