AND NOW, comes Financial Trust Company, through its attorney, William A.
Duncan, Esquire. and files this Complaint in Mortgage Foreclosure, of which the following is a
statement:
1. PlaintifTis Financial Trust Company, a corporation organized and existing under
the laws of the Commonwealth of Pennsylvania with its main office and principal place of
business located at I West High Street, Carlisle. Cumbcrland County, Pennsylvania 17013.
2, Defendant, NICHOLAS A. RlLlO, an adult individual, and Defendant, JOSEPH
A. RlLLO, JR" an adult individual, and NICHOLAS A, RlLLO and JOSEPH A.. RlLLO, JR,.
a partnership dIbIa RILLD'S OF CARLISLE, with its principal place of business Ioc:ated at SO
Pine Street, Carlisle, Cumberland County. Pennsylvania
3. On or about December 21, 1990, Defendants made. Cltecuted and delivered to

5, Said real estate mortgage and modification agreement have not been assigned.
6. Nicholas A. Rillo and Joseph A. Rillo, Jr., partners d/b/a Ri\1o's of Carlisle, are the
sole record owners in fee simple of said premises subject to said mortgage, by virtue of a Deed
dated March 30, 1990, and recorded in the Cumberland County Recorder's Office in Deed
Book "M", Volume 34, Page 1145, more specifically set forth in Exhibit "C", attached hereto
and made a part hereofby reference.
7, Said real estate mortgage and modification agreement are in deflult because
Defendants herein have failed to pay the payments that were due and owing for the months of
June 1997 and July 1997.
8. Said real estate mortgage and modification agreement are in default because
Defendants herein have failed to pay the 1995, County, Township and School taxes due and
owing on the premises in the amount on 12,195.76 and the 1996 County, Township and
School tlXes due and owing in the amount ofs 11,62674
9. By reason of the aforesaid default. the entire principal balance of Four Hundred
Seventy-nine Thousand Seventy.nine and 71/100 ($479.019.11) Dollars. with intCFest thereon
at the rate ofTen and one-balf(IO.50) % per annum computed from June 2S, 1997, and
attorney's fees in the amount of Twenty.three Thousand Nine Hundred Fifty-three and 99/100
($23,9S3.99) are now due and payable
