TO THE HONORABt,E, THE JUDGES OF SAID COURT: The petition of plaintiff, DOROTHY DePASQUALE, by her attorney, Richard L. Webber, Jr., respectfully represents that: 1. Plaintiff is DOROTHY E. DePASQUALE, who resides at 35 Fish Hatchery Road, Shippensburg, Cumberland County, ~ennsylvania. 2, Defendant is JAMES D. STINE, who resides at 4 Strohm Road, Shippensburg, Cumberland County, Pennsylvania. 3. Plaintiff and Defendant formerly resided tog~ther at 4 Strohm Road, Shippensburg, PA. 4. The parties separated on July 24, 1997. Plaintiff left the residence located at 4 Strohm Road, Shippensburg, PA, 5. Since approximately late May 1997, Defendant has attempted to cause and has intentionally, knowingly, or recklessly caused bodily injury to Plaintiff and has placed Plaintiff in reasonable fear of imminent serious bodily injury, and has knowingly engaged in a course of conduct or repeatedly committed acts toward Plaintiff, under circumstances which have placed the plaintiff in reasonable fear of bodily injury. This has included, but is not limited to, the following specific instances of abuse: A. On September 3, 1997, Defendant attempted to retrieve some of her personal belongings that were located at Defendant.s residence. Defendant approached a vehicle in which Plaintiff was seated while parked in Defendont's driveway. At that time, Defendant struck the window with his fist or hand, kicked the door, opened the door, leaned in the car door, and attempted to assault Plaintiff. Plaintiff attempted to flee in the vehicle. Defendant threw stones at the vehicle, hitting the door and window while she attempted to flee. As a resul t of this incident, the Pennsylvania State Police will be filing criminal charges against Defendant. The next evening, Thursday, September 4, 1997, Defendant telephoned the American Legion in Shippenaburg, PA and threatened Plaintiff's companion, Jeff Zeigler. B. Since July 24, 1997, the date of the parties' separation, Defendant has telephoned Plaintiff at her place of employment an average of 2 to 3 times per work day, C. In late May 1997, Defendant seriously assaulted Plaintiff, causing substantial bruising to her arms and legs. 6, Plaintiff believes and therefore avers that she is in immediate and present danger of abuse from Defendant, and that she is in need of protection from such abuse. 7. Plaintiff desires that Defendant be prohibited from having any direct or indirect contact with Plaintiff including, but not limited to telephone and written communications, and visits to her residence. 8. Plaintiff desires that Defendant be enjoined from harassing and stalking the Plaintiff, and from harassing the Plaintiff's relatives. 9. Plaintiff desires that Defendant be restrained from entering her place of employment. NHIRIPORI, for the reasons set forth above, Plaintiff requests that this Court enter an emergency order under the Protection From Abuse Act: a. Restraining Defendant fr.om abusing, harassing, stalking and/or threatening placing Plaintiff in fear of abuse in any place where Plaintiff may be found. b. Enjoining Defendant from living at, entering, attempting to enter or visiting Plaintiff's residence or any subsequent residence. c. Prohibiting Defendant from having any contact wi th Weigle, Esquire on or about Thursday, September' 18, 1997 concerning the contents of the Petition, However, Mr. Weigle is not representing Defendant in this proceeding. 5. The parties agree that the hearing should be generally continued to afford them time to prepare and execute a Consent Agreement. 6. The Plaintiff requests that the Temporary Protection Order remain in effect until modified or terminated by the Court after notice or hearing. 7, Defendant indicated to the undersigned Plaintiff's counsel that he did not object to the Temporary ?rotection Order remaining in effect until a Consent Agreement was executed and entered as an Order of Court. 8. A Certified copy of the Order for Continuance will be provided to the pennsylvania State Police by the attorney for the Plaintiff. WHEREFORE, the Plaintiff requests that the Court grant this Motion and continue this matter generally, and that the Temporary Protection Order remain in effect until further Order of Court. DePASQUALE, or placing her in fear of abuse. 2. The Defendant, although entering into this Agreement, denies (1) the allegations raised in Plaintiff's Pgtition and (2) that. the Plaintiff is ent.itled to t'elief under the protection fronl Abuse Act. He enters into this Agreement in order to compromise ~isputed claims and to resolve the various issues raised in the Petition and the Temporary Protective Order. 7. The Defendant understands and agrees that the Protection Order entered in this matter shall be in effect for a period of 1 year or until modified or terminated by the Court after notice or hearing and, can be extended beyond that time, if. the Court finds that he has committed an act of abuse or has engaged in a pattern or practice that indicates risk of harm to the Plaintiff. 8.
