Plaintiff, General Accident Insurance Company, by way of payments made by it on behalf of its insured, Lalmohammed Abdulaziz, has become subrogated to all rights of recovery against the Defendant by their insured, Lalmohammed Abdulaziz. 3. Defendant, Paul E. Haigh is an individual who resides at 411 First Street, Apartment 3, Carlisle, Pennsylvania 17013. 4. The acts and occurrences hereinafter related took place on December 3, 1996 when Marun Abdulaziz, was operating her vehicle on Walnut Bottom Road when the Defendant, Paul Haigh. failed to yield the right of way to boulevard traffic, pulled from a parking lot and struck Plaintiff's vehicle. 5. As a result of the carelessness, recklessness and negligence of the Defendant, Paul E. Haigh, Marun Abdulaaia was caused to incur property damage to her vehicle in the amount of $5389.23. 6. PAUL E. HAIGH, Defendant CIVIL TERM - LAW JURY TRIAL DEMANDED MOTION FOR SUMMARY JUDGMENT 1. Plaintiffs move for summary judgment based upon the Agreement of Defendant to pay for damages he caused in an automobile accident. 2. Defendant's negligence resulted in damage to an automobile of Plaintiff's subrogor in the amount of $5,389.23. 3. On April 17, 1997, Defendant entered into an Agreement with Plaintiff to satisfy the damage incurred as a result of his negligence and agreed to pay the amount of $10.00 per month until satisfied. 4. Plaintiffs are liable on the Agreement for the payment of said damages. 5. Plaintiffs allege in paragraph 6 of their Complaint that such an Agreement was reached. 6. Defendant in paragraph 6 of his Answer admits that since April 17, 1997, he has made payments of $10,00 per month. 7. There is no outstanding issue of fact or law.
