A true and correct copy of the Agreement of Lease is attached hereto and made a part hereof as "Exhibit A". 5. On or about December 22. 1995, Total Fitness Center, Inc. as Assignor and Defendants as Assignee executed an Assignment of Lease whereby Total Fitness Center. Inc. assigned all of its right title and interest in the Agreement of Lease to Defendants and Defendants assumed the performance of and agreed to perform all the terms and obligations. covenants and provisions of the Agreement of Lease. A true and correct copy of the Assignment of Lease is attached hereto and made a part hereof as "Exhibit B". The Agreement of Lease and Assignment of Lease are collectively referred to as the "LEASE". 6. The Lease has not been assigned except as herein provided. 7. No judgment has been entered on the Lease in any jurisdiction prior to this action. 8. Judgment is not being entered by confession against a natural person in connection with a residential lease. 9. Defendants are in default under the terms and conditions of the Lease in that Defendants have failed to pay rent and other charges when due as required under the Lease.
