On or about September 4, 1997, the defendal,t ini tiftted an ar~ument over a bill belonging to the plaintiff, yelled obsceniti.es at her and either tackled her or threw her to the ground as she attempted to run into their marital residence. During this incident, plaintiff was struck on the right side of her face. b.) Immediately after the incident setforth above, the defendant continued to yell for approximately 5 minutes, threw out into the trash barrel christmas presents plaintiff had purchased for plaintiff's mother, a child support check of plaintiff and her purse and took all keys off her key ring except the keys to her car. a.) On or about September 3, 1997, at approximately 5:45 a.m., defendant was yelling obscenities to the plaintiff about the telephone bill and thraatened to rip the telephone off the wall. d.) On or about May, 1997, defendant threatened to kill plaintiff before he would allow her to have the kids after she informed him that, one day, he would come home to an empty house. e.) Since approximately, January, 1991, the defendant has abused the plaintiff in ways including but not limited to yelling and cursing at her causing the plaintiff to fear for her safety. 5. The defendant possesses and owns numerous firearms. 6. 'l'he plaintiff believe. and therefore avers that she i. in immediate and pre.ent danger of abu.e from the defendant and that she ia in need of protection from .uch abuse. 7. The plaintiff desires that the defendant be prohibited from having any direct or indirect contact with her includi.ng, but not limited to, telephone and written communications, except for the limited purposo of facilitating custody arrangements. 8. The plaintiff desires that the defendant be enjoined from harassing and stalking the plaintiff, and from harassing her relatives, or the minor children from the marriage and the minor children that she has prior to her marriage to the defendant. 9. The plaintiff desires that the defendant be enjoined from removing, damaging, destroying or selling any property owned jointly by the parties or owned by the plaintiff. B. EXCLUSIVE POSSESSlQH 10. The home which the plaintiff is aSking the Court to order the defendant to stay away from is owned jointly by the partie.. The defendant may come to the plaintiff's residence for the limited purpose of transferring custody of the parties' children, but he shall remain in his vehicle at all times during the transfer of custody. C. REIMBURSEMENT FOR COST OF CASE 11. The plaintiff desires that the Court order the detendant to pay the costs of there ~roceedings. WHEREFORE, pursuant to the provisions of the "Protection from Abuse Act" of October 7, 1976, 23 P.S.S6101 n USL.., as amended, the plaintiff prays this Honorable Court to grant the fOllowing relief: A. Grant a Temporary Order pursuant to the "Protection from Abuse Act.": 1. Ordering the defendant to refrain from abusing the plaintiff or from placing her in fear of abuse. 2. Ordering the defendant to refrain from having any direct or indirect contact with the plaintiff including, but not limited to, telephone and written communi9ations, except for the limited purpose of facilitating custody arrangements. 3. Ordering the defendant to refrain from harassing and stalking the plaintiff and from harassing her relatives and the minor children of the marriage and her minor children prior to marr.tage to the detendant. 4. Prohibiting the defendant trom removing, damaging, destroying or selling property jointly owned by the parties or owned by the plaintiff. 5. ordering the defendant to stay away from the plaintiff'S residence located at 10 stone Church Road, carlisle, Cumberland county, pennsylvania, and ordering the defendant to stay away from any residence the plaintiff may, in the future, establish for herself, except for the limited purpose of transferring custody of the parties' children. The defendant shall remain in his vehicle at all times during the transfer of custody. ,6. Awarding plaintiff temporary custody of the parties' minor children, Bradley Charles Calaman, age 6, and Shelbie Jean Calaman, age 4. B. Schedule a hearing in accordance with the provisions of the "protection from Abuse Act," and, after ouch hearing, enter an Order to be in effect for a period of one (1) year: 1. Ordering the defendant to refrain from abusing the plaintiff or from placing her in fear of abuse. 2. Ordering the defendant to refrain from having any direct or indirect contact with the plaintiff including, but not limited to, telephone and written communications, except for the limited purpose of facilitating custody arrangements. 3. Ordering the defendant to refrain from harassing and stalking the plaintiff and from harassing her relatives and the minor children of the marriage and her minor children prior to marriagll to the defendant. 4. Granting possession to the plaintiff of the residence to the exclusion of the defendant. s. Prohibiting the defendant from removing, damaging, destroying or selling property jointly owned by the parties or owned by the plaintiff. 6. Ordering the defendant to stay away from the plaintiff' I!I residence located at 10 stone Church Road, carlisle, Cumberland County, Pennsylvania, and ordering the defendant to stay away from any residence the plaintiff may, in the future, establish for herself, except for the limited purpose of transferring custody of the parties' children. The defendant shall remain in his vehicle at all times during the transfer of custody. The plaintiff further requests that a certified copy of this Petition and Order be delivered to the Pennsylvania state Police, North Middleton Township Police Department and Middlesex Township Police Department which have jurisdiction to enforce this Order.
