5, Prior to the purchase of the vehicle, a sales agent employed by Willow
View represented that the vehicle had been examined by a Willow View mechanic and
that the vehicle was in good operating condition and that there were no mechanical
problems associated with the vehicle,
6. Simultaneous to purchasing the vehicle, Killinger purchased a warranty
for the vehicle from Guardian for $325,00. A copy of the warranty document is
attached hereto as 'Exhibit B" and incorporated herein by reference.
7. The warranty purchased from Guardian was described by Guardian as a
"power train and major assembly component protection' warranty which was a six
monthl6,SOO mile warranty
8. Approximately one week after Killinger purchased the vehicle, the "oil"
light illuminated in the vehicle during operation, and Killinger subsequently checked the
oil using the dipstick and there was no oil on the stick Killinger proceeded to add four
quarts of oil to motor of the vehicle at that time.
9. Killinger immediately contacted both Guardian and Willow VifNI regarding
the excessive oil consumption and neIther party would authorize that the vehicle be
checked for mechanical problems
10 On January 27, 1997, lifter continued excessive oil consumption. Killinger
took the vehtde to Hanover Auto Works, CartiSle. Pemsylvania, and a diagnostic

WHEREFORE, Killinger demands judgment against Guardian for the repair bills
set forth above and the unpaid rental coverage in the total amount of $2,500,34 plus

20. Guardian issued Killinger a written warranty in connection with Killinger's
purchase of the vehicle, and Guardian has failed to comply with the terms of the
warranty it issued to Killinger.
21. Guardian's conduct as set forth in this Complaint is in direct violation of
the Unfair Trade Practice and Consumer Protection Law, 73 PS section 201-2(4Xxiv).
WHEREFORE. Killinger demands judgment be entered against Guardian for
three times Killinger's actual damages as ascertained by the court pursuant to 73 P.S.
section 201-9(a) plus costs.
