1. Plaintiff, COLUMBIA NATIONAL INC., ilil a corporation with
a plaoe of bUlilineu at 7142 Columbia Gateway Drive, Columbia,
Maryland 21046-2132.
2. Defendant, THOMAS G. GILBERT, ia an adult individual wholile
lalilt known addreu ia 32 MILLERS GAP ROAD, ENOLA, PENNSYLVANIA
17025. Defendant, HEIDI GILBERT, ia an adult individual whoae lalilt
known addrelillil ia 32 MILLERS GAP ROAD, ENOLA, PENNSYLVANIA 17025.
3. On or about May 31, 1996, the aaid Defendanta executed and
delivered a Mortgage Note in the aum of $123,400.00 payable to
COLUMBIA NATIONAL INC., which Note ilil attached hereto and marked
Exhibit "A".
4. Contemporaneoualy with and at the time of the exacution of
the aforeoaid Mortgage Note, in order to liIecure paymant of the
liIame, Defendants made, executed and delivered to original
Mortgagee, a certain real estate Mortgage which ia recorded in the
Recorder of Deeda Office of the within County and Commonwealth in
Mortgage Book 1323, Page 370 conveying to original Mortgagee the
subject premises.
Said Mortgage is incorporated herein by
reference.
5. The land aubject to the Mortgage ial 32 MILLERS OA~ ROAD,
ENOLA, ~A 1702!! and ia more particularly deaoribed in Exhibit "B"
attached hereto.
6. The aaid Defendanta are the real. ownora of the land
aubject to the Mortgage.
7. The Mortgage ia in default due to the fact that Mortgagora
have failed to pay the inatallment due on April 1, 1997 and all
aubaequent inatallmonta thereon, and the following amounts are due
on the Mortgage I
(a) Unpaid principal balance
(b) Intereat at $29.84 per day
from 3/1/97 to 9/1/97
(baaed on contr.act rate of 8.875')
(c) Accumulated Late Charge a
and Late chargea at $49.09
per month for 5 montha

The attorney'a feea Bet forth &bove are in conformity with the
Mortgage document a and ~ennaylvania law, and will be collected in
the event of a third party purchaser at Sheriff' a Sale. If the
Mortgage ia reinatated prior to the sale, reaaonable attorney'a
fees will be charged that are actually incurred by ~laintiff.
8. No judgment has been entered upon said Mortgage in any
jurisdiction.
9. Notioe of intention to foreolosure and aooelerate the loan
balanoe pursuant to Pennsylvania Aot No. 6 of 1974 is not required
in that the original principal balance exoeeds ~50,000.00.
10. Defendants are not members of the Armed Foroes of the
United states of America, nor engaged in any way whioh would bring
them within the Soldiers and Sailors Relief Act of 1940, aD
amended.
11. Plaintiff has Complied with the procedures required by
Pennsylvania Act 91 of 1983 (Homeowners' Emergency Mortgage
Assistance Payments Program) and defendant has either failed to
meet the time limitations as set forth therein or has been
determined by the HOllsing Finance Agency not to qualify for
assistance.
WHEREFORE, Plaintiff domands judgment in mortgage foreclosure
"IN REM" for the aforementioned total amount due together with
interest at the rate of 8.875\ ($29.84 per diem), together with
other charges and costs including escrow advances incidental
thereto to the date of Sheriff's Sale and for foreclosure and sale
of the property within described.

1. Plaintiff, COLUMBIA NATIONAL INC., is a corporation with
a place of business at 7142 Columbia Gateway Drive, Columbia,
Maryland 21046-2132.
2. Defendant, THOMAS G. GILBERT, is an adult individual whose
last known address is 32 MILLERS GAP ROAD, ENOLA, PENNSYLVANIA
17025. Defendant, HEIDI GILBERT, is an adult individual whose last
known address is 32 MILLERS GAP ROAD, ENOLA, PENNSYLVANIA 17025.
3. On or about May 31, 1996, the said Defendants executed and
delivered a Mortgage Note in the sum of $123,400.00 payable to
COLUMBIA NATIONAL INC., which Note is attached hereto and marked
Exhibit "A".
4. Contemporaneously with and at the time of the execution of
the aforesaid Mortgage Note, in order to secure payment of the
same, Defendanto made, executed and delivered to original
Mortgagee, a certain real estate Mortgage which is recorded in the
Recorder of Deeds Office of the within County and Commonwealth in
Mortgage Book 1323, Page 370 conveying to original Mortgagee the
subject premises.
Said Mortgage is .incorporated herein by
reference.
5. The land eubjeot to the Mortgage iel 32 MILLERS GAP ROAD,
ENOLA, PA 17025 and ie more partioularly deeoribed in Exhibit "B"
attaohed hereto.
6. 'l'he eaid Pefendante ere the real ownere of the land
eubjeot to the Mortgage.
7. The Mortgage ia in default due to the faot that Mortgagors
have failed to pay the inetallment due on April 1, 1997 and all
eubeequent inetallmenta thereon, and the following amounte are due
on the Mortgage I
