CIVIL ACTION COMPLAINT
1. Plaintiff, Hypo Holdings, Inc., is a corporation
organized and .xisting under and by virtue of the laws of the Stat.
of N.w York and authorized to do business in the Commonwealth of
P.nnsylvania with offices located as captioned.
2. D.f.ndants, P.ter J. Hoffman and Donna B. Hoffman, are
.dult individu.ls r.siding at the captioned address.
3. On or .bout November 21, 1990, Defendants, Peter J.
Hoffaan .nd Donn. 8. HOffman, execut.d .nd delivered to H~st..d
s.vings Associ.tion .n installment not. and ..curity .gr....nt
(h.r.inaft.r -not.-) and a mortgage wher.by Defendants proal sed to
pay Hoa..te.d s.ving. A.sociation the unpaid principal bal.nce with
int.r..t th.reon .t the fix.d rat. of 12' per annWl OVer a tana of
110 aonth. beginning January 2, 1991. (Exhibit -,,- attadled
hereto) .
4. On or about December 15, 1995, the aforesaid note was
lawfully assigned to Super Special Holdings, Inc., II who then and
there became successor in right, title and interest to said note
held by Homestead Savings Association. (Exhibit "B" attached
hereto).
5. On or about January 19, 1996, the aforesaid note was
lawfully assigned to Galonia Establissement, who then and there
became successor in right, title and interest to said note held by
Super Special Holdings, Inc., II. (Exhibit "e" attached hereto).
6. On or about January 19, 1996, the aforesaid note was
lawfully assigned to Plaintiff, Hypo Holdings, Inc., who then and
there became successor in right, title and interest to said note
held by Galonia Etablissement. (Exhibit "0" attached hereto).
7. Defendants are in breach of the terms of said note.
8. Demand has been made for payment and no payments have
been made.
9. Defendants owe Plaintiff the balance due on said note of
$32,486.08 together with interest to accrue at $10.68 per day from
September 1, 1991 until said obligation is paid in full.
10. To date, said obligation of Defendants has accrued
iapound balance of $174.00, interest at 12' per annum in the sum of
$22,247.18, accrued penalties and fees in the sum of $1,362.72 as
veIl a. attorney. fee. in the sum of $9,115.49 for which a claim i.
hereby..de. (Exhibit .E" attached hereto).

Associationf'Assignor') and Super Spccial Holdings, 1nc, II, a corporation organized and existing undcr thc

WHEREAS, by Order No, 91-520 of the Office ofThrifi Supervision, Department of the Treasury of
the United Sbtes ("OTS"), dated August 30, 1991, RTC was appointed Receiver for Homestead Savings
Association ("Old Thrift'); .
WHEREAS, by OTS Order No. 91-520 dated August 30, 1991, RTC, as Receiver for Old Thrin,
immediately organized Homestcad Federal Savings Assoeiation,(''Ncw Thrift') and caused it to be chartered
as a federal savings association; and
WHEREAS, by OTS Order No. 91-520 dated August 30, 1991, RTC was appointed as Conservator
for New Thrin and by virtue of that certain Purchase and Assumption Agreement dated August 30, 1991,
entered into between RTC as Receiver for Old lluifi and RTC as Conservator for New lluin, succeeded to
all right, title and privilege in and to substantially all of the assets of Old Thrift, including the mortgages and
notes which arc the subject of this assignment; and
WHEREAS, by OTS Order No. NE94-13, dated April 8, 1994, RTC as Conservator of New Thrift
was replaced by RTC as Receiver ofNcwThrifi, which appointment was accepted by RTC on April 8, 1994,
NOW, ll1EREFORE, for value received, Assignor hereby remises, relc.'1Ses, quitc~1ims, transfers,
assigns, and delivers to Assignee, its successors and assigns, any and all of Assignor's right, title and interest

Reconsideration and any response thereto. it is hereby Ordered and Decreed that this
Court's Order of August 5, 1999 is stricken and plaintiff is not precluded from entering
evidence on the subject or issue of any amount owing by defendants to plaintiff at the
time of trial.

J.
5. On or after June 7, 1999, plaintill's counsel received a copy of an Order
for Sanctions dated June 7, 1999; again, neither plaintiff nor plaintill's counsel ever
received a copy of defendants' Motion for Sanctions accompanying this Order, in
violation ofPa.R.C.P. 440 and C.C.R.P. 206-6. (Exhibit E).
6. On August 3, 1999, plaintiff forward to defendants' counsel fully executed
interrogatories as well as additional documents in satisfaction of defendants' document
request. (Exhibit F).
7. On August 9, 1999, the undersigned received a copy ofan Order dated
August 5, 1999, entering sanctions against plaintiff for failure to respond to
interrogatories and document request, despite providing same to defendants prior thereto.
(Exhibit G).
8. Pa.R.C,P. 440 states:
"(a) Copies ofall legal papers other than original process filed in
an action or served upon any party to an action shall be served
upon every other pany to the action. Service shall be made by
handing or mailing a copy to or leaving a copy for each party at the
address of a party's attorney of record endorsed on an appearance
or prior pleading of the party. . . .
9. C.C.R.P. 206-6 states:
Where notice of the entry of an judgement, decree, or Order is
required under Pa.R.C.P. 236 (a), the petitioner, or moving party,
shall include in the proposed Order, judgement, or decree, the
names of the persons and/or the attorneys who are required to be
notified and shall provide duplicate copies of the proposed Order, a
stamped envelope addressed to the said persons and/or attorneys.
10. Defendants did not forward the required pleadings to plaintiff as is clearly
required under the above statutes.
II. Only after the entry of Orders, for which plaintiff never had an
opponunity to respond, did defendants notify plaintiff
12. Without proper service ofall pleadinp, plaintiff was prtjudiced in their
ability 10 dispute 01' otherwise respond to defendants' Motion.
13. To the contrary, defendants cannot show IlOf have they sufTend any
prejudice in connection herewith. In tic:t. all documents relevant to this action were
pnMded to defendant,' prior counsel, Ronald Butler. Esquire
