COMPLAINT
1. We, Richard C. Ouble and Carel A. DubIe, paid $1,207.00 to Wesley Shilling
(payable in cheeks/cash and a rocking chair that we all agreed to 0. worth of $100.00)
to rebuild the engine in our 198; Buick.
2. On May J, 1997 we, Richard C. DubIe and Carol A. DubIe, delivered the rocking
chair to Wesley Shilling's retlidence and picked up our Buiclt.
3. Wesley Shilling told us to bring the Buick back in 0. few days for a check-up
and Wlsured us a number of times that the car was in good wO:rking order.
4. We, Richard C. DubIe and Carol A. DubIe, drove from Wesley Shilling's residence
in Newville, PA to Carlisle, PA and noticed that the oil light was indicating low
oil pressure when the engine was idy1ing.
5. Richard C, DubIe called Wesley Shilling from our friend, Marion Fennell's
residence in Carlisle, PA, to tell him of our observations, and Wesley Shilling
said not to worry about. it and that it could be a malfunction in the oil pressure
gage and he wsured us that it Wllll okay to drive the Buick.
6, Upon returning home, Richard C. DubIe, checked the oil and the dip stick showed
it was full of oil,
7. On May 5, 1997 Carol A, DubIe drove the Buick to Carlisle, PA and noticed the
oil light flickering again.
8, On May 6, 1997 Carol A, DubIe was driving to Hershey, PA and the car lost power
and had to be driven off the highway, When the AAA tow truck drive arrived he noticed
that there was no oil plug in the pan under the Buick, and all the oil had drained
out of the rebuilt engine. The Buick W~9 towed to Wes Shilling's residence in New-
ville, PA, and a note was placed on the windshield stating that the oil plug was
missir~ and that the car had stopped running, and would he please call us,
9, Wesley Shilling called shortly and the first thing he said was "I didn I t touch
that oil plug, I didn't touch that oil plug".
10. Richard C, Dub1e talked with Wesley Shilling that evening, and it was ag~eed
that Wesley Shilling would tear down the eng~ne and let us know the problem. He
was informed that we would be going away on May 15, 1997, and to please let ue
know the problem before we were to leave.
11. On May 15, 1997 we, Biehn.l,l C. [lubl" and Gn.rol A. DubIo, hOO not hoard anything

12. On June 2, 1997 llieho.rd C. DubIo callod Wouloy Shilling, and lea.rned tho.t nothing
ha.d, been done on our Buiok, buL tho.t work oould be llta.rted "tomorrow for o.nothor
$200.00". We. Richo.rd C, DubIe and coxol A. fJublo. talked and decided we did not
want Wesley Shilling to work on our Buick any more. In tho next few days we picked
up the keys to our Buick, and suid we would have it taken o.way.
IJ. On June 8, 1997 we, Richanl C. DubIe and Carol A. DubIe, went to get things
from our Buick, Wesley Shilling came out of his residence, and told us to get our
oar out of there tomorrow.
14. On June 9, 1997 we, Richard C. DubIe and Coxol A. DubIe, ha.d. our Buick towed
to another garage for repairs.
15. On June 27, 1997 we, Richard C. DubIe o.nd Carol A. DubIe, filed a Civil Case,
Docket No.1 CV-0000I08-97 with District Justice Hon. Helen B, Shulenberger in
Newville, PA to recover the $1,207.00 we paid to Wesley Shilling.
16. On July 21, 1997 a Judgment was entered for Richard C. DubIe and Carol A.
DubIe against Wesley Shilling in the amount of $1,207.00. Wesley Shilling's
witness at this hearing, a John Lake of Newville, PA was not present at the time
we, Richard C. DubIe and Carol A. DubIe, picked up our Buick from Wesley Shilling
at his residence on May J, 1997 and had nothing whatsoever to do with our business
dealings with Wesley Shilling.
