WHEREAS, Mark G, Caldwell and Ellen 0, Caldwell, of 804
Riverview Road, Lemoyne, CUmberland County, Pennsylvania 17043, are
about to execute contemporaneously herewith, a contract with
Heritage Builders, Inc" of 6968 Gertrude Road, Harrisburg, Dauphin
County, Pennsylvania 17112, for the erection of a three-story stone
and stucco single family dwelling home to be constructed on owners'
lot located at Lot 33 in White Oaks Subdivision, Lemoyne,
CUmberland County, Pennsylvania, as more particularly described in
Exhibit "AM.
NOW, August 1, 1997, at the time of and immediately before
execution of the principal contract, and before any authority has
been given by the said Heritage Builders, Inc" to commence work on
the said building, or purchase materials for the same in
consideration of the making of the said contract with Heritage
Builders, Inc., and the further consideration of One Dollar to
Heritage Builders, Inc" paid by Mark G. Caldwell and Ellen O.
Caldwell, it is agreed that no lien shall be filed against the
building by the contractor, or any sub-contractor, nor by any of
the material men or workmen or any other person for any labor, or
materials purchases, or extra labor or materials purchased for the
erection of said building, the right to file such liens being
expressly waived,
