The vehicle was purchased and is registered in the Commonwealth of Pennsylvania, 4. The purchase price of the vehicle, including registration charges, document fees, sales tax, finance and bank charges but, excluding other collateral charges not specified, yet defined by the Magnuson-Moss Federal Trade Commission Improvement Act, totaled more than $16,722.11. A true and correct copy of the Sales Agreement is attached hereto, made a part hereof and marked as Exhibit "A." 5. Plaintiff avers that, from time of delivery to the present, his vehicle has been plagued by a latent oil consumption defect in derogation of Chevrolet's express and implied warranties. Plaintiff first noticed excessive oil consumption at about 40,000 miles, when the "low lube oil" indicator lit on the dashboard. On this occasion a quart of oil was added, 6, On July 15, 1996, Plaintiff spoke with Gary Hoover at Sutliff Chevrolet Co., 13th and Paxton Sts" about the loss of lube oil and asked him to check the engine to determine the cause of the oil usage at approximately 43,918 miles, Plaintiff avers that he spoke with Mr. Hoover, who, after inspecting Plaintiff's vehicle, informed him that the dealership was aware of the oil usage but not to be concerned. Plaintiff was not provided an invoice for said service visit. 7. On November 10, 1996, at 51,528 miles, Plaintiff changed the oil. From this date through December, 1996, Plaintiff 3 -- avers that Mr. Hoover was aware the subject vehicle was consuming excessive oil to the point of one quart for every 900 to 1,000 miles. 8. On December 11,1996, at 54,329 miles, Plaintiff avers that he returned to the dealership for an oil change using a 10 weight oil. 9. By the first week of January, 1991, the subject vehicle was consuming one quart of oil per every 500 to 600 miles. Plaintiff continued to check for ground seepage and leaks, but found none. On January 21, 1997, Plaintiff took the subject vehicle to a Chevrolet authorized dealer for an oil change and a replacement PVC valve at 56,161 miles. See paragraph 16, infra. 10. On February 3, 1991, Plaintiff brought the subject vehicle back to Sutliff as the oil level had again fallen, A Sutliff technician known as "Dave," identified the problem at that point as leaking valve covers, informed by a Chevrolet Technical Service Bulletin. Pursuant to an inspection on or about February 10, 1997, Gary Hoover of Sutliff Chevrolet called Plaintiff and recommended replacement of the oil pump "0" ring, the intake set and the valve covers and transmission return line at an estimated cost of 580 which he offerred at a ten (101 percent discount. 11. Upon the diagnosis of leaking valve covers, Plaintiff avers that neither Chevrolet nor any agent thereof documented the concern as an engine problem. Had the problem been properly diagnosed within the warranty period, Plaintiff avers that said concerns would have been covered under the express warranty, See 'I ,-.. ,.,..,'"~ paragraph 14, infra, 12. On February 11, 1997, Plaintiff brought the subject vehicle to Graham Motors, a General Motors dealership in Carlisle, PA. Plaintiff avers he was then informed by an ASE certified technician that a possible cause of the excessive oil consumption could be the piston oil rings or the valve seals. Upon the advice of the ASE technician, Plaintiff replaced the valve seals and covers at his expense ($741.01), 13. Plaintiff avers that Chevrolet now recommends an out- of-warranty replacement of the pistons or piston oil rings at a cost of more than $2,000.00. plaintiff further avers that as a result of the ineffective and negligent repair attempts made by Defendant and its authorized dealer to remedy the latent oil consumption defect, the vehicle cannot be used for the purposes intended by Plaintiff at the time of acquisition; as such, the vehicle is worthless, 14, In consideration for the purchase of the above vehicle, Defendant Chevrolet issued to Plaintiff several written warranties, including a three (3) year, thirty-siX thousand (36,000) mile warranty, as well as other standard warranties fully outlined in the warranty booklet, delivered at time of sale. 15, plaintiff has delivered the non-confortl\inq vehicle to an authorized service and repair facility of the manufacturer on numerouS occasions, After a reasonable number of attelllPts,the manufacturer was unable to repair the non-conformities ...s ---. -, 16. The first repair attempt is believed to have occurred on or before January 27, 1997, when the vehicle's odometer showed 56,761 miles, On that date, repair attempts were made to remedy a defective PCV. A true and correct copy of the repair invoice summary is attached hereto, made a part hereof and marked Exhibit "8." 17. The second repair attempt is believed to have occurred on or before February 12, 1997, when the vehicle's odometer showed 57,777 miles, On that date, repair attempts were made to remedy a defective transmission cooler line and allegedly defective seals and valve covers. A true and correct copy of the repair invoice summary is attached hereto, made a part hereof and marked Exhibit ~\c. " 18. The third repair at tempt is believed to have occurred on or before March 12, 1997, when the vehicle's odometer showed 59,113 miles. On that date, repair attempts were made to the ECM. A true and correct copy of the repair invoice summary is attached hereto, made a part hereof and marked Exhibit "0," 19, The fourth repair attempt is believed to have occurred on or before March 13 1997, when the vehicle's odometer sho....ed 59,117 miles. On that date, repair attempts were made to the defective PCM, A true and correct copy of the repair invoice summary is attached hereto, made a part hereof and marked Exhibit "E." ~ ,-.- 20. The fifth warranty repair attempt is believed to have occurred on or before May 7, 1997, when the vehicle's odometer showed 61,618 miles. On that date, repairs were made to the defective oil level sensor. A true and correct copy of the repair invoice summary is attached hereto, made a part hereof and marked as Exhibit "F." 21. The vehicle has, in addition to the inherent defects which have severely compromised the vehicle's oil consumption, exhibited defects and non-conformities which substantially impair its use, value and/or safety during the manufacturer's express warranty and "goodwill" period. Said repairs have been made to the brakes; steering system; paint; air conditioning unit and left front window, True and correct copies of the repair invoices reflecting these concerns are attached hereto, made a part hereof and marked collectively as Exhibit "G," 22. In addition, Plaintiff avers his vehicle has been subject to additional repair attempts for defects and/or non- conformities and/or conditions for which the dealer did not maintain records. 23, Plaintiff further avers he has resorted to Chevrolet's Arbitration process (BBB Autolinel prior to filing the within Complaint as required by the Magnuson-Moss Act, A true and correct copy of the BBB's rejection letter is attached hereto, made a part hereof and marked as Exhibit "H." 7 - ~ 31. As a direct and proximate result of Defendant's failure to comply with the express written warranties and implied warranties, Plaintiff has suffered damages and, in accordance with 15 U,S.C. S2310(d) (1), Plaintiff is entitled to bring suit for such damages and other legal and equitable relief, 32, Title 15 U.S.C. provides: If a consumer finally prevails on an action brought under paragraph (1) of this subsection, he may be allowed by the court to recover as part of the judgment a sum equal to the amount of aggregate amount of costs and expenses (including attorney fees based upon actual time expended), determined by the court to have been reasonably incurred by the Plaintiff for, or in connection with the commencement and prosecution of such action, unless the court, in its discretion shall determine that such an award of attorney's fees would be inappropriate. 33. Plaintiff avers that upon successfully prevailing upon the Magnuson-Moss claim herein, all reasonable attorney fees are recoverable and are demanded against Defendant. WHEREFORE, Plaintiff respectfully demands judgment in his favor and against Defendant in an amount equal to the purchase price of the subject vehicle, plus all available collateral charges and attorney fees. To this date said expenses include the replacement of the following items: valve seals and covers replaced ($561.96), check oil lube light ($37.10), lube oil light replaced ($96,30), WHEREFORE, Plaintiff respectfully demands judgment in his favor and against Defendant, in an amount equal to the purchase price of the subject vehicle, plus all available collateral charges and attorney fees. COUNT III UNFAIR TRADE PRACTICES AND CONSUMBa PRO'l'BCTIOH CLADC 41. Plaintiff hereby incorporates paragraphs 1 through 40 by reference as if set forth at length herein, 42. Section 1961 of The Pennsylvania Automobile Lemon Law, provides that a violation of its provisions is also a violation of the Unfair Trade Practices and Consumer Protection Law. 43. In addition, the Unfair Trade Practices and Consumer Protection Law defines unfair methods of competition to include the following: (xiv) , Fail ing to campI y with the terms of II "--- - any written guarantee or warranty given to the buyer at, prior to, or after a contract for the purchase of goods or services is made. 44, Plaintiff believes, and therefore avers, that the reckless, wanton and willful failure of Defendant to comply with the terms of the written warranties constitutes an unfair method of competition. 45. (ieneral !\Iotors, 929 F,Supp, 884. 889 (E,D,Pa, 1996), The factors which a court should take into account when determining whether a disclaimer is conspicuous include: (a) The l'iaeel11ent "fthe disclaimer in the documcnt: (b) the size of the print: and (c) whether the disclaimer is in all capitallctters or is otherwise highlightL-u, hi.
