AND NOW COHES the above-named Plaintiff l:Iy his attorney
Thomas c. Zerbe, Jr., and petitions the court for the entry of an
Order modifying the terms of a prior order of custody, l:Iased upon
the following I
1. The Plaintiff is Edwin H. Hora, an adult individual, who
maintains a residence at 911 Valley Road, Enola, Cumberland county,
Pennsylvania 17025.
2. The Defendant is Bonnie A. Lorwey, an adult individual
who resides at 422-D Duke Street, Enola, Cumberland County,
Pennsylvania.
3. Plaintiff and Defendant have never been married, but are
the parents of Brooke Anne Lorwey-Hora, born July 8, 1991.
4. Defendant has primary physical custody, and has
petitioned, at 97-1750 Civil Term, to reduce Plaintiff's custody.
5. Defendant has continuously sought to interfere with
Plaintiff's cu~todial rights and violated the terms of the Custody
Order, attached to Plaintiff's Petition, and Plaintiff fears
Defendant will move to a location where Plaintiff has no access or
no knoWledge of Brooke Anne's wherealJouts,
6, Halice displayed in case at 97-1760 Civil Term and other
times causes Plaintiff to fear that Defendant may change residence
to creato new lssues of custody or to cause difficulties in
Plaintiff's exercise of hiR custody rights.
7. Defendant has accused Plaintiff of causing minor injuries
to Broolte-Anne Lorwey Hora which could onl y have occur.l'ed while in
Defendant's custody.
6. Plaintiff fears that Defendant's malice toward Plaintiff,
as revealed lJy false statements and other means will adversely
effect her jUdgment in the care of Brooke Anne Lorwey-Hora.
9. Since filing of Petition at 97-1760 by Bonnie A. Lorwey,
Plaintiff's circumstances have changed ln that he is now married
and an affectionate relationship exists between Brooke Anne and her
stepmother.
10. The best intereRts of the child will be served by
awarding primary physical custody to the Plaintiff.
WHEREFORE, Plaintiff prays the Court to enter an Order
granting primary physical custody to Plaintiff, and requests

2. A Hea~ing was p~eviously held in this rnatte~ on August 21, 1997
and September 4, 1997 on the Mothe~'s Petition (Docketed at No. 97-1750) to
~edlJce the fi'athe~'s periods of pa~tial custody with the Child. By O~de~
dated septernbe~ 4, 1997, this Cou~t denied the Mothe~'s Petition and
adopted the te~rns of the Custody Ot'de~ ente~ed by the Yo~k County Court of
Common Pleas on May 9, 1996. Unde~ the May 9, 1996 O~de~ (as clarified by
a second O~de~ ente~ed on Octobe~ ll, 1996) in Yo~k County, the Mothe~ had
primary physical custody of the Child with the Fathe~ havin9 custody du~il'l9
alte~nating weeks in the sUrnrne~ and f~om 'l'hu~sday thmugh 'l'uesday on
alte~nating weeks du~in9 the school tenn.
3. The fi'athe~ filed this Petition (Docketed at No. 97-4763) to modify
the september 4, 1997 O~de~ to p~ovide fo~ the pa~ties to share physical
custody on an alternating weekly basis th~oughout the yea~ as they do
du~ing the sumrne~ unde~ the existing O~de~.
4. A Conciliation Confe~ence was held on the fi'athe~'s Petition on
Novembe~ 4, 1997, with the following individuals in attendance: The
fi'athel:', Edwin H. Mo~a, with his counsel, Thomas Ze~be, Esqui~e, and the
Mother's counsel, Samuel L. Andes, Esqui~e. The Mothe~ did not attend the
Conference.
