do this work for a minimal fee to Plaintiff the following year.

13. Denied. Defendant's workmanship was not defective. The paint failed to
adhere because of a peculiarity of the roof surface itself. It is admitted that two applications of
the paint were each unsuccessful In successive years, and that on each occasion, the paint did
eventually peel.
14. Admitted in part and denied in part. It is admitted that Plaintiff asked the
Defendant to make the necessary repairs. Plaintiff, however, did not permit Defendant to apply
the aluminum fiber coating which he ultimately recommended. It is further denied that
Defendant's workmanship was defective.
15. Denied. The problem was not the defective workmanship of the Defendant,
but some peculiarity in the roof surface, Far from denying responsibility, Defendant coated the
roof a second time, without charge, and offered to coat it a third time with an aluminum fiber
paint, such as the one ultimately used by another painter on Plaintiff's roof.
