AKD MOW, come. the Plaintiffs, SHARON rOLTS and RICHARD
rOLTI, by and through their attorneys, SMIGEL, ANDERSON' SACKS, and
aver the following:
1. Plaintiffs, Sharon Foltz and Richard Foltz, are hu.band
and wife, currently residing at 114 Hill Lane, Cumberland County,
Mechanicsburg, Pennsylvania.
2. Defendant, Wal-Mart Stores, Inc. is a Delaware
Corporation authorized to do business in Pennsylvania, The address of
the Defendant is 6520 Carlisle Pike, Mechanicsburq, Cumberland County,
Pennsylvania.
3. At all times relevant hereto, Defendant Wal-Mart
storee, Inc. waG in exclusive custody, possession and control of that
area de.cribed as premises, and it was the duty of the Defendant to
keep and maintain those premises in a reasonably safe condition for
those persons lawfully thereon.
4. On September 12, 1995, at approximately 4 p.."
Plaintiff Sharon Foltz waG lawfully present inside the .tore of
Defendant Wal-Mart Store., Inc" located at 6520 Carlisle Pike,
Mechanic.burg, Cumberland county, Pennsylvania, hereinafter referred
to ae preai.e. and wae lawfully and carefully proceeding on foot upon
said premises.
5. Notwithstanding its duty, the Defendant did, at that
aforementioned time and date, and for some time prior thereto,
carelessly, recklessly and negligently allow to remain on the said
premises a dangerous and defective condition in the form of a mat at
or near the "Notions" counter within the store.
.. As Plaintiff Sharon Foltz was proceeding upon the
premises as aforesaid, she was caused to trip by reason of the
afo~esaid dangerous condition, with the result that she suffeced
severo and serious injuries and damages as are hereinafter set forth.
7. The injures and damages which are hereinafter set forth
were caused solely by and were the direct and proximate result of the
negligence of the Defendant in any or all of the following respects:
~. Fail~d to keep the premises in a safe condition
for. persone lawfully using same;
b. Permitted the dangerous condition to be and remain
on the premises when the Defendant knew or, in the exercise of
reasonable care, should have known of the danger involved;
o. Failed to warn Plaintiff Sharon Foltz of the
dangerouB condition created by the above described hazard;

4. Failed to r.move the dang_roue condition ot which
the O.tendant Wal-Mart Stor.., Inc. kn.w or in the .x.rcis. ot
r.asonable car. should have known;
.. Permitted persons, and the Plaintift Sharon Foltz
in particular, to traverse the premises when the Defendant Wal-Mart
Store., Inc. knew or, in the exercise of reasonable care, should have
known that it was dangerous to do so and involved an unreasonable risk
of harm to persons so doing;
f. Failed to inspect the premises to discover the
dangerou. condition or in inspecting so carelessly as not to have
di.covered the condition;
g. In maintaining the premises in an improper manner
or in employing personnel who were not sutficiently qualitied to
maintain the premiae. in a proper manner;
h. Permitt.d the mat to remain on tha pr.mis..;
i. Failed to provided adequate warnings to its lawful
lic.n....; and
j. In being oth.rwis. carel..s, reckless and
n.glig.nt.

Wal-Mart Stor.., Inc., Plaintitt Sharon Foltz .ustained the tollowing
injurie.:

t. As a result of the injuries as aforesaid, Plaintift
Sharon Foltz sustained the following damages:
e. Plaintiff Sharon Foltz has suffered and will
continue to suffer great pain, BUffering, inconvenience,
embarrassment, mental anguish and a loss of the enjoyment of life;
b. Plaintiff Sharon Foltz has expended and will be
required to expend sume of money for medical and surgical attention,
hospitalization, medical supplies, surgical appliances, medicinell and
attendant services;
a. Plaintiff Sharon Foltz'lI general health, strength,
and vitality have been impaired.
10. By further reason of the injuries as aforesaid,
Plaintiff Richard Foltz has been and will in the future be deprived of
consortium, conjugal lIerviees, assistance and compa.\ionship.

accordance with the standard of care owed to Plaintiffs and others similarly situated,

3, PlaintiOs l1Ied their Complaint on or about September II, 1997, A true and
correct copy of plaintiffs' Compluint is attached hereto us Exhibit "A,"
4, Pluintiffs huve not ucted to secure the udvuneement of their case,
5, Indeed, the docket cntries indicate that aner plaintiffs filed their Complaint,
defendant filed an Answer and New Matter, and plaintiffs replied to the New
Matter on October 30, 1997, A true and correct copy of the docket entries is
attached hereto as Exhibit "B,"
6, The docket entries further reveal several withdrawal and entries of appearances
for defense counscl. Plaintiffs have engaged in no docket activity since filing a
reply to the New Matter in October 1997, over four and one-half years ago,
7, Further, with regard to non-docket activity, discovery has becn completc since
1999, Plaintiffn have not requested to depose anyone, and they have niJt
submitted expel1 reports either,
8, It is well-settled law that the plaintiffs have the responsibility to move their case
along and secure its advancement. Despitc this obligation, plaintiffs have failed
to diligently pursue this matter, and plainly, there has been no docket activity for
well over two years.
9, Plaintiffs have no compelling reason for the delay in prosecuting the action, This
is a simple premises liability matter, and there is no reason why plaintiffs could
not gather the evidence nccessary to bring their case to trial.
10. On the other hand, Wal-Mart has suffered aclual prejudice from the delay in
prosecution.

11, Plaintiffs' uction is based on a transient condition which is no longer present, and
the longer they delay in bringing the case to trial, the hurder it will be for Wal-
Mart to defend al!ainstthe existence of the condition,
12, Further, as the Pennsylvania courts realize, witncsses become unavuilable after
significant delays in litigation, and memories fade. For instance, Diane Baker was
the Wal-Mart employee who completed the incident report based on plaintiO's
description of the incident.
13. Ms, Baker no longer works for Wal-Mart,
14, More importantly, Sherry Pope, another former employee, was identified as a
possible eyewitness to the incident. Ms, Pope: has moved out of the area, und
defendant is unablc to contact her,
15, Her absence significantly prejudices Wal-Mart's defense of the matter as she is
the only employee to have any knowledge of the condition of the mat at the time
of the incident. It is quite unlikely thaI any of the present employees will
remember the condition of a mat in the fabrics department in 1995,
16. In short, plaintiffs have failed to diligently pursue this matter, und they have no
compelling reason for the delay.
