A true and correct copy of said Mortgage containing a description of the premises subject to said Mortgage is marked Exhibit "B", attached ht!reto and made a part hereof. 5. On or about March 21, 1994, Defendant executed a Promissory Note ("Note 2") in favor of Plaintiff in the original principal amount of $7,180.06. A true and correct copy of said Note is marked Exhibit "C", attached hereto and made a part hereof. 6. On or about September 8, 1995, Defendant executed an Amended, Restated, and Consolidated Promissory Note ("Amended Note") in favor of Plaintiff in the original principal amount of $53,301.34, consolidating the indebtedness of Note 1 and Note 2. A true and correct copy of said Amended Note is marked Exhibit "0", attached hereto and made a part hereof. 7. On or about September 8, 1995, Defendant made, executed and delivered to Plaintiff a Modification of Mortgage ("Modification to Mortgage"), said Modification to Mortgage being recorded in the Office of the Recorder of Deeds of Cumberland County on September 25, 1995, in Mortgage Book Volume 504, Page 814, modifying the Mortgage to secure the additional indebtedness evidenced by the Amended Note. A true and correct copy of said Modification to Mortgage containing a description of the premises subject to said Mortgage is marked Exhibit "E", attached heleto and made a part hereof. 8. Defendant is the reoord and real owner of the aforesaid mortgaged premises. 9. Defendant is in default under the terms of the aforeRaid Mortgage, as amended by the Modification to Mortgage and Amended Note, foro inter alia, failure to pay the monthly installments of principal and interest when due. Defendant is due for t~e January 1/ 1997 payment. 10. On or about May 7/ 1997/ Defendant was mailed Notice of Homeowner's Emergency Mortgage Assistance Act of 1983, in compliance with the Homeowner's Emergency Mortgage Assistance Act, Act 91 of 1983. A true and correct copy of said Notice is marked Exhibit "F", attached hereto and made a part hereof. 11. On or about May 7/ 1:':97/ Defendant was mailed Notice of Intention to Foreclose Mortgage in compliance with Act 6 of 1974, 41 P.S. S101, et seq. A true and correct copy of said Notice is marked Exhibit "G", attached hereto and made a part hereof. 12.
