Transportation erroneously sent a notice to Eugene F, Engle, Jr" ,It 645 Hummel Avenue, Lemoyne, Pennsylvilflla regarding his license suspension (attachml as Exhibit "C"); 5, On June 27, 1995 the Defendant was InGlrCerated within the State Correction Institution and was not given proper notice due to the erroneous address; 6. The Defendant was never permllled an opportunity to surrender his license due to the fatal error by the Pennsylvania Department of Transportation, Bureau of Driver licensing; 7. The Defendant has since been paroled to a half..way house when the Petitioner allempted to obtain a drivers license and was advised of a six month suspension; 8. On or about May 7, 1997 the Honorable Charles A. Clement certified an affidavit to allow the Petitioner to begin his six months suspension (attached as Exhibit "0"); 9, The Petitioner was never given the opportunity to begin his suspension In 1995 due to the fatal notice requirement by the Pennsylvania Department of Transportation, Bureau of Drivers Licensing, WHEREFORE, the Defendant respectfully requests this Honorable Court to allow the Defendant to appeal Nunc Pro Tunc and order the suspension to begin on August 1, 1995, .. . _._.._._.__. ..__._.4__._~~.__.
