15, Plaintiff has lIatisfied the above definition as her
vehicle has been subject to repair more than three (3) times for
the same non-conformity, and the non-conformity remains
qncorrected,
16, In addition, the above vehicle has or will be out-of-
service by reason of the non-conformities complained of for a
cumulative total of thirty (30) days or more.
17. Plaintiff has delivered the non-conforming vehicle to
an authorized service and repair facility of the manufa~turer on
numerous occasions. After a reasonable number of attempts, the
manufacturer was unable to repair the non-conformities,
18. The first warranty repair attempt is believed to have
occurred on or before July 12, 1996, when the vehicle's odometer
showed 479 miles, On that date, repair attempts were made to
repair the vehicle's defect that pulled the car to the right when
driving on flat road, Upper strut mounts were ordered, A true
and correct copy of the repair invoice is attached hereto, made a
part hereof and marked Exhibit "8,"
19, The second warranty repair attempt is believed to have
occurred on or before July 18, 1996, when the vehicle's odometer
showed 518 miles. On that date repair attempts were made by
installing front strut mounts. A true and correct copy of the
repair :invoice is attached hereto, m'.lde a part hereof and marked
Exhibi t "C,"
20, The third warranty repair attempt is believed to have
occurred on or before July 30, 1996, when the vehicle I s odometer
shewed 671 miles. On that date, repair attempts were made for
squeaking noise in steering and brakes, and for steering that
pulled to the right side and memory steer, Front and rear wheels
were ali9ned, cradle was adjusted and steering column was removed
and adjusted, spring on sensor was repaired and road tested
several times and alignment was adjusted two times. As a resl.l1t of
repair work, a loaner car was required for five (5) days. A true
and correct copy of the repair invoice is attached hereto, made a
p;;lrt hereof and marked Exhibit "D."
21, The fourth warranty repair attempt is believed to have
occurred on or before September 5, 1996, when the vehicle's
odometer showed 1382 miles, On that date, lube, oil, filter were
changed, belt and hoses were cher.ked, all fluids were topped off,
and tire pressure was set. A true and correct copy of the repair
invoice is attached hereto, made II part hereof and marked Exhibit
liE."
22. The fifth warranty repair attempt is believed to have
occurred on or before October 18, 1996 when the vehicle's odometer
showed 4421 miles, On that date, repair attempts were made to
remedy a clicking noise in engine area. Lube, oil, filter were
changed, belt and hoses were checked, all fluids were topped off
and tire pressures were set. A true and correct copy of the
repair invoice is attached hereto, made a part hereof and marked
Exhibit "F,"

23. The sixth warranty rlilpair attempt is believed to have
occurred on or before October 25, 1996, when the vehicle's
odomlllter showed 4571 miles. On that date, repair attempts were
made 'to remedy a crunching noise in the front end made when riding
over bumps, Insulator and front stabilizer were repl~ced, A true
and correct copy of the repair invoice is attached hereto, ~ade a
part hereof and marked Exhibit "G."
24, The seventh warranty repair attempt is believed to have
occurred on or before March 18, 1997, when the vehicle's odometer
showed 5,616 miles. On that date, lube, oil, filter were changed,
all fluids were topped off and tire pressure was set. Repair
attempts were made to remedy the recurring problem with the car
pulling to the right side. A true and correct copy of the repair
invoice is attached hereto, made a part hereof and marked Exhibit
~\H" .
25. The eighth warranty repair attempt is believed to have
occurred on or before April 25, 1997, when the vehicle's odometer
showed 5,925 miles, On that date, the car was state inspected,
Repair attempts were made to remedy the recurring problem with the
car pulling to the right side. A tr'le and correct, copy of the
repair invoice is attached hereto, made a part hereof and marked
Exhibit "I".
26, The vehicle continues to exhibit defects and non-
conformities which s'lbstantially impair its use, value and/or
safety as provided in 73 Pa, C.S.A 51951 ~~. Additional
repair attempts are included, A true and correct copy of the
invoice is attached hereto, made a part hereof and marked Exhibit
"J".
27, In addition, Plaintiff avers her vehicle has been
subject to additional repair attempts for defects and/or non-
conformities and/or conditions for which the dealer, did not
maintain records.
2B. Plaintiff has been and will continue to be financially
damaged due to Defendant's intentional, reckless, wanton and
negligent failure to comply with the provisions of 73 Pa.. C. S ,A,
51951 .et .IWl,
29, Plaintiff further avers that she has resorted to
General Motors' Arbitration process (BBB Autoline) prior to filing
the within Complaint as required by 73 Pa, C,S,A. U959, A true
and correct copy of the BBB's Arbitration decision is attached
hereto, made a part hereof and marked as Exhibit "K".
30, Pursuant to 73 Pa, C.S.A, 51958, Plaintiff seeks relief
for losses due to the non-conformities and defects in 'the above-
mentioned vehicle in addition to reasonable attorney fees and all
court costs.
WHEREFORE, Plaintiff respectfully demands judgment in her
favor and against Defendant in an amount equal to the purchase
price of the subject vehicle, plus all available collateral
charges and attorney fees.
'41, The purposes for ,which Plaintiff purchased this vehicle
include but are not limited to their personal, family and
household use,
42, At the time of this purchase and at all times
subsequent thereto, Plaintiff has justifiably relied upon
Defendant's express warranties and implied warranties of fitness
for a particular purpos,e and implied warranties of
merchantability,
43. At the time of the purchase and at all times subsequent
thereto, Defendant was aware Plaintiff was relying upon
Defendant's express and implied warranties, obligations, and
representations with regard to the subjec~ vehicle,
44, Plaintiff has incurred damages as a direct and
proximate result of, the breach and failure of Defendant to honor
its express and implied warranties,
45. Such damages include, but are not limited to, the
purchase price of the vehicle plus all collateral charges,
including attorney fees and costs, as well as other expenses, the
full extent of which are not yet known.
WHEREFORE, Plaintiff respectfully demands judgment; in her
favor and against Defendant, in an amount equal to the purchase
price of the subject vehicle, plus all available collateral
charges and attorney fees.

55. In the delivery of the subject vehicle by this defendant, an express new
vehicle limited warranty was offered relative to the subject vehicle and Is specifically
limited by the terms thereof.
