Now, on this date, this matter comes before the Court, havinq
been submitted to the Court upon the Complaint and Exhibits filed
herein, the Summons issued to the Defendant, R S MOWERY' SONS INC,
and the Affidavit of PATRICIA HENRY showinq service on said
Defendant by certified mail, in the manner and time required by
Arkansas law and from the above and foreqoinq and the evidence
introduced by the Plaintiff and other matters before the Court, the
Court finds and orders the followinq:
1. That the Court has subject matter juriSdiction over this
cause of action, and venue is proper in this Court.
2. That juriSdiction was obtained over the Defendant, R S
MOWERY' SONS INC, said Defendant havinq been served by certified
mail as shown in the return of service, and the Defendant has
failed to file an answer or appear in any other manner and
therefore the Plaintiff is entitled to a Judqment by Default.
3. The Defendant was indebted to the Plaintiff in the SUII of
$426,120.00 for materials and services receiVed from the Plaintiff,
that the Defendant has paid a total amount of $420,282.74 aqainst
said indebtedness, leavinq a balance owed to the Plaintiff of
$5,837.26, and the Plaintiff is entitled to Judqment in that
amount.
