5, On August I, 1996, the termination date of the Lease was extended by
the parlies to July 31. 1997. See Exhibit B.
6, On January 20, 1997, the parties agreed to extend the Lease on a day to
day basis with the Defendant agreeing to v,lcate the premises during August of 1997, See
Exhibit C.
7. The leased premises were sold by the Lessor to Plaintiff on July 14,
1997 and the Lease was assigned by the original Lessor to Plaintiff. See Exhibits D and E.
8. Judgment in this action is not being entered by confession against a
nalUral person in connection with a residential lease,
9. Judgment in ejectment has not been entered on this Lease in any
jurisdiction,
10. There has been default by defendants of the terms of the Lease as
follows: Defendant has failed to comply with its obligation under Paragraph 13 of the Lease
to peacefully surrender the premises upon termination of the Lease. The expiration date of the
Lease was August I, 1997, Defendant has been provided with the requisite ten (10) day notice
to quit In accordance with Paragraphs 16 and 18 of the Lease.
11. By virtue of the foregoing default. Plaintiff is entitled to possession of
the following premises: 101 Erford Road, Camp Hill, PA 17011.
