Evaluation Repon (CER) and will be given to the Individualized Education Program (IEP)
Team The Reevaluation is to be completed and the Repon is to be disseminated to you within
60 school days of receipt of your consent to reevaluate.

Scale - Revised On 11/11/99 Eli's mother rompleted Ihe Conners' Parellt Raling Scale
-. Revised The school district received the Parent Rating Scale Ii'om Eli's father
December 7, 1999. This instrumenl is one tooltllQl can be used to aid in identifying
children who may have Attention Deficit Disorder with/without Hyperactivity.
There arc a total of four scales on this instrument Oppositional. Hyperactivity, Cognitive
Problems, and Conners' ADlID Index. Individuals scoring high on the Opposilional
Scale are likely to break rules, have problems with those in authority, and are more easily
angered or annoyed compared to others of Ihe same age. Those scoring high on the
Hyperactivity Scale have dilliculty sitting slill, feci more restless and impulsive than
others. and have a need to be always on the go. Those scoring high on the Cognitive
Problems Scale tend to learn more slowly than most their age. They also have problems
organizing Iheir work. they have difficulty completing tasks or schoolwork, and they
appear to have dif1iculty concentrating Finally. the Conncrs' ADIID Indcx identifies
children "at risk" for ADHD.
Scores are reported as being markedly/moderalely atypical (indicates significant
problem). mildly atypical (possible significant problem), slightly atypical (borderline:
should raise concern). and average (typical score). All scures arc based on comparison to
others of the same gender and age.
Results oflhe Teacher's Rating ~kale indicate that Eli's scores on the Cognitive
Problems Scale and the Oppositional Scale arc within the Average range On the other
hand, scores on the Hyperactivily Scale and Ihe Conners' ADHD Index indicate a
significant problem, as they fall wilhin Ihe Moderalely to Markedly Atypical range,
Eli is very frequenlly restless in a "squirmy" sense, is always 'on the go,' he cannot
remain still, and he disturbs others in class. He also very frequently leaves his scat.

squirms in his seat, he gets distracted when given Instructions to do something, he has
difficully waiting in lines or waiting his turn in games. and he leavcs his scat when
rcmaining scatcd is expectcd.
Classroom Observation
During a classroom observation it was noted that Eli wa.5 on-task only 54% of the time,
He was frequently OUI of his seat, he called out sc',cral timcs, and hc continuously had
somcthing 10 his hands to manlpulatc, Whilc thc tcachcr was talking, Eli gal oul of his
seat, got on his knees, and bcgan routing in his desk: Hc did this three times during the
obscrvation, In addition, hc also laid undcr his dcsk and crawlcd on the floor; all of this
whi Ic thc Icachcr was prcscntlng a Icsson
In summary. il is clear Ihat both the parents and the teacher see behaviors indicative of
one with Allention Deficit Hyperactivity Disordcr. Thcsc results should be reported to

INFORMATION FROM OBSERVATIONS IN TilE CL.ASSROOM AND OTHER
SETTINGS:
Durinll a classroom observation it was noted that Ryan was on-task 61% oflhe time.
During the observotion Ryan was at times confrontational, unmolivaled, and obstinate. At olher
times he complied without incident to requests made by the teacher or aides. AI the beginning of
the period Ryan sat in the front of the room at the table wilh two other peers. the teacher. and one
of the classroom aides, They wre reading from a Science textbook and going over the material as
they went along. When the teacher Bsked Ryan to read aloud, he refused, When asked a
question, he responded inappropriately, Finally, after more prompting Ryan agreed to read aloud
with the help of an aide who pointed to th" words for him and told him the words he did not
know. When the teacher asked him to stop reading 50 that they could review what was read,
Ryall did 50. When the teacher then asked another student to rcad, Ryan objected; he wanted to
keep reading, Ryan was told he could read again later. At that point. Ryan stopped complaining,
Later when the group was again reviewing the test, Ryan was asked how he felt about something;
Ryan replied inappropriately. saying that he didn't care. After that, Ryan hegan calling out
answers. Ryan stood up at one point and began fixing his pants, When the aide asked him to
return to his seat. he complied, When asked to keep his head up off of the table. Ryan did not
move, After the aide touched his shoulder and again requested, Ryan called out, "Don't touch
me'" At the end of the period Ryan got up out of his seat and walked away from the table,
SUMMARY OF FINDlNGSIINTERPRETATION OF ASSESSMENT RESULTS:
-Student', Current Performance (inr.luding cognitive, developmental and physical functioning)
Ryan appears to be functional slightly below the average range based on coversations
with the school psychologist. Developmentally Ryan is functioning on a It-vel below his peera
in terms of fine motor skills. He is functioning below the level of his peers in tenns of
motivation. Physically he does not present any concerns.

grade. Eli lJuulitied fi.lr Speech and I.un!!uag~ services while Kindergarten and has received
reading services in grudes one and two. On the Kaulinan Brief Intelligence Testudministered by
Ms. Kecner, Guidancc Counsclor. it is nl.lted that Eli is Ilmctioning within the low Average range
of cognitive ability (Vocabulary 85, Matrices 90, Composite 86). Eli was the subject of an
Attention Deticitllyperactivity Disorder sneening in January of this year. Results indicate that
Eli, in tilct, exhibits characteristics similar to those diagnosed as having the disorder It was
suggested that Eli's parents report the r~sults to his doctor
Eli gels along well with his pccrs and is rcspectful of others lIis tillhcr reports that Eli is a
fricndly child, hc is courteous to othcrs, and he gcts along well with his brothers and ~tepsister,
Both parents report that Eli has asthma and allergies, Thc schoolnur~c reports that Eli has

Eli's mother feels that he is still in nccd of speech and reading help, She said that he has made
some wonderful improvements with help last year, Eli's father feels that Eli does not retain
infom13tion like his peers, he read~ slowly, he has a speech impairment, and he may have
Attention Deficit Disorder. He notcs that Eli is far bchind his peers in terms of academic progress
and that he needs help in the areas of reading, math, writing, homework, and organizational skills,
He also states that Eli bas a constant need to be jumping around and that, "if he is not glued to the
Nintendo or the computer he is in his own little world with imaginary friends, jumping around,
bouncing around, and never sitting still." In addition, Eli has difliculty completing anything from
start to linish without being remindcd Finally, Mr. Sheffield notes that Eli's strengths include
playing with the Nintendo or the computer,

During a classroom observation Eli was out of his scat and sometimes sitting on the floor during
classroom activities, Eli was able to follow directions and attend to classroom work with
additional prompts from his classroom teacher. Eli was unintelligible in unknown contexts during
classroom participation. The teacher needed to ask Eli to repeat himself so he could be better
understood, Eli did so willingly.

74% correct, which indicates his grammatic usage is below that of his peers, Some errors
found were deletion of the vcrb "is", is/arc, subjective pronoun crrors (them/they), possessive
pronoun errors (yours dress), they/she, have/has, was/were, Eli was also given the Arizona
ArticuJJ!ljon Proficien~Scale. Hc received a score 01'<)15, which indicates that speech is
intelligible, although noticeably in error, at the word level, However, an infornlallanguage
sample was performed, And it was found that Eli had more errors in connected speech than
what was found on the articulation test. Some errors noted were: kr/tr, deletion of /s!, w/y,

3. There is an existing Order of October 29, 1997, which provides
the paternal aunt and uncle primary physical custody. The
issue at this time is the fact that the older child, Ryan, is
not going to visit with the mother pursuant to the existing
Order on alternating weekends. Ryan is currently under
counseling with Philhaven and Ryan, at age 12, is suggesting
he does not want to go to visit the Mother. The Mother wants
a hearing to have the Court compel Ryan to go to visit with
the Mother. Mother is also suggesting that, at a later date,
she may want a hearing to request that she have primary
custody of the three minor children

The parties, by their undcrslgncd counscl, n:spectfully represent that:

I, This agreement concerns custody and support for thrce minor children: Ryan Matthew
Sheflield (DOB May 26, (9985); Zachary Natlmnial Sheffield (DOB October 29, (987); and
Elijah Andrew Shefficld (DOB March 20, (991) (hereafter "children"),
2. Plaintiff Kenneth 0, Sheffield (hereafter" rathcr") is the children's natural father, and
Defendant Cheryl A, Sheffield (hcarafter "Mother")is thc children's natural mother. David and
Mary Sheffield (hereaftcr "Uncle and Aunt") are Father's brother and sister-in-law, respectively,
and are the children's paternal uncle and aunt,
3. On or about August 25, 1997, Father filed a Petition for Custody against Mother.
seeking custody of the childrcn.
4, On or about Octobcr 8, 1997, Mothcr filed a Petition for Joindcr to join Uncle and
Aunt as parties to this action, Uncle and Aunt have actively participated in every significant
phase of this case,

5. By Orders dated October 29, 1997, and December 19, 1997, the Court granted
primary physical custody of thc children to Uncle and Aunt and regular periods of temporary
custody to Mother and rather, True copies of these orders arc attached and incorporated by
rcference,

7. The partles 11Ilve a!!rced to resolvc their differenccs und havc u!!rccd to the following
terms and conditions concerning custody and child support, which they dcsire to have the Court
adopt as hs own Ordcr:
a) Mothcr, Dcfendant Chcryl A, Shcffield, shall have primary physical custody
of the children.
b) Father, Plaintiff K~nncth D, Sheffield, shall have partial physical custody
every other weekend and at such other times as thc parties agree upon from time to time,
c) Mother and Father shall share lcgal custody of the childrcn.
d) Neither parent shall take any child out of state for a period of more than two
consecutive days without giving the other parent advance noticc,
e) A holiday and vacation schedule shall be as thc parents agree upon from time
to time, except that Father shall have the children for two weeks for vacation during the
summer,
I) Uncle and Aunt shall have partial custody of the children one Sunday per
month, on a date to be agreed upon by the parties, from the time church services are over
(approximately noon) until 6:00 p,m, Uncle and Aunt shall provide all transportation for these
periods of partial custody, which shall not intefere with Father's periods of partial custody or
either parent's holiday or visitation schedule,
g) Each party shall promptly notify the othcrs of any medical emergency or other
important matters involving any of the childrcn,
8, Mother and Father and Uncle and Aunt have agreed to the following tenns and
conditions concerning support and desire that the Court adopt these as its own Order:
a) Futhcr shall cnsure that the children havc health-care lnsufllllce covcrllge,
b) Fulher shall pay Muther $100 II wcck for chlld support. Each of thelll shull
rctain the right to petition the court to lllodlfy this lllllOUnl.
c) Upon thc Court's lldoptlon of this llgrccment in lln Order, euch purty shull
promptly tuke all neccssury stcps to dlscontinuc any existing Domestic Rclatlons case involving
the parties illler 51!,
'd) Copies of this agreement and subscquent court orders shall be t1Ied In the all
relevant t1Ies in the Domestic Relations Office, including PACSES Case Number 538000078,
e) In adultion to the support paymcnts mcntioned above, Fathcr agrecs to help
Mother with miscellanous and special expenses incurrcu involving the childrcn (e,g, school
clothes, school pictures, registration fees for spurt activitics),
t) Father and Moth~r acknowledge and agrce to pay Uncle and Aunt $808,50 on
account of a loan in that amount by the latter tu the former.
g) Father and Mother acknowledgc and agree to pay Uncle and Aunt $1561.16
on account of expenses the latter incurred while caring for the children,
WHEREFORE, the parties pray that the Court adopt this agreement as its own Order and
cancel the hearing scheduled for March 30, 1998,

A hearing is scheduled in Court Room No...2- of the Cumberland

case. The purpose of this hearing will be to address the
issue of the minor child, Ryan Matthew Sheffield, refusing to
go to visit with the Mother on scheduled periods of
visi tation.
Pending further Order of this Court, this Court.s prior Order
of October 29, 1997, shall remain in effect.
For Christmas 1997, the Father shall have custody through
Christmas Day at 3:00 p.m. Father shall deliver the minor
children to the Mother who shall have custody on Christmas Day
from 3 :00 p.m. through that weekend which is her regularly
scheduled weekend of temporary custody.
It is directed that Mother shall be kept advised concerning
all counseling sessions scheduled concerning Ryan or any of
the other children and any counsellor who is providing family
therapy or any other counseling shall meet with the Mother and
keep the Mother involved in the counseling sessions.
Neither parent or adult having custody of the minor children
shall disparage the other parent or other custodian to tha
minor child.

1. The pertinent information pertaining to the children who are
the subject of this litigation is as follows:
Ryan Matthew Sheffield, born May 26, 1985; Zache~y Nathaniel
Sheffield, born October 29, 1987; and Elijah Andrew Sheffield,
born March 20, 1991.
2. A Conciliation Conference was held on December 11, 1997, with
the following individuals in attendance:
The Father, Kenneth V. Sheffield, and the paternal aunt and
uncle, David S. Sheffield and Mary L. Sheffield, along with
their counsel, Marcus A. McKnight, III, Esquire; and the
Mother, Cheryl A. Sheffield, with her counsel, Suzanne Sporri,
Esquire, of the Dickinson School of Law l-"amily Law Clinic.
3. There is an existing Orde~ of October 29, 1997, which provides
the paternal aunt and uncle primary physical custody. The
issue at this time is the fact that the older child, Ryan, is
not going to visit with the mother pursuant to the existing
Order on al ternating weekends. Ryan is currently undlfr
counseling with Philhaven and Ryan, at age 12, is suggesting
he does not want to go to visit the Mother. The Mother wants
a hearing to have the Court compel Ryan to go to visit with
the Mother. Mother is also suggesting that, at a later date,
she may want a hearing to request that she have primary
custody of the three minor children

the attached Custody Conciliation Report, it is ordered and
directed as follows:
1. The Mother, Cheryl A. Sheffield, and the Father, Kenneth D.
Sheffield, shall enjoy shared legal custody of Ryan Matthew
Sheffield, born May 26, 1985; Zachary Nathaniel Sheffield,
born October 29, 1987/ and Elijah Andrew Sheffield, born March
20, 1991.
2. The Paternal Aunt and Uncle, David S, Sheffield and Mary L,
Sheffield, shall enjoy primary physical custody of the three
minor children.
3. The Mother shall enjoy periods of temporary physical custody
of the minor children on alternating weekends from Friday at
6:00 p.m. until Sunday at 2:00 p.m. or 6:00 p.m. Mother shall
advise the Aunt and Uncle on Friday as to when the time of
custody will end on Sunday, The Aunt and Uncle shall handle
transportation for exchange of custody at those times. Mother
shall also enjoy temporary custody one evening a week for
purposes of taking the minor children to a counsellor for
family counselling sessions.
4. The Father shall enjoy periods of temporary physical custody
of the minor childJ..-en on alternating weekends at times as
arranged between the parties.
5. The Counsell,ing sessions referenced above shall include in
attendance at those sessions such individuals as a counsellor
determines are appropriate for meaningful counselling
sessions.
6.
The Paternal Aunt and Uncle, David S. Sheffield and Mary L.
Sheffield, shall have the authority to make decisions with
respect to emergency medical treatment for the three minor
children. They shall at all times keep both parents advised
with respect to any required emergency medical treatment and
also with respect to all matters pertaining to the children's
schooling including school conferences, report cards, etc.

defcndant, mothcr, Chcryl A, Sheflicld, In violalion of Pa.R.Civ.P. 1915.15, plaintiff fathcr,
failcd to indicate whcrc alld with whom the childrcn have rcsidcd during thc past fivc years,
6, Betwccn thc time of the partics' separation and August 15, 1997, the children
resided with mother. Subscquently mother turncd the childrcn ovcr to their patcrnal aunt, Karcn
Shcffield, for a weckend, aftcr which father was to have the children for a one wcek vacation
beforc thc start of the school year.
7. On or ahoUl August 22, 1997, mothcr Icarncd that father had rcmovcd thc children
from the area and had discnrolled them from the Big Spring School District.
8, Atthc end of August, 1997, the children residcd briclly in Monrocville, PA with
father and his paramour, Karen (last namc not known to petitioncr). Father Informcd mother
that the children would remain with him and his paramour for a year; mOlher did not agree to
this.
9. On or about Scptembcr 24, 1997, molhcr discovcrcd that the children were not
rcsiding with thcir fathcr, Kcnncth Shefficld, but wcrc instead rcsiding with David and Mary
Shcfficld, father's brothcr and sister-in-law, at 10 Cedar Road, Carlisle, Cumberland County,
PA 17013. Mother subsequently learned that the children are en roiled in Cumbcrland Valley
School District.
10. On information and belief, thc children continuc to reside with thcir paternal aunt
and uncle David and Mary Sheffield in Cumberland County,
