2G1WL52M2S11024849. The vehicle was purchased and is registered
in the Commonwealth of Pennsylvania,
4. The purchase price of the vehicle, including
registration charges, document fees, sales tax, finance and bank
charges but, excluding other collateral charges not specified, yet
defined by the Magnuson-Moss Federal Trade Commission Improvement
Act, totaled more than $16,722.11. A true and correct copy of the
Sales Agreement is attached hereto, made a part hereof and marked
as Exhibit "A."
5. Plaintiff avers that, from time of delivery to the
present, his vehicle has been plagued by a latent oil consumption
defect in derogation of Chevrolet's express and implied
warranties. Plaintiff first noticed excessive oil consumption at
about 40,000 miles, when the "low lube oil" indicator lit on the
dashboard. On this occasion a quart of oil was added,
6, On July 15, 1996, Plaintiff spoke with Gary Hoover at
Sutliff Chevrolet Co., 13th and Paxton Sts" about the loss of
lube oil and asked him to check the engine to determine the cause
of the oil usage at approximately 43,918 miles, Plaintiff avers
that he spoke with Mr. Hoover, who, after inspecting Plaintiff's
vehicle, informed him that the dealership was aware of the oil
usage but not to be concerned. Plaintiff was not provided an
invoice for said service visit.
7. On November 10, 1996, at 51,528 miles, Plaintiff
changed the oil. From this date through December, 1996, Plaintiff
3
--
avers that Mr. Hoover was aware the subject vehicle was consuming
excessive oil to the point of one quart for every 900 to 1,000
miles.
8. On December 11,1996, at 54,329 miles, Plaintiff avers
that he returned to the dealership for an oil change using a 10
weight oil.
9. By the first week of January, 1991, the subject vehicle
was consuming one quart of oil per every 500 to 600 miles.
Plaintiff continued to check for ground seepage and leaks, but
found none. On January 21, 1997, Plaintiff took the subject
vehicle to a Chevrolet authorized dealer for an oil change and a
replacement PVC valve at 56,161 miles. See paragraph 16, infra.
10. On February 3, 1991, Plaintiff brought the subject
vehicle back to Sutliff as the oil level had again fallen, A
Sutliff technician known as "Dave," identified the problem at that
point as leaking valve covers, informed by a Chevrolet Technical
Service Bulletin. Pursuant to an inspection on or about February
10, 1997, Gary Hoover of Sutliff Chevrolet called Plaintiff and
recommended replacement of the oil pump "0" ring, the intake set
and the valve covers and transmission return line at an estimated
cost of 580 which he offerred at a ten (101 percent discount.
11. Upon the diagnosis of leaking valve covers, Plaintiff
avers that neither Chevrolet nor any agent thereof documented the
concern as an engine problem. Had the problem been properly
diagnosed within the warranty period, Plaintiff avers that said
concerns would have been covered under the express warranty, See
'I
,-..
,.,..,'"~
paragraph 14, infra,
12. On February 11, 1997, Plaintiff brought the subject
vehicle to Graham Motors, a General Motors dealership in Carlisle,
PA. Plaintiff avers he was then informed by an ASE certified
technician that a possible cause of the excessive oil consumption
could be the piston oil rings or the valve seals. Upon the advice
of the ASE technician, Plaintiff replaced the valve seals and
covers at his expense ($741.01),
13. Plaintiff avers that Chevrolet now recommends an out-
of-warranty replacement of the pistons or piston oil rings at a
cost of more than $2,000.00. plaintiff further avers that as a
result of the ineffective and negligent repair attempts made by
Defendant and its authorized dealer to remedy the latent oil
consumption defect, the vehicle cannot be used for the purposes
intended by Plaintiff at the time of acquisition; as such, the
vehicle is worthless,
14, In consideration for the purchase of the above vehicle,
Defendant Chevrolet issued to Plaintiff several written
warranties, including a three (3) year, thirty-siX thousand
(36,000) mile warranty, as well as other standard warranties fully
outlined in the warranty booklet, delivered at time of sale.
15, plaintiff has delivered the non-confortl\inq vehicle to
an authorized service and repair facility of the manufacturer on
numerouS occasions, After a reasonable number of attelllPts,the
manufacturer was unable to repair the non-conformities

16. The first repair attempt is believed to have occurred
on or before January 27, 1997, when the vehicle's odometer showed
56,761 miles, On that date, repair attempts were made to remedy a
defective PCV. A true and correct copy of the repair invoice
summary is attached hereto, made a part hereof and marked Exhibit
"8."
17. The second repair attempt is believed to have occurred
on or before February 12, 1997, when the vehicle's odometer showed
57,777 miles, On that date, repair attempts were made to remedy a
defective transmission cooler line and allegedly defective seals
and valve covers. A true and correct copy of the repair invoice
summary is attached hereto, made a part hereof and marked Exhibit

18. The third repair at tempt is believed to have occurred
on or before March 12, 1997, when the vehicle's odometer showed
59,113 miles. On that date, repair attempts were made to the ECM.
A true and correct copy of the repair invoice summary is attached
hereto, made a part hereof and marked Exhibit "0,"
19, The fourth repair attempt is believed to have occurred
on or before March 13 1997, when the vehicle's odometer sho....ed
59,117 miles. On that date, repair attempts were made to the
defective PCM, A true and correct copy of the repair invoice
summary is attached hereto, made a part hereof and marked Exhibit
"E."

,-.-
20. The fifth warranty repair attempt is believed to have
occurred on or before May 7, 1997, when the vehicle's odometer
showed 61,618 miles. On that date, repairs were made to the
defective oil level sensor. A true and correct copy of the repair
invoice summary is attached hereto, made a part hereof and marked
as Exhibit "F."
21. The vehicle has, in addition to the inherent defects
which have severely compromised the vehicle's oil consumption,
exhibited defects and non-conformities which substantially impair
its use, value and/or safety during the manufacturer's express
warranty and "goodwill" period. Said repairs have been made to the
brakes; steering system; paint; air conditioning unit and left
front window, True and correct copies of the repair invoices
reflecting these concerns are attached hereto, made a part hereof
and marked collectively as Exhibit "G,"
22. In addition, Plaintiff avers his vehicle has been
subject to additional repair attempts for defects and/or non-
conformities and/or conditions for which the dealer did not
maintain records.
23, Plaintiff further avers he has resorted to Chevrolet's
Arbitration process (BBB Autolinel prior to filing the within
Complaint as required by the Magnuson-Moss Act, A true and correct
copy of the BBB's rejection letter is attached hereto, made a part
hereof and marked as Exhibit "H."

31. As a direct and proximate result of Defendant's failure
to comply with the express written warranties and implied
warranties, Plaintiff has suffered damages and, in accordance with
15 U,S.C. S2310(d) (1), Plaintiff is entitled to bring suit for
such damages and other legal and equitable relief,
32, Title 15 U.S.C. provides:
If a consumer finally prevails on an action
brought under paragraph (1) of this
subsection, he may be allowed by the court to
recover as part of the judgment a sum equal
to the amount of aggregate amount of costs
and expenses (including attorney fees based
upon actual time expended), determined by the
court to have been reasonably incurred by the
Plaintiff for, or in connection with the
commencement and prosecution of such action,
unless the court, in its discretion shall
determine that such an award of attorney's
fees would be inappropriate.
33. Plaintiff avers that upon successfully prevailing upon
the Magnuson-Moss claim herein, all reasonable attorney fees are
recoverable and are demanded against Defendant.
WHEREFORE, Plaintiff respectfully demands judgment in his
favor and against Defendant in an amount equal to the purchase
price of the subject vehicle, plus all available collateral
charges and attorney fees.

41. Plaintiff hereby incorporates paragraphs 1 through 40
by reference as if set forth at length herein,
42. Section 1961 of The Pennsylvania Automobile Lemon Law,
provides that a violation of its provisions is also a violation of
the Unfair Trade Practices and Consumer Protection Law.
43. In addition, the Unfair Trade Practices and Consumer

made.
44, Plaintiff believes, and therefore avers, that the
reckless, wanton and willful failure of Defendant to comply with
the terms of the written warranties constitutes an unfair method
of competition.
45. Section 201-9,2(a) of the Unfair Trade Practices and
Consumer Protection Law, authorizes the Court, in its discretion,
to award up to three (3) times the actual damages sustained for
violations of the Act,

"Car owners should expect Increased oil
consumpllon al high speeds, No slandard late 01
consumpllon can be established because under
vanous combinations 01 tho engine sizes and
condlllons menl10ned above, one engine might use a
quart In 2,500 miles and another use a quart ,n
1,500 miles and yel both engines might be normal."
"New engines require conSiderable runnrng lime
before the piston nngs and cylinder walls become
'conditioned' and dunng thiS lime they use Oil more
lapldly than later, Typically, an engine's 0,1 economy
should not be Judged unl1l it has run at least 4,000
miles,"
Also, improper methods of checking oil level may
lead a customer to believe that their vehicle has
excessive 011 consumption, Check 011 on a level
surface. engine off and at operaling temperature.
Allow adequate time for the oil to drain back Into the
oii pan.
Keeping the above Inlormallon in mind, be certain
that the customer IS using the oil lecommended in
the Ownel's Manual. Always use an oil which is
Amencan Pelloleum Instltule (API) certified for use in
gasoline engines, and which displays the API
certlfrcalton mark (Starburst Symbol), Also, always
use an 011 of proper VISCOSity as specllled In the
vehicle's Owners M n
While normal 011 consumption varies, we believe the
use of 2 quarts (1.9L) or male of engine 011 wllhin
2,000 miles or 3,200 kilometers should be cause for
Investigation, Address the follOWing Items to
determine the source of the 011 consumption,
e ., e orm OIL LEAK
DIAGNOSIS found In Service Manual, Secllon 6,
. 011 leaking inlo the cooling system Via a cracked
engine block, Check radlalol tor Ihe presence ot
engine 011.

V. PRELIMINARY OBJECTION BASED UPON THE LEGAL
INSUFFICIENCY OF THE COMPLAINT !DEMURRER) _
PENNSYLVANIA AUTOMOBILE LEMON LAW
29, This defendant. Chevrolet Motor Division. General Motors Corporation,
hereby incorporates by reference, as if more fully set forth at length. its allegations in
paragraphs 1-28 of these preliminary objections,
30, The plaintiff has alleged that the defendant. General Motors Corporation.
Chevrolet Motor Division, has violated the Pennsylvania Automobile Lemon Law,
(Complaint, 1142).
31, The Pennsylvania Automobile Lemon Law provides:
The manufacturer of a new motor vehicle sold and registered
in the Commonwealth shall repair or correct, at no cost to the
purchaser. a nonconformity which substantially impairs the
use. value. or safety of said motor vehicle which may occur
Within a caned of one year followinQ the actual delivery of ~~~
vehicle to the Durchaser, Within the first 12.000 miles of e

32, The new vehicle limited warranty was limited to a term of 36 months or
36,000 miles, whichever should first occur. (Complaint. Exhibit "J"),
33, The plaintiff did not seek repair for any condilion of the new vehicle until
July 15, 1996, almost 2 years from the date on which the plaintiff took possession of the
vehicle, well after the expiration of the new vehicle limited warranty and the term of the
Lemon Law, (Complaint. 116),
34. The plaintiff did not seek any repair to the new vehicle until the vehicle had
approximately 43,918 miles on it, again well after the expiration of the term of the Lemon
Law. (ComplainI.1I6).
35, Because the plaintiffs cause of action is grounded in the Pennsylvania
Automobile Lemon Law, and because the plaintiffs complaint fails to establish a prima
facie case under the Lemon Law, the plaintiffs complaint must be dismissed with
prejudice as legally insufficient as a matter of law.
WHEREFORE. the defendant, Chevrolet Motor Division, General Motors
Corporation, respectfully requests that this Honorable Court enter an order sustaining its
preliminary objections and dismissing the plaintiffs complaint with prejudice as a matter

97-4363 CIVIL
IN RE: DEFENDANT'S PRELIMINARY OBJECTIONS TO PLAINTIFF'S COMPLAINT
BEFORE HESS AND GUIDO, JJ.
OPINION AND ORDER
The defendant. Chevrolet Motor Division of the General Motors Corporation. has filed
preliminary objections to the plaintitl-s complaint. The plaintitl'. Jude Smith, purchased a 1995
Chevrolet Lumina. which was manufactured and warranted by the defendant. on or about
September 14. 1994, The plaintiff avers that from the time of delivery to the time of his
complaint the vehicle has been plagued by a latent oil consumption defect in derogation of the
defendant's express and implied warranties; he claims he is entitled to damages under
Pennsylvania's Uniform Commercial Code. the Magnuson-Moss Warranty Act. and the Unfair
Trade Practices and Consumer Protection Law, I'laintifffurther admits in his complaint that he
first noticed the problem at about 40,000 miles. which is after the expiration of the express
36.000 mile warranty, '}be defendant' s preliminal)' objections are in the nature of demurrers 10
all of lhe plaintil1- s claims. We su.stain all of the objl'Clions.

Under these conditions. the Uniform Commercial Code allows an implied warranty to be
modified, In regard to whether the language is conspicuous. we find helpful the case of
Hornber~er v, General Motors. 929 F,SupP, 884. 889 (E,D, Pa. 1996), The factors which a court
should take into account when determining whether a disclaimer is conspicuous include: (a) The
placement of the disclaimer in the document; (b) the size of the print; and (c) whether the
disclaimer is in all capital letters or is otherwisc highlighted, hi. In 1I0rnber!,!er. the court found
that the disclaimer was conspicuous despite the fact that it was in the middle of a thirty-seven
page warrant)' booklet. The court noted that the disclaimer was the only writing in the booklet
enclosed in a thick, dark-lined box. and that the language ....as in boldface print. ~ hi. at 890,
The disclaimer in this case is identical to the one in Ilornberver and we see no reason to find that
it is not conspicuous.
In this case. the implied warranties are limited to the same restrictions as the express
warranty, Normally. under \3 Pa.C,S. Section 2725 (a) and (b) an action for breach of any
contract for sale must be commenc~'Ii within four years after the breach occurs: and ~a breach of
warranty occurs when tender of delivery is made. except that where a warranty explicitly extends
to future performance of the goods and discovery of the breach must a\\'3it the time of such
performance the cause of action accrues when the breach is or should have been discovered, ~
Assuming the alleged problem with the plaintin's vehicle makes it unfit for its ordinary
purpose it seems e1ear to us that without the limited warranty language the plaintilT could ha\'C
brought an action for breach of implied warranty within four years of delivery of the car,
Furthermore. in light of the l'enn.~yl\'ania Surrcme Cnurt's tkcision in Nationwide In~t1fll~ v,
"

97-4363 CIVIL
since the warmnty period for the vehicles in question was twclve months or 12.(){)() miles. and the
plaintiffs' alleged discovery of the defect was afier twclve months, Other than a shorter warranty
period. the Suzuki warranty in the Connick case has no crucial difierences with the warranty in
this case,
Next. we find that the plaintiff has failed to state a cause of action upon which relief can
be granted based upon the Magnuson-Moss Act. The plaintiff has alleged that the defendant has
violated the Magnuson Moss Act. 15 U,S.c. Sl'Ction 2301 !:1 ~ Specifically. the plaintiff
claims that the defendant violated Section 231 O(d)( I) of the Act. That section allow a consumer
to recover if the manufacturer fails to comply with written warranties provided to a purehaser
upon sale, Since we find no breach of the \\Titlen warranty in this case, we cannot find a
violation of the Magnuson-Moss Act. We further find that the warranty limitation in Chevrolet's
warranty booklet complies with the requirement in the Magnuson-Moss Act that implied
warranties may only be limited in duration to the duration of a \\Titten warranty of reasonable
duration, IS U.S,c. Section 2308(b),
Likewise. we find that the plaintiff has failed to state a cause of action upon which relief
can be granted under the Unfair Trade Practices and Consumer Protl'Ction Law. The plaintilT
claims that the defendant violated the Act by ~failing to coml'l)' with the tcons of any wTitten
guarantee or warranty given to the buyer at. prior to. or after a contract fi.lr the I'urehase of goods
or services is made,~ Again. we find that the defendant complied with the wTillen guarantee. and
therefore. this claim is without merit.
Furtrn:onore. to the extent that the I'laintilT has made a claim that the deti:ndant has
