7. Admitted. By way of further Answer the written notice
provided to the Plaintiff on or about April 21, 1997 also
included the Defendant's new address as a place to which the
Plaintiff could send an itemized list of damages.
8. Denied. Defendant claims that at most she only owed
the Plaintiff two (2) months rent which would have totaled
$750.00.
9. Denied. The Defendant was out of the premises on or
about May 15, 1997 and she surrendered a key to the Plaintiff by
leaving same at the residence when she left.
10. Denied. It is denied that the Defendant is responsible
to the Plaintiff for rent for any amount following May 22, 1997.
11. Admitted.
12. Denied. It is denied that the Defendant caused damages
to the Plaintiff's property as outlined in Plaintiff's Exhibit
"B". It is specifically denied that the Defendant failed to pay
outstanding bills for sewer and water services. By way of
further answer it is averred by the Defendant that the Plaintiff
never gave Defendant notice of a list of damages and the costs of
repairs prior to July 14, 1997 which was more than thirty (30)
days beyond the date that the lease was terminated.
13. Denied as irrelevant. This paragraph serves no purpose
and has no relevancy to this proceeding.
COUNT I
BREACH OF CONTRACT
14. Paragraphs 1 through 13 are incorporated herein by
reference as though set forth at length.
15. Denied. This allegation is a conclusion of law. To
the extent that this allegation is not a conclusion of law the
Defendant specifically denies that she owes the amount of rent
claimed by the Defendant, that she caused the damage to the
property as outlined in the Plaintiff's Exhibit and she
specifically denies that she failed to pay for sewer and water
services.
16. Denied. Defendant claims that although she may owe the
Plaintiff unpaid rent, the amount of unpaid rent is considerably
less than $1,875.00 and she denies that the damages that were in
fact done to the leasehold premises equal $430.00.

WHEREFORE, Defendant prays that judgment will not be entered
in favor of Plaintiff but that judgment will be entered in favor
of Defendant.

Plaintiff in writing that she was terminating the lease effective
May 22, 1997.
20. Defendant did in fact vacate the premises on or about

21. In the written notice which the Plaintiff received on
or about April 21, 1997, the Defendant advised the Plaintiff in
writing of her new address.
22. The Plaintiff did not advise the Defendant in writing
with regard to her security deposit and provide Defendant with an
itemized list of damages within thirty (30) days of the date of
her termination of the lease.
COUNTERCLAIM
23. Paragraphs 1 through 22 are incorporated herein as if
set forth at length.
24. The Plaintiff has violated the landlord-tenant laws by
not providing Defendant with an itemized list of damages and an
accounting of her security deposit within thirty (30) days of the
date she terminated the lease.

to twice the security deposit, or $750.00.
