THIS AGREEMENTmade this 8TH day of AUGUST, 1997, by and between
JOHN FOGARTY CUSTOM BUILT HOMES, INC., hereinafter called the
Contractor, AND ROGER W. SMITH AND TRACY D. SMITH, HUSBAND AND
WIFE, hereinafter called the Owner;
STIPULATION AGAINST LIENS
WITNESSETH THAT:
The Contractor by instrument dated JUNE 7, 1997 entered into an
Agreement with the Owner for the erection and Construction of a
SINGLE FAMILY DWELLING, situated on 5 ACRES MIDDLESEX TOWNSHIP,
CUMBERLAND COUNTY, PENNSYLVANIA
AND WHEREAS, the Contractor has covenanted and agreed therein to
enter into an additional agreement with the Owner stipulating that
no lien or liens of any kind shall be filed against the above
building or the appurtenances thereto.
NON, THIS AGREEMENT WITNESSETH, that the Contractor, for and in
consideration of the awarding to him of the said contract as for
the sum of ONE DOLLAR ($1.00) to him in hand paid by the Owner,
the receipt of which is hereby acknowledged, promises and agrees
that no Mechanic's lien or liens shall be filed against the
aforesaid building or the appurtenances thereto by any
subcontractors, materialmen, mechanics, laborers, or anyone for
materials furnished, work done or services rendered of any kind
whatsoever, for or about, or on account of the aforesaid building
or on the credit thereof.
