hereof and marked Exhibit "C."
20. The third warranty repair attempt is believed to have
occurred on or before April 25, 1997, when the vehicle's odometer
showed 12,442. On that date, repair attempts were made to the
defective brakes, including drum and cylinder concerns. In
addition, repair attempts were made to the steering gears. A true
and correct copy of the repair invoice is attached hereto, made a
part hereof and marked Exhibit "D."
21. The fourth warranty repair attempt is believed to have
occurred on or before June 6, 1997, when the vehicle' s odometer
showed 14,360. On that date, repair attempts were made to
alleviate a ticking noise emanating from the engine. A true and
correct copy of the repair invoice is attached hereto, made a part
hereof and marked Exhibit "E."
22. The fifth warranty repair attempt is believed to have
occurred on or before June 18, 1997, when the vehicle's odometer
showed 15,522. On that date, repair attempts were made to remedy
a rough ride condition, knocking noise in the engine; and a brake
pull. A true and correct copy of the repair invoice is attached
hereto, made a part hereof and marked Exhibit "r."
23. The sixth warranty repair attempt is believed to have
occurred on or before July 2, 1997, when the vehicle's odometer
showed 16,569. On that date, repair attempts were made to remedy
a noise emanating from the back of the vehicle. A true and correct
copy of the repair invoice is attached hereto, made a part hereof
c. Implied Warranty Of Fitness For A Particular
Purpose.
39. The purposes for which Plaintiffs purchased this
vehicle include but are not limited to their personal, family and
household use.
40. At the time of this purchase and at all times
subsequent thereto, Plaintiffs have justifiably relied upon
Defendant's express warranties and implied warranties of fitness
for
a
particular
purpose
and
implied
warranties
of
merchantability.
41. At the time of the purchase and at all times subsequent
thereto, Defendant was aware Plaintiffs were relying upon
Defendant's express and implied warranties, obligations, and
representations with regard to the subject vehicle.
42. Plaintiffs have incurred damages as a direct and
proximate result of the breach and failure of Defendant to honor
its express and implied warranties.
43. Such damages include, but are not limited to, the
purchase price of the vehicle plus all collateral charges,
including attorney fees and costs, as well as other expenses, the
full extent of which are not yet known.
WHEREFORE, Plaintiffs respectfully demand judgment in their
favor and against Defendant, in an amount equal to the purchase
price of the subject vehicle, plus all available collateral

25. In addition, Plaintiffs aver their vehicle has been
subject to additional repair attempts for defects and/or non-
conformities and/or conditions for which the dealer did not
maintain records. Furthermore, Plaintiffs

financially damaged due to Defendant's intentional, reckless,
wanton and negligent failure to comply with the provisions of 73
Pa. C.S.A. Sl951 et seq.

Chrysler's Arbitration process (Customer Arbitration Board) prior
to filing the within Complaint as required by 73 Pa. C.S.A. S1959.
28. Pursuant to 73 Pa. C.S.A. S1958, Plaintiffs seek relief
for losses due to the non-conformities and defects in the above-
mentioned vehicle in addition to reasonable attorney fees and all
court costs.
WHEREFORE, Plaintiffs respectfully demand judgment in their
favor and against Defendant in an amount equal to the purchase
price of the subject vehicle, plus all available collateral
charges and attorney fees.

At a pretrial conference held Wednesday, February 25,
1998, before the Honorable Edward E. Guido, Judge, present for
Plaintiffs was Samuel B. Fineman, Esquire, and present for

The Defendant has related that this case was only
filed in August of 1997, and there has been a recent development
where the vehicle was involved in an accident. The Defendant
has only recently received the police report for that accident
and additional discovery needs to be completed as follows:
1. Deposition of Plaintiffs.
2. Depositions of various witnesses listed in the
police report.
3. A reinspection of the vehicle.
All of the additional discovery shall be completed May
20, 1998. Upon completion of discovery, Plaintiffs may relist
the case for trial. The Court has indicated to Defendant that
it will not entertain any further requests for continuance from
the Defendant.

coverage. It is undisputed Ihat warranty work was never declined by a Chrysler dealer based upon a

Section 2715 of The Unifonn Commereial Code allow~ n.'Covery for: "any commercially
reasonable charges, expenses or commissions in connL'Ction with eITecting cover"; (2715(a)-(2))
and "...any other reasonable expense incident to delay or other bn.'aCh." (2715(a)(3)). If any
clements of damage are found not to be applicable under the lemon law. plaintilT asserts recovery
under the Unifonn Commercial Code.
VI. UNfAIR TRADE PRACTICES AND ~ONSVMER PROTECTION ~L..MMi
PlaintilT advances two separate but related theories of recovery in accordance with lh:
Unfair Trade Practices and Consumer Protection Law. Section 1961 of the Lemon Law specifically
mandates. in no WlCenain terms. that a violation of the Lemon Law shaD also be a ,iolation oflh:
Unfair Trade Practices and Consumer Prolection l..aw. *:!01-9.2(a). It is clear from the wording of
* 1961 that the Legislature sought to rctnOve the issue of wbetber the manufacturer's conduct was
"outrageous" (as required by the UTPCPL). b)' limiting the Court's discretion to the mlpltade of
that conduct. The Court is compelled to award some amount of treble "actual" damages under the
Lemon Law. 73 P.S. ~201-9.2; McClelland v. H\lllldai Motor Americ!!. 93-CV.3399 (E.D. Pa.
April n. 1994. per Katz. 1.). for example. in lIassinlZer v. Genera1 Motors Comoration.
(U.S.D.C.E.D. Pa No. 87-56n, March 2.1988). the Court awarded plaintilTan additional 55,000
under the Unfair Trade Acl for a violation of The Lemon Law.
Section 201-2(4)(xiv) defines unfair or deceptive acts to include failing to comply Vlith the

Thus. if the jUI)' finds a violation of thc Lcmon Law. the Unfair Trade Practices Act has
been violated as well. To wit: (I) thc warrant)' was breached; and (2) the repairs made to the
vchiclc \\'ere below the standard agn.'\.'d to in writing (i.c. the New Vehicle Limited Warranty
promise to repair dcfects in materials and workmanship).
Lending additional suppon 10 UTp<"PL damages. it must be remembered that the Lemon
Law requires Chrysler to compl)' without need for litigation. By refusing its obligation at law. the
LegislalUrc sought to sanclion such conduct by awarding treble damages to the customer. If
UTPCPL damages an: not awarded. the manufacturer is merely faced with the prospect paying a
judgment equal to a refund. precisely the same amount to be paid prior to litigation. Such an
outcome SCl'\'es no deterrent effect and ignores the mandates of ~1961 of the Lemon Law.
The facts surrounding this case establish a clear \;013tion of the ternon Law and as such.
plaintilh.ill seek an additionaJ award of up to Three (3) times the actual damages incum:d upon
successful result in this case.

PRBTRIAL MEMORANDUM
Defendant, Chrysler Corporation, by and through its
attorneys, Marshall, Dennehey, Warner, Coleman & Goggin, hereby
submit its Pretrial Memorandum in accordance with CUmberland
County Rule of Court 212-4.
I. STATI5lUlfT OF FACTS AS TO LIABILITY I
This case involves the purchase of a 1996 Dodge Ram 2500
Series truck. Plaintiffs' counsel has brought this lawsuit under
several theories of liability including the Pennsylvania Lemon
Law, 73 P.S., et seq" the Magnuson-Moss Act, 15 U.S. 52301, et
seq., the Pennsylvania Uniform Commercial Code and the
Pennsylvania Unfair Trade Practices and Consumer Protection Law,
P.S. 5201-1 et seq.
Plaintiffs' claim under the Unfair Trade Practice Act is
predicated upon his claim under the Pennsylvania Lemon Law. The
Pennsylvania Lemon Law provides at 7) P.S, 51961 that a violation
of the Lemon Law is also a violation of the Unfair Trade
Practices. However, as will be established at trial, the
defendant has not violated the Pennsylvania Lemon Law.
In addition, plaintiffs' claim under the federal Magnuson-
Moss Warranty Act is predicated upon his claim under the
Pennsylvania Uniform Commercial Code for breach of warranty.
Plaintiffs have only attempted to plead the Magnuson-Moss Act
because it provides for attorney fees should the plaintiffs
finally prevail and if fees are awarded in the discretion of the
court.
Plaintiffs' claim in reality is no more than a claim under
the Pennsylvania Lemon Law and one for breach of warranty, The
plaintiffs have identified only two allegedly unresolved
complaints with their automobile. One deals with the paint on
their automobile. The plaintiffs reported very minor spots in
the paint of their Dodge truck to the Chrysler dealership five
months after purchase. However, the dealership determined that
the paint spots were caused as a result of atmospheric fallout or
acid rain. The cause of the spots was substantiated by
plaintiff-husband's own repair shop who submitted an invoice
stating that the paint blemishes were caused by acid rain. Acid
rain damage is not a condition covered under Chrysler's warranty.
In fact, acid rain/atmospheric fallout cosmetic concerns are
specifically excluded from Chrysler's warranty, Nevertheless, in
the interest of the customers' satisfaction and to settle the
claim, Chrysler agreed to re-paint the vehicle. The plaintiffs
refused and insisted that all repairs be done to his vehicle by
his chosen repair facility. In settlement, Chrysler agreed to
pay for paint repairs at the facility chosen by the plaintiffs
and the repairs were performed, Payment for the repairs was made
in settlement of the claim and an accord and satisfaction was
worked. Plaintiff-husband now complains that his own chosen
repair facility did not do a good job; however, his claim has
been settled by operation of law.
As can be established by the plaintiffs' own complaint at
Paragraph 19, the first report of a complaint with regard to
brakes occurred on April 21, 1997, when the vehicle had 12,281
miles on it. Chrysler's warranty only covers brakes for the
first 12 months or 12,000 miles of use whichever comes first,
The Pennsylvania Lemon Law applies only to conditions reported
with the first 12,000 miles. In the interest of customer
satisfaction repairs were made after the expiration of the
warranty. The plaintiff-husband remains dissatisfied with regard
to his brake repairs; however, his dissatisfaction does not
equate to a breach of Chrysler's express limited warranty and the
Pennsylvania Lemon Law is inapplicable.
II . STATBMBNT OF FACTS AS TO DAMAGBS I
The plaintiffs have not been damaged as a result of any
action or inaction on the part of Chrysler Corporation. As
stated above, Chrysler's warranty does not cover acid rain damage
which is a condition outside of its control. Further, to the
extent a claim existed, Chrysler extinguished the claim when it
paid for re-painting done at the facility of the plaintiffs'
choice, Plaintiffs' complaint with regard to brakes occurred out
of warranty and there have been no damages as a result of the
Chrysler Corporation paid for a re-paint job at the facility of
the plaintiffs' choice.
Plaintiffs' complaints with regard to the brakes of the
vehicle and in fact all other complaints occurred after the
vehicle was driven for 12,000 miles and none of these conditions
are relevant to a violation of the Pennsylvania Lemon Law. See
plaintiffs' Complaint, paragraphs 19 through 23. Indeed,
Chrysler's express written warranty only covers brake wear for
the first 12 months or 12,000 miles whichever occurs first.
There are no damages under the Pennsylvania Lemon Law.
Because the Pennsylvania Lemon Law has not been violated the
plaintiffs cannot rely on 73 P.S. ~1961 which provides that a
violation of the Lemon Law is also a violation of the Unfair
Trade Practices Act. Further, plaintiffs have neither pled nor
can they prove any unfair trade practice which involves the
unfair/fraudulent culpable conduct required under the Act.
The only remaining avenue the plaintiffs may attempt to
recover under is for breach of warranty under the Uniform
Commercial Code. However, as stated, there can be no breach of
warranty for the paint condition which was excluded under the
warranty and which was settled. Nor can there be a claim for
breach of warranty for the brakes when the alleged condition
occurred outside the period of warranty coverage.
Even if the plaintiffs were able to suport an allegation of
breach of any warra~ty, the measure of damage for breach of
warranty is only a sum equal to the difference at the time and
place of acceptance between the value of the goods accepted and

the value they would have had if they had been as warranted, 13
P.S. ~2714(b) AM/PM Franchise Ass' and the Atlantic Richfield
~, 584 A.2d 915, 920 (Pa, 1990), Cober v. Corle, 610 A.2d
1036, 1040-41 (Pa. Super. Ct. 1992). The difference between the
value lias is" and "as warranted" can be measured by the cost of
repair. See, Pomoa v, Hart, 15 Pa. D.&C, 4th 119, 124 (1992).
The plaintiffs must prove by expert testimony the difference
between the two values or provide evidence of the cost of repair.
Plaintiffs have provided no expert report which provides the
value of the difference in the product as received and as
warranted. The failure to prove these elements is fatal to
plaintiffs' claim. Even assuming arguendo the plaintiffs could
prove a breach of warranty and damages, their claim would be
limited to either the cost of the vehicle with and without the
minor acid rain spotting or the cost of its repair (which has
already been provided to the plaintiffs) and the cost of a brake
repair. at most the cost a completely new set of brakes. Under
the worst case scenario the value of this case is well under
$2,000.00.
IV. SUMMARY OF LEGAL ISSUES:
Defendant incorporates by reference the issues and
authorities discussed above. In addition, defendant contends the
testimony with regard to repairs and complaints outside
Chrysler's applicable warranty provisions must be excluded as
irrelevant and prejudicial.

52. Denied. To the contrary. the Plaintiffs have sought help from numerous other
dealerships as well as from the National Cenler for Dispute Selllement, Chrysler's "non-partisan"
arbitr,lIion unit to no avail. In fact, none of the self-help measures employed by Plaintiffs have had
an effect on reconciling Ihis mailer. Further. in response to Defendant's Answer, Paragraph 27,
Plaintiffs aver that they in fact resorted to said Chrysler's Arbitration process and their claim was
denied. Chrysler's Answer in said Paragraph 27 is patently inaccurate.
53. Specifically denied.
54. Denied. As stated in the Complaint and as shown in attached Exhibits "B," "C," "D."
"E:' "F:' and "G." the vehicle was serviced in order 10 attempt to repair the defective engine, brake
drums. and rear wheel cylinders, at least three times. \\oith no effective repair. As such, a reasonable
number of repairs were attempted. Finally. the non-confonnities of a defective engine and brakes,
most certainly, impair the use, value and safety of the vehicle.
55. Denied, Rather, it is averred that Plaintiffs' claims are not time-barred because they fall
well within the applicable statutes oflimitation. Actions under the Lemon Law and Magnuson-
MDSS Act may be brought within four years of the discovery of a defect. Actions arising under the
Unfair Trade Law may be brought within six years of when the cause of actiDn accrues. Gabriel v.
o '/lara. 534 A.2d at 493. As for breach of express warranty, the applicable statute of limitations.
13 Pa.C.S.A. sec. 2725. provides that a breach of warranty action must be commenced within four

remaining averments of paragraph 3 of plaintiffs' Complaint and

including the charges and fees enumerated in plaintiffs'

and the alleged charges and fees do not total more than the sum
