6. On or about February 6, 1967, Defendants signed a copy of
the mobile home park regulations, thereby agreeing that a violation
of regulations shall be cause for eviction. See Exhibit C,
attached hereto.
7. Paragraph I, under the Pets section of the Regulations
clearly states that only one (1) pet is allowed. See Exhibit C,
attached hereto.
6. On or about March 31, 1995, Defendant was mailed a spring
bulletin, advising all tenants that dogs over 30 Ibs are
prohibited. However, anyone already ownj,ng a dog over 30 Ibs was
permi t ted to keep the dog, however, the tenan t mus t prov ide the
office with a certificate of insurance with a minimum of $100,000
CPL. The notice included a copy of the new Pet Agreement,
requested tenants provide a photograph of any pet and advised that

9. Defendant did not complete the Pet Agreement.
10. On or about July 25, 1995/ Plaintiff mailed to Defendant
a reminder that the pet information previously requested had still
not been sent.
11. Sometime after the July 25, 1995 notice Defendants mailed
Plaintiff a picture of a german sheppard.
12. Defendants failed to provide proof of insurance as
required by the pet rules and regulations.
13. On or about May 15, 1997/ Plaintiff mailed to Defendants
a Notice of First Violation of Rules.
14. ay notioe dated May 15, 1997, Defendants were advised
that the Pet Agreement must be completed along with a pioture of
their pet and proof of liability insuranoe, provided to the office
no later than May 3D, 1997.
15. On or about May 22, 1997 a Notice of Second Violation of
Rules within six months was mailed to Defendant.
16. ay Notice dated May 22, 1997, Defendants were advised
t,hat they had violated sections 1, 2, and 6 in the "Appearance of
Lot and Home" section of Rules and Regulat,ions. Defendants were
asked to do the following to avoid eviction: remove the El Camino
with an expired ins~ection and registration and the cycle with no
plate or inspection that had been parked in the over-flow lot;
remove cinder blocks from yard; remove wash line post; clean out
debris from under deck; paint or remove fence.
17. Defendants received the two notices on May 29, 1997.
18. Defendants are currently in violation the Mobile Home
Park's Rules and Regulations in that they have more than one pet,
namely, they have two(2) dogs.
19. Defendants were advised of the third violation of Rules
and Regulations due to their maintenance of two (2) pets at the
leased premises, by civil action complaint filed on August 11, 1997
and served upon them shortly thereafter.
20. Plaintiff has requested Defendants remove one dog from
the leased property to comply with the Rules and Regulations which
they have refused to do.
21. As of August 19, 1997/ Detendants had not removed the
uninspected and unregistered motor vehicles from the mobile home
park.
22. Defendants have failed and refused to timely cure the
defaults of which they were notified.
23. Defendants continuing refusal to sign a Pet Agreement and
their maintenance of more than one pet is a continuing breach of
the lease agreement.
24. Monthly rent for lot 13 is $235.00 per month, payable on
the first of each month.
25. Defendants failed to pay monthly rent for September, 1997
as of the date of this complaint.
26. Additional rent will accrue between the filing of this
complaint and the resolution of this litigation, for which claim is
hereby n1ade.
WHEREFORE, Plaintiff respectfully requests judgment in their
favor for possession of lot 13 Rolo Court Mobile Home Park,
Mechanicsburg, pennsylvania and for any and all rent due as of the
hearing date, plus costs, attorney fees and any additional relief
this court deems just.
