On or about Deoember 9, 1~97, Defendant served upon Plaintiff a set of Interrogatories together with ~ oompanion Request for Production of Documents, Copies uf such documents are attaohed hereto, incorporated herein by reforence and marked Exhibits "A" and "B" respectively. 6. By way of letter dated April 22, 19'J8, Defendant reminded Plaintiff of his obligation to respond to discovery. A copy of said letter is attached hereto, incorporated herein by reference and marked as Exhibit "c", 6. To date, Defendant has not received any responses to the outstanding Interrogatories and Request for Production of Documents. 7. Pa.R.C.P. No. 4006(a)(2) requires answers to written interrogatories to be served within thirty (30) days after service thereof. 8. Pa.R.C.P. No. 4009(b)(2) requires a response to a request for production of documents be served within thirty (30) days after service thereof. 9. Pa.R.C.P. No. 4009(10) (2) authorizes the party submitting the request for production of documents to move tor an order under Pa.R,C.P. AllY50n was both In pain from her Injuries and In fear because of the co1l1510n, She was calling for her mother. Two ambulancas arrived at the scene of the accident. One ambulance took Me, Mahan to a h05pltal and the 5econd ambulance took Allyson to a hospital. Without Informing Ms. Mahan a5 to which hospital they were taking her and her daughter, the ambulance5 operated with world-class mindlessness, They took Ms, Mahan to Holy Spirit Hospital and AlY50n to Polyclinic H05pltal. For several hour5 before Holy Spirit Hospital released Ms, Mahan and she was able to be driven to Polyclinic Hospital, Allyson lay frightened and In pain calling for her mother at Polyclinic Hospital. Two 5ulte arose out of the collision: foor v, 015en and the Instant action, Mr, Foor 5ellled his action with the Defendant. Also, Ms. Mahan settled her own claim agaln5t the Defendant. The only remaining Plaintiff In this action Is Ms, Mahan's claim a5 parent and natural guardian of AllY50n Mahan, Dr, Ted Eschbach, a board certified orthopedic surgeon, treated Allyson'5 dislocated hip. Although any Joint once dislocated Is more susceptible to further dislocation than a joint that has never been dislocated, Dr. Eshbach released Allyson from his care with maximum recovery. He subsequently re-examined her and found no problem. In addition to orthopedic care for the dl510cated hip, Mo. Mahan had Dr. Robert J. Beaudry examine AllY50n for Injury to her temporomandibular Joints because of eevere - 2 - facial bruising, With the baseline e5tabllshed approximately four and one-half years ago, sufficient lime has elapsed for a re-examlnallon to determine If any degenerallve condition 15 dlscernable. Ms. Mahan Is In the proce55 of having Allyson re-examined. STA TEMENT OF THE BASIC FACTS AS TO DAMAGES: Allyson had a dislocated hip, severe facial bruising from her head hitting the back of the front seat, pain and suffering, emotIonal distress the accident and two ambulance routine produced, and loss of enjoyment of life for a $hort period of lime after the accident until her face and hip healed, PRINCIPAL ISSUES OF LIABILITY AND DAMAGES: The Defendant will stipulate to Iiablilty, On damages, the issue wili the extent of the Injuries and valuation of those InJuries. SUMMARY OF LEGAL ISSUES OR ANY OTHER MA TTER 1. The Plaintiff requests the Defendant to stipulate to the United States Life Tables as set forth in the Standard Suggested Jury Instructions; 2. The Plaintiff requests that the Defendant stipulate to the authenticity of photo copies of the Plaintiffs medical records but both parties reserve the right to challenge the admissibility of any mailer Included In those records. 3. The Plaintiff may have scheduling problems with her experts. - 3 - 4, The Plaintiff requests lhatthls case be continued until the next term 50 as to permit Allyson to be re-examined with respecllo her TM Joints.
