8, On August 28, 1995, at approltlmately 10:41 p,m., the Plaintiff, Maraarct A,
Nlelds while driving her Sentra northbound on Route 15 (the Bypass) was Idllna at the
Intersection of Route IS (the Bypass) and North 21st Street, awaltlnathe intersection trafflc lIaht
to turn areen In order that she could make a left hand turn onto 21 st Street,
9, At the aforementioned time and place, and uJXln the occurrence of the turn slanal
chanaina from red to areen, the Plaintiff proceeded to commence her left hand turn when the
Defendant, driving his Chevrolet southbound on Route 15 (the Bypass) travelled into the
intersection, through a red traffic light, and struck the Plaintiff's vehicle, Defendant's
negligence, carelessness and recklessness caused injury to the Plaintiffs as more fully set forth
herein.
10, The aforesaid accident and resulting injury to the Plaintiffs were a direct and
proKimate result of the negligence, carelessness and recklessness of the Defendant consisting of
the followlna:
a, Driving his motor vehicle in a negligent, careless or reckless manner;
b. Negligently, recklessly, and carelessly failing to stop at a red light and
entering into ongoing traffic;
c. Failing to keep alert and maintain a proper lookout for the presence of
other vehicles on the streets and highways;
d. Otherwise operating his vehicle in careless, negligent or reckless manner
with complete disregard for the rights and safety of others; and

e. Otherwise violating the sllltutes and ordinances of the Commonwealth of
Pennsylvania Motor Vehicle Code pertaining to the operation of motor vehicles
and the rules and regulations pertaining thereto.
11. As a result of the negligence. carelessness and recklessness of the Defendant,
Plaintiff suffered physical injury as follows:
a. Extensive bruising of torso from scat belt and airbags;
b. Bruising on len hand and wrist. left knee and left shoulder; lmffici
c, Pain in torso. left hand, left wrist, left knee and left shoulder;
d, Deep contusions of both breasts;
e. BruiSt'.d sternum;
f, Bruised liver;
g. Possible cracked ribs on right side;
h. As a consequence of the injuries and trauma, Plaintifrs blood pressure
became unregulated necessitating adjustment of Zestril and Lasix dosages; and
i. A loss of diabetcs control.
12, Plaintiff has incurred medical expenses in excess of $4.450.00 and has and will
likely continue to experience pain and suffering and further medical expenses as a result of the
negligence. careless and recklessness of the Defendant.
13. Plaintiff. Howard W. Nields, also suffered loss of consortium as a result of the
negligence, carelessness and recklessness of the Defendant.

When a party has the burden of proof on a particular issue, Ihelr contention on that
issue must be established by II fair prepondenlllce of the evidence. The evidence establishes a
contention by a fall' preponderance of the evidence if you lire persuaded that It is more
probably accurate and true than nol.
To put It another way, think, If you will, of an ordinary balancc scale, with a pan on
each side. Onto one side of the scale, place all of the evidence favomble to the Plaintiffs; onto

compamble weight of the evidence, you feel that thc scales tip, cver so slightly or to the

Tills lawsuit adses out of an intersectional motor vehicle co\llsion occurring on August
28, 1995 in Cwnp Hill Borough, Cumberland County, Pennsylvania at the intersection of the
Route 11/15 Bypass and North 21" Street. On that occasion, the Plaintiff, Margaret A,
Nields, operating a 1995 Nissan Sentra was tmvcling in a generally easterly di.1'eCtion o!, Routll
IS Nm1h, and made a lelt hand turn from the left hand turn lane, intending to go north on
North 21" Street. At the same time and place, the Defendant, Miles R. Hockensmith, IV,
operating a 1989 Chevrolet Z24, was traveling in the right hand lane of Slale Route 770 South
and a collision ensued betwccnthc two vehicles in the Intersection. Both drivers claimed that

two d'IYs with the injuries described in det~i1 below.
II. Pacts as to Damages
The imp~ct of the Defend~lIt's vehicle striking the Mrs. Nield's vehicle caused the left
side of her body to strike the left side p~nel of the door of her vehicle. She suffered extensive
bruising of the torso from the se~t belt ~nd the ~irb~g in the vehicle.
As ~ result of the ~ccident, Mrs. Nields suffered bruising on her left h~nd ~nd wrist, left
knee ~nd left shoulder. She ~lso suffered deep colllusions of both bre~sts.
As ~ result of Defend~nt's vehicle striking Mrs. Nield's vehicle, she ~Iso suffered ~
bruised sternum ~nd bruised liver.
As ~ result of Defend~nt's vehicle striking Mrs. Nields' vehicle, she suffered severe
injury to the ribs on her right side, possibly even fr~ctures to her ribs.
As ~ result of Defend~nt's vehicle striking Mrs. Nield's vehicle, ~nd her injuries ~nd
tr~um~, her blood pressure bec~me unregul~ted necessiwing adjustment of Zestril and Lasix
dosages. As a result of the injuries and trauma, Mrs. Nield's suffered a loss of control over her
diabetes regulation.

Nields suffers from ~dhcsive c~psulitis in the left shoulder which he directly relates to the
tr~ul1la of the ~ccident.
After missing two wceks of work ~s ~ rcsult of the ~ccidelll, Mrs. NIclds rcturned to
work ~s an RN in the neon'Il~1 intensive care unit 'It Holy Spirit Hospital. Upon return to
work, she suffercd pain when holding and feeding the inf~nts and would need to rest her arm
on a chair while working. Thcsc problcms continue today. Mrs. Nields ~lso has difficulty
c~rrying things with hcr lcft ~rm ~nd opening ~nd moving doors. While Mrs. Nield's left
shoulder has not worsened since the accident, It h~s ~lso not improvcd. She still has range of
motion problcms with her lcft shoulder. She feels a dull achc in the left shoulder on a daily
basis. When she moves the wrong way Mrs. Nields feels sh~rp p~ins in the left shoulder. The
weather affects the pain in her left shouldcr.
Mrs. Nields has to limit the amount of time she spends crocheting bec~use her left
shoulder will tire. Mrs. Nields takes four (4) advil evcry night to sleep. She takes varying

llIisleads the jury, unduly del~ys the pro~ecdings, wmes tilllc, ~nd is needlessly cumul~tivc.
Evidence which is relevant Ill~Y bc excluded under Rule 403 if its probative value is mcrely
outweighed by one of the concerns noted above. The tri~l court's determination is based
upon a bal~nce of of the degree of probity With the potcntial d~nger. The party objecting to
the evidence maintains the burden of of eSlablishing th~ttrial conccrns outweigh ilny
probative v~lue.
Plaintiff believes Defendant cannot meet this burden since there is no prejudice to
Defendant in showing the jury the extell\ of Mrs. Nield's injuries and second because the
probative value of the evidence of Plaintiff's d~mages fJr outweighs any concerns or danger of
the nature of the photograph. As the m~jority of Plaintiff's bruising injuries have since
heJled from the time of the accident, the photograph, taken ~t a time near the accident is
proper evidence to show the extent of Pl~intiff's bruising, a necessary part of Plaintiff's proof
of damages.
