RE: Return of Mr. and Mrs. Engle's Security Deposit
Dear Ms, Neslon:
As you know. I represent Mr. and Mrs. Engle. According to my clients, they signed a Lease with you in
1983 and. at that time, provide you with a security deposit of$275.00. To date, that security deposit has not
been returned.
Based on statutory language found in the Pennsylvania Landlord Tenant Act at 68 P.S. f250.5I 2(a) and
(b) and (c) whereby Pennsylvania Law requires that "every landlord shan within 30 days oftennination ofa
lease provide a tenant with a written list of any damages to the leasehold premises for which the landlord claims
the tenant is liable. Further, any landlord who fails to provide a written list within 30 days as required shall
forfeit all rights to withhold any portion of sums held in escrow including any IUlpaid interest thereon...Lastly. if
the landlord fails to pay the tenant the difference between the smn deposited and the actual damages caused by a
tenant within 30 days after tennination of the lease, the landlord shall be liable to double the amolUlt by which
the smn deposit in escrow including any unpaid interest in any local court ofrecord."
In calculating the 5275.00 security deposit of the Engles over a period of 10 years, allowing you the
initial two years interest free as provided by the Pennsylvania Landlord/Tenant Act. I arrive at a figure of
S464.62 owed by you to Mr. and Mrs. Engle. Therefore. I would expect you 10 forward a check to Mr. and Mrs,
Engle at their current address of 4726 Enola Road. Newville. Pennsylvania 17241 as soon as possible. If they
do not receive their security deposit within 10 days, I will Instruct them to move: forwanl and file suit l1S11i:l~:
you in the local District Justice's Office.
If you do not understand the above quoted statutory language. please consult your attorney. In the
alternative. simply mail a check in the amount of$464,62 to Mr. and Mrs. Engle and this matter will be
resolved.

is denied that the security deposit was paid on or about March
1983. The security deposit was paid on or about August 1, 1983.

Denied. It is specifically denied that the Plaintiff notified the
Defendant in writing of a forwarding/new address. By way of
further answer, Attorney Paul Orr notified the Defendant of his
representation of the Plaintiff and did advise of a new address,
with said address notification; however, not being provided in
accordance with the provisions of the Landlord and Tenant Act, more
specifically, 68 P.S. 250.512(e).

Admitted in part and denied in part. It is admitted that the
Defendant has not returned any security deposit to the Plaintiff.
It is specifically denied that Defendant was legally obligated to
return the security deposit within 30 days of receipt of a letter
from Attorney Orr.

The responses to Paragraphs 1 through 8 above are incorporated
herein by reference thereto.

On or about March 12, 1997, the mobile home which the Plaintiff had
been renting was gutted by fire.

On or about March 20, 1997, Defendant and Plaintiff met and at that
time Defendant returned to Plaintiff a prorated amount of rent for
the month of March, being approximately $200.

On or about March 20, 1997, Plaintiff surrendered the leasehold
premises and Defendant accepted return of the leasehold premises.

Not until May 1, 1997, had Defendant been provided in writing with
any current/new address for the Plaintiff.

The Plaintiff had been notified by the Defendant on or about March
20, 1997, to remove their personal belongings/possessions from the
leasehold premises as well as the cats which they had been caring
for.

When it appeared obvious to the Defendant that the Plaintiff had
stopped removing their personal belongings/possessions, the
Defendant proceeded to remove those items.

The Defendant retained the security deposit on account of the cost
of removal of cats, personal possessions/belongings, and for
cleaning the premises.

On or about Hay 9, 1997, the Defendant responded to a letter
received from Attorney Orr itemizing the damages incurred and the
application of the security deposit towards those damages. A copy
of said letter is attached hereto and marked as Exhibit A and
incorporated herein by reference.

Defendant has incurred the following expenses in regards to
Plaintiff's failure to remove their personal possessions/
belongings, the removal of cats, and cleaning of the premises:
Removal of Personal Belongings $ 1,200.00
Cleaning 480.00
Removal of Cats 150.00
TOTAL $ 1,830.00

From the date of occupancy of the premises through the date of
termination there is a credit due to the Plaintiff of $387.36,
including interest, for the security deposit retained by Defendant.
COUNTERCLAIM

The Defendant's answers to Paragraphs 1 through 8 above and
Paragraphs 10 through 19 are incorporated herein by reference
thereto.

There is due and owing to the Defendant the sum of $1,442.64 as a
result of damages incurred, as more particularly set forth under
New Matter above.
WHEREFORE, Defendant demands judgment against the Plaintiff for
$1,442.64 plus interest, costs, and attorney's fees.

14. Admined in part. denied in part. It is admined that Defendant notified Plaintiff
on or about March 20, 1997 to remove Plaintiffs personal belongings immediately. It is
specifically denied that the stray cats were being exclusively cared for by the Plaintiff. rather
they were neighborhood stray cats that were being cared for by numerous local residents.
15. Denied, To the contrary. Plaintiff was unable to remove all of his personal
belongings within the limited time constraints imposed by Defendant.
16, Denied. Plaintiff is without knowledge as to why the security deposit was
retained by Defendant. By way of further answer, at no time within the 30 days of the total fire
loss suffered by Plaintiff did Defendant notify Plaintiff in writing ~ to the damages and
Defendant's reasons for refusing to return security deposit to Plaintiff.

properly retained by the Defendant.
