COURT ORDER
AND NOW, this :(J,.,d day of September, 1997, upon consideration of
the attached Custody Conciliation Report, it is ordered and
directed as follows,

A hearing is scheduled in Court Room No. ~ of the
Qpuberland County Courthouse on the ~ day of
i>>H.",.,/. ~-V ' 1997 at q; 3(') a.m. at which time testimony will
be taken ~n the above case. At this hearing, the Father,
Hichael E. Chestnut, shall be the moving party and shall
proceed initially with testimony. Counsel for the Father and
counsel for the Hother, when that attorney is retained, shall
file with the Court and opposing counsel a memorandum setting
forth the history of custody in this case, the issues
currently before the Court, each party's position on these
issues, a list of witnesses who will be called to testify and
a sUllllllary of the anticipated testimony of each witness. This
memorandum shall be filed at least ten days prior to the
mentioned hearing date.
Pending further order of this Court, the Hother, Linda L.
Raudabuagh, shall continue to enjoy legal custody of Nicole L.
Raudabaugh, born April 22, 19B7. The Father, Hichael E.
Chestnut, shall have reasonable telephone contact with his
minor child at the minimum of two to four times per month.

CONCILIATION CONFERENCE SUMKARlt' REPORT
IN ACCORDANCE WITH THE CUMBERLAND COUNTY CIVIL RULE OF PROCEDURE
1915.3-8(b}, the undersigned Custody Conciliator submits the
following report:
1. The pertinent information pertaining to the child who is the
subject of this litigation is as follows:
Nicole L. Raudabaugh, born April 22, 1987.
2. A Conciliation Conference was held on September 18, 1997, with
the following individuals in attendance:
Attorney James D. Flower, Jr. for Michael E. Chestnut, vho is
the Father of the minor child, and Linda L. Raudabuagh, who is
the Mother and appeared without legal counsel.
3. The Father resides in Montana and has resided there for a
number of years. 'the child resides here in Cumberland County
with her Mother and her Mother's boyfriend and another child
of the Mother and the boyfriend.
4. 'the Father has not seen the child since at least 1994. Father
suggests that he has on nUlllerous occasions requested time to
see the child and the Mother has consistently refused. Father
cites one recent situation vhere he vas in the Cumberland
County area and asked Hother for time vith the child and the
Hother refused. Father suggests he has made numerous
telephone calls to the hame and has spoken vith the child,
vith a lot at these calls taking place over the past fev
months.
5. Hother is unwilling to allow the Father to see the child. She
suggests the Father has shown little, if any, interest in the
child since the child's birth and she teels it is not in the
best interest of the child to be vith the Father. Nother
suggests that the child is unvilling to go vith the r.ther.
