affidavits of consent and waivers of notice of intention to
request entry of divorce decree so the divorce can be concluded
under Section 330l(cl of the Domestic Relations Code. The
Master will file the affidavits and waivers.
On April 1, 199B, the plaintiff filed a petition
raising the economic claims of equitable distribution, alimony,
alimony pendente lite, and counsel fees and expenses.
The parties were married on November 2B, 197B and
separated February 7, 1997. They are the natural parents of
three children, all of whom are minors.
As noted, the parties have reached a settlement
with respect to the outstanding economic claims and an
agreement is going to be placed on the record at this time.
The agreement as placed on the record will be considered the
substantive agreement of the parties not subject to any changes
or modifications except for correction of typographical errors
which may be made during the transcription. Counsel and the
parties are going to return later today to review the draft of
the agreement for typographical errors, make any corrections as
necessary, and then sign the agreement by way of affirmation of
the terms of settlement that have been reached with respect to
the outstanding claims. The signature by the parties will act
as an affirmation of the aQr~nt. The agreement will be
ccnsider~j bindinq on the ~~rtie$ at the time that It is placed
6. Alimony. Husband shall pay to wife alimony in the
amount of $1,000.00 per month for a term of 30 months.

within the degrees of consanguinity, upon her
remarriage, or upon her death or upon husband's death.
Said $1,000.00 per month shall be reportable to the
Internal Revenue Service as alimony. However, husband

which exists in favor of husband at the Domestic
Relations Office for sums husband has already paid to
wife.
7. Child support. Additionally, the parties agree that
husband shall pay the sum of $500.00 per month to wife
as child support for those children in her primary or
shared custody, said children being M~kenna and Bevin.
This amount of $500.00 per month shall become

credits on the child support or APL accounts or spousal
support accounts shall be eliminated as of April 1,
1999. Wife shall withdraw any appeal filed pursuant to
the Order of Court dated January 25, 1999 and January
21, 1999, as they relate to child support and APL. And
the parties agree that the terms contained herein shall
be entered at Domestic Relations as a stipulated order
relative to the child support.
8. Wife shall waive her claim for award of counsel fees
and costs.
9. Except as herein otherwise provided, each party may
dispose of his or her property in any way and each
party hereby waives and relinquishes any and all rights
he or she may now have or hereafter acquire under the
present or future laws of any jurisdiction to share in
the property or the estate of the other as a result of
the marital relationship including without lill'litation
statutory allowance. widow's allowance, right of
intestacy. right to take against the will of the other
and right to act as administrator or executor in the

MR. REILEY: Correct.
MS. SULLIVAN: Did you understand the terms of the
marital settlement as I dictated them here today?

MS. SULLIVAN: Do the terms as I dictated them
here today comport with your understanding of what the
settlement of this matter is?

this settlement?

final settlement of all the marital claims that you have
against Mrs. Reiley?

Based on 1998 depocitc through Juno 30, 1998, I would eatim~te that

until August 15, 199B. Last year the return wasn't fihd until
October 15, 1998 because of a second extansion and the likelihood
is that the 199'/ won't be completed until next October.
Because Mrs. Reiley filed Married Filing Separately for 1997 (she
had an overpayment of $1400 which the IRS took against 1993 taxes),
Marx's tax bill will be about $6,000 higher for 1997, I estimate
it at about $28,000 with only $3,000 paia to aate tor an additional
$25,000 due later this year. Pennsylvania will be an additional
$3,000 or so for 1997, In addition nothing has been paid against
1998 Federal or ~ennsylvania, whiCh prorated for 6 months is an
additional $16,000 to $17,000.
I reviewed my memo to you dated March 31, 1998 and ~~e information
continu.. to b2 about the same,
The IRS and Pennsylvania taxes on installment have been paid at the
rate ot $1500 end $250 monthly. The mortgage and second are about
three ~ntns behind. Everything else is about the same.
From a tax standpoint, I WOUld advise doing everything you can to
finalize the divorce in 1998. EVen filing under the Single t11ing
statuI will save him about $3,000 annually. In addition. it would
obviously b, ':0 hia advantage to structure any part of hia
Obligation .1 alimony for tax purposes so he can take that as a

3. Movant served Respondent with a Request for Production of Documents and a set of
Interrogatories on October 8. 1998.

RE: Pre-Hearing Conference Memorandum
DATE: Monday, October 19, 1998
Present for the Plaintiff, Christine E. Reiley, is
attorney Emily Long Hoffman, and present for the Defendant, Mark
D. Reiley, is attorney Barbara Sumple-Sullivan.
This action was commenced by a divorce complaint on
August 8, 1997, raising grounds for divorce of irretrievable
breakdown of the marriage. The parties are going to sign
affidavits of consent and waivers of notice of intention to
request entry of divorce decree so that the divorce can be
concluded under Section 3301(C) of the Domestic Relation Code.
The Plaintiff filed a petition on April 1, 1998,
raising the economic claims of equitable distribution, alimony,
alimony pendente lite, and counsel fees and expenses. Counsel
have advised that there will be at least four witnesses offered
on the issue of marital misconduct. We will schedule a separate
hearing for those witnesses and counsel are directed to provide
each other a list of witnesses they intend to call for that
hearing at least a month prior to the hearing. We will also
take testimony at that time on the issue that is going to be
raised by the wife regarding the dissipation by husband of the
marital home. Again, if any witnesses that are to be offered on
that issue, other than the parties, they should be made known to
opposing counsel.
With respect to the representation by wife of
attorney Hoffman, attorney Keith B. DeArmond originally filed
the complaint in divorce and he has not withdrawn his
appearance. Ms. Hoffman i. going to attempt to file a praecipe
signed by Mr. DeArmond withdrawing his appearance. On July 20,
199', Ma. Hoffman signed an entry of appearance which was filed
on August 4, 1998, enterinq her appearance in the action.
The part i.. vere married on November 28, 1978, and
separated February 7, 1997. They are the natural parent. of
three children, "ekenna, born February 13, 1981: Michael, born
January 6, 1987; and Bevin born April 4, 1991. Mekenna lives
with the wife and Michael lives with the father; the custody of
Bevin is shared between the parties. However, counsel advised
that the custody issues are currently pending before the Court
and that it is likely that the custody arrangement may change.
Wife is 44 years of age and resides at 1414 Red
Maple Court, New Cumberland, Pennsylvania. She has a Bachelor's
Degree and currently is self-employed doing artist consulting
work for various employers as noted on her income statement.
The income statement indicates that her net monthly income
currently is $2,050.24. That income is subject to fluctuation
because wife's contracts with the various employers is subject
to change. Wife is currently covered under husband's health
insurance plan. Upon the entry of a divorce decree, wife will
not have any medical insurance and counsel are going to provide
the costs to wife of obtaining medical insurance. Wife has not
raised any health issues.
Husband is 43 years of age and resides at 904 Fifth
Street, New CUmberland, Pennsylvania. He has an M.D. Degree and
a specialty in podiatry. He has an office where he is a sole
practioner at 100 Colonial Road, Harrisburg, Pennsylvania. As
reported on his income statement, his net monthly income is
$5,430.69. He has not raised any health issues. Husband is
currently paying child and spousal support in the amount of
$2,000.00 per month which is not allocated. Counsel have
indicated, however, that the support issues are on appeal and
are not yet resolved by the Court.
The parties own real estate at 347 Hillside Drive,
New CUmberland, Pennsylvania, where they lived prior to
separation. The property is subject to a first mortgage with
York Federal Savings and Loan Association. That mortgage is in
foreclosure and the approximate payoff on that mortgage is
around $112,000.00. The property is also subject to other liens
including a line of credit and tax liens. It is this property
that is the subject of the dissipation issue which wife has
raised. Following the sale of the property, the first mortgage
is to be paid and any remaining net proceeds should be escrowed
by counsel and counsel should determine how they want to apply
those escrow funds to the various remaining creditors including
the Internal Revenue Service and the Pennsylvania Department of
Revenue.
Husband has a 1915 Alf. Romeo automobile Which
according to the pre-trial stat.ment is not in operable
condition. He also is usinq a 1915 Volvo 240. Both of those
vehicle. should be appraised. Wife haa a 1992 Dodge Caravan
which she claims is nonmarital and was provided to her by her
father. Husband is going to determine if he can agree with that
characterization of that vehicle inasmuch as he has noted on his
pre-trial statement that the Caravan is a marital asset. In any
event, if the car is a marital asset, we need to have a value
for the vehicle.
Husband has a medical practice as noted at 100
Colonial Road, Harrisburg, Pennsylvania. Attorney Hoffman has
indicated that she is going to have Seligman & Friedman do an
evaluation of the practice which should be accomplished within
the next couple of months.
The PNC checking account, which the parties had,
according to counsel had a minimal balance at separation but we
should have a copy of the statement of the account around the
date of separation.
There does not appear to be a lot of disagreement
with respect to the household tangible personal property;
however, counsel have agreed that three categories of items need
to be appraised, wife's jewelry, certain prints, and the baby
grand piano. Aside from those items, counsel have indicated
that they do not intend to use a value for the other items of
household tangible personal property in the equitable
distribution computation.
On the pre-trial statement are listed numerous
debts and the substantial portion of those debts involve
educational loans and monies owed to the Internal Revenue
Service and Pennsylvania Department of Revenue. Currently
husband is paying monthly to the Internal Revenue Service and
Pennsylvania Department of Revenue the sum of $1,750.00.
Husband is seeking wife's assistance with the payment of the
debt which according to husband'S attorney amounts to
$270,000.00, not inclUding the first mortgage. The Master has
suggested that wife may be willing to give up her claim for
alimony and acknowledge responsibility for a portion of the
debt, but by giving up her claim to alimony ask husband to
asaume a substantially larger portion of the debt. The Master
haa alao suggested that perhaps wife could agree to contribute
monthly to the payment that husband is making to the combined
Internal Revenue Service debt and the Pennsylvania Department of
Revenue debt. Also, we have talked about the possibility of
bankruptcy but after discussing the matter with counsel, it
appears that the only debt that could be discharged would most
likely be debt of around $27,000.00 total which in this
situation would not be of much benefit to the partie. where as
noted, the substantial portion of debt involve. .tudent loans
