MELLOTT, Defendant COURT ORDER AND NOW, this .::.';Lc tL day of /: l f;, I. ".' ,1997, upon consideration of the attached Custody Conciliatiotl Report, it is ordered and directed as follows: 1. The Father, Brian D. Mellott, and the Mother, Darlene 1(. Mellott, shall enjoy shared legal custody of Brandon A. Me.!1ott, born September 16, 1985, and Megan J. .Mellott, born August 5, 1991. 2. The Mother shall enjoy primary physical custody of the minor children. 3. The Father shall enjoy periods of temporary physical custody ot the minor children as tollows: A. On alternating weekends from Friday at 8:00 p.m. until Sunday at 7:00 p.m. B. On a weekday evening as agreed upon by the parties and upon Father giving Mother adequate notice in advance ot the time that Father desires an evening visitation. C. At such other times as agreed upon by the parties. 4. The Thanksgiving holiday shall be handled with the Mother enjoying custody every Thanksgiving through Saturday morning and the Father having custody from Saturday morning through the day the children return to school. It is noted that Father's period of time is specifically intended to afford Father and the mino!' children, if they so desire, to go hunting. 5. The Christmas holiday shall be handled such that Mother has custody on Christmas Eve through Christmas Day at 2:30 p.m. From that point forward, Father shall have custody trom Christmas Day at 2 :30 p.m. until a time period that is one- halt of the remaining time of the children's vacation. For example, if the children do not return to school until January 3, their vacation after Christmas Day would consist ot flight days so that Father would have December 26, 27, 28 and 29. Under this example, Moth6r would have December 30, 31, January 1, and January 2. " , 6. The Easter holiday shall be handled with the Mother having the first half of the day on Easter and the Father having the second half of the day. 7. The Thanksgiving weekend shall not be included in the alternating weekend schedule provided for above. 8. The Mother shall always have custody of the minor children on Mother's Day and the Father shall always have custody of the minor childnm on Father's Day. This provision shall supersede the alternating weekend provision. 9. Both parents shall enjoy reasonable telephone contact wi th the minor children when the children are in the custody of the other parent. 10. Father shall enjoy periods of liberal custody with the minor children during the summer months. In the event the partes are unable to reach an agreement between themselves on a summer schedule, either party may contact the Custody Conciliator for the scheduling of another Custody Conciliation to resolve that issue. If the matter cannot be resolved at a Custody Conciliation, a hearing will be scheduled before the Court. 11. When the Father has custody of the minor child, Brandon, he shall ensure that the child receives all prescription medication that the child normally receives with the Mother. Father shall have the right to request a medical evaluation of the child at any time in order to determine whether the prescription medication should continue. Father would incur the cost of any such evaluation. 12. This Order is entered pursuant to an agreement reached by the parties at a Custody Conciliation Conference. In the event either party becomes dissatisfied with this Order, that party may petition the Court to have the case again reviewed by the Custody Conciliator and, if necessary, by the Court.
