COMPLAINT
AND NOW, comes the Plaintiff, Great Valley Savings Bank,
Successor in Interest to Central Pennsylvania Savings Association,
by and through its attorneys, Caldwell & Kearns, and does file the
following Complaint against Defendants, Marlin P. Brown and Sandra
L. Brown, stating in support thereof the following:
1. Plaintiff Great Valley Savings Bank is a Pennsylvania
bank and trust company duly incorporated and existing under the
laws of the Commonwealth of Pennsylvania, with its principal place
of business located at :?10 North Fifth Street, Reading, Berks
County, Pennsylvania 19063. plaintiff Fulton Bank is the servicing
agent for Great Valley Savings Bank with regard to real estate
located in Dauphin County, pennsylvania.
2. Defendants, Marlin P. Brown and Sandra L. Brown, are both
adult individuals, whose last known address is: 104 South Walnut
Street, Mechanicsburg, Cumberland County, Pennsylvania 17055.
3. Plaintiff, by merger, did acquire and succeed to the
interest and assets of Central Pennsylvania Savings Association,

formerly a Pennsylvania banking corporation, or about October 1,
1994, As stated, Fulton Bank is the servicin~ agent for Great
Valley Savings Bank with regard to real estate located in Dauphin
County,
4. On or about May 11, 1984, in consideration of a loan of
$47,400.00 made by central l?ennsylvania Savings Association to
Marlin P. Brown and sandra L, Brown, said Defendants did execute
and deliver to Central pennsylvania Savings Association a written
Adjustable Rate Note, a true and correct copy of which is attached
hereto and marked Exhibit "A" and made a part hereof by reference
thereto.
5, Said Note did obligate the said Defendants to pay the sum
of $47,400.00 at an initial annual interest rate of nine and three-
quarter (9.75%) percent commencing on June 1, 1984, and continuing
thereafter until paid in full., except that any remain.ing debt not
paid would be due and payable on May 1, 2009. It is noted the
interest rate was adjustable and could change in accordance with
Section 4 of the Note, Exhibit "A", commencing December 1, 1985 and
on that day of every eighteen (18) months thereafter.
6. In conjunction with said loan, the said Defendants did
furthermore execute a certain Mortgage dated May 11, 1984, which
was recorded on May 16, 1984 in and for the Office of Recorder of
Deeds of Cumberland County, pennsylvania, in Mortgage Book 751,
Page 34, which did secure the tract or parcel of land with

improvements erected thereon, known and numbered as 104 South
Walnut Street, Mechanicsburg, Cumberland County, Pennsylvania,
'7. The said Defandants did fail to tender the monthly
payment due on the aforesaid obligation on April 1, 1997, The
Defendants have furthermore failed to make the regular monthly
payments due for the succeeding months of May through August, 1997.
8. As provided in the said Note, due to said failure, the
Defendants are in default and as provided in said Note, the full
amount of the principal and accrued interest is now due and
payable.
9, As furthermore provided in the Note, Plaintiff t s
Servicing Agent, Fulton Bank, did p'rovide said Defendants with
notice of said default and acceleration by letter dated June 17,
1997, a true and correct copy of which is attached hereto, marked
Exhibit "B", and made a part hereof by reference thereto.
10, Defendants, Marl in P. Brown and Sandra L. Brown, are
therefore presently in default of said obligation to Great Valley
Savings Bank in the principal amount of $35,544.22, accrued
interest through August 15, 1997, of $1,576.91; negative escrow
account $671.68, late charges afl provided in the Note totaling
$20.78, for a total due through August 15, 1997 of $37,813.59, In
addition, after August 15, 1997, interest accrues at a per diem
figure of $9.50 per day.

11, Plaintiff has demanded payment of the aforesaid
obligation by Oefendants but Defendants have failed and/or refused
to pay said sum,
12. Pursuant to the Homeowners Ji:mergency AlBsistance Act, Act
91 of 1983, notice was given to Defendants, Marlin p, Brown and
Sandra L. Brown, the residents of the mortgaged property, of the
availability of asaistance through said Agency by letter dated May
29, 1997. Attached hereto and marked Exhibit "c" is a copy of the
correspondence mailed to said Defendants on May 29, 1997, advising
them of their rights pursuant to said Act.
13. Furthermore, pursuant to Act No.6, Fulton Bank,
Servicing Agent for Plaintiff, Great Valley Savings Bank, did also
give to said Defendants, Notice of Intention to Foreclose Mortgage
as required by law. A true and correct copy of said Notice dated
May 29, 1997, is also attached hereto, marked Exhibit "0" and made
a part hereof by reference thereto.
14, As provided in the loan documents, a reasonable
attorney's fee for collection of $1,500.00 is also demanded.
WHEREFORE, Plaintiff Great Valley Savings Bank, Successor in
Interest to Central Pennsylvania Savings Association, demands
judgment against Defendants Marlin P. Brown and Sandra L. Brown, in
the amount of $39,313.59, plus accrued interest from August 15,
