alimony pendente lite, and counsel fees and costs.
The parties were married on June 21, 1980,
and as noted, the hearing today was to determine the date of
separation of the parties. Inasmuch as the parties have
reached an agreement 1 the Master will assume that th~y have
resolved the date of separation issue.
The parties are the natural parents of three
children, all of whom are minors and who reside with wife.
An agreement is going to be placed on the
record in the presence of the parties, The agreement as
placed on the record will be considered the substantive
agreement of the parties not subject to any changes or
modifications except for correction of typographical errors
which may be made during the transcription.
The parties are going to return with counsel
on Monday Oecember 18, 2000, at 1:30 p.m. to review the draft
of the agreement, make any changes with reference to
correction of typographical errors, and then affix their
signatures affirming the terms of settlement as placed on the
record at this time. Upon the agreement being placed on the
record, the parties will be bound by the agreement even though
the Signatures have not been affixed affirming the terms of
settlement.
When the Master has been provided the
complet.ed agreement, he will prepare an order vacating his

appointment and counsel will then be able to file a praecipe
transmitting the record to the Court requesting a final decree
in divorce. Mr. Miller.
MR. MILLE:RI
1. With regard to the marital residence, Plaintiff agrees
to waive all right, title, and interest to the marital
residence, It is the intent of the parties that the marital
residence be sold and the proceeds thereof be given to
Defendant. Plaintiff will cooperate in signing a deed and
any and all other documentation required to effectuate such
sale. In the event sale of the residence is not possible,
Defendant agrees to make a good faith effort to refinance the
mortgages on said property and remove the obligation of
Plaintiff on those mortgages and in that event, Plaintiff also
agrees to sign a deed and any and all other documentation
necessary to tran5fer the property entirely into Defendant's
name.
2. Plaintiff currently has one IRA account which was
rolled over from a Pennsylvania Blue Shield 401(k) account to
a second 4011k) account with First USA Bank and then into the
current IRA. The parties agree to divide the current balance
of that IRA believed to be approximately $43,000.00 and in
furtherance thereof, the parties agree to sign any and all
documentation necessary to effectuate the equal division of
that account. Defendnnt intends to establish an IRA account
in order to transfer her one half of the proceeds and thereby
avoid any negative tax consequences.
3. Plaintiff also has a pension account by virtue of his
employment with Pennsylvania Blue Shield. Plaintiff agrees
to transfer all right, title, and interest to said account to
Defendant and in furtherance thereof agrees to sign any and
all necessary agreements or documentation to effectuate the
transfer. The QDRO necessary to effectuate the transfer of
the pension account will be prepared by wife's counsel.
4, Both partie~ agree to cooperate with the other party in
the event one party desires to obtain a life insurance policy
on the life of the other which will include cooperation to
sign any and all documentation and provide blood testing.
5. With regard to alimony, Plaintiff agrees to pay
Defendant, the amount of $400.00 per month to begin Jam,\ary 1,
-
2001, and to continue until their youngest child, Alexander
Helm, obtains the age of 18 years and graduates from high
school. Said alimony amount shall be non-modifiable and
shall terminate in the event Defendant remarries or cohabits
or the death of either party.
6. For purposes of clarification, the parties further
agree that the amount Plaintiff has paid to Defendant toward
the mortgages on the marital residence shall bA considered
spousal support and, therefore, taxable to Defendant and
deductible to Plaintiff. Wife shall be responsible for
paying the mortgages on the house and any taxes and insurance
and maintenance costs. The parties further agree that
Plaintiff shall not be responsible for additional
contributions toward the mortgages,
7. The parties mutually waive any right, title, and
interest to each other's automobiles. Furthermore, Plaintiff
agrees to sign any and all documentation necessary to transfer
title in the parties' 1992 Plymouth Grand Voyager to
Defendant.
8. The parties agree that the contents of the marital
residence and all other personal property have been mutually
divided to the satisfaction of the parties, Accordingly, the
parties agree to waive all right, title, and interest to the
household contents and personal property in the possession of
each party.
9. The parties shall be responsible for their own costs
and attorney fees and the parties mutually agree to waive any
requests for contributions of costs or attorney fees.
10. The parties agree that the alleged separation agreement
that they had previously entered into is not a viable
agreement and is superceded by the present settlement that has
been placed on the record,
11, Except as herein otherwise provided, each party may
dispose of his or her property in any way and each party
hereby waives and relinquishes any and all rights he or she
may now have or hereafter acquire under the present or future
laws of any jurisdiction to share in the property or the
estate of the other as a result of the marital relationship
including without limitation, statutory allowance, widow's
allowance, right of intestacy, right to take against the will
of the other, and right to act as administrator or executor in
the other's estate. Each will at the request of the other
execute, acknowledge, and deliver any and all instruments
which may be necessary or advisable to carry into effect this
mutual waiver and relinquishment of all such interest, rights,

Present for the Plaintiff, Dennis L. Helm, is
attorney Keith B. DeArmond, and present for the Defendant,
Karen A. Helm, is attorney Mark D. Schwartz.
This action was commenced by the filing of a
di vorce complaint on September 15, 1997, raising grounds for
divorce of irretrievable breakdown of the marriage. The
parties will sign affidavits of consent and waivers of notice
of intention to request entry of divorce decree so that the
divorce can be concluded under Section 330l(c) of the Domestic
Relations Code. The complaint also raised the economic claim
of equitable distribution. On June 21, 1999, wife filed a
claim under new matter raising the economic issues of alimony,
alimony pendente lite, and counsel fees and costs. Mr,
Schwartz has indicated that wife is going to offer testimony
on the factor of marital misconduct as that factor may affect
wife's alimony claim. The substance of the allegation
r.egarding marital misconduct apparently will involve husband's
extra marital relationships.
The parties were married on June 21, 1980,
and according to husband separated on January 1, 1996, Wife
avers that the separation occurred July 17, 1997. We will
schedule a hearing on the issue of the date of separation as
well as the factor of marital misconduct and then schedule a
hearing to complete the testimony on the remaining factors and
the valuation and identification of marital assets.
The parties are the natural parents of three
children, all of whom are minors, Jeremy, Kyle, and Alex,
The children are in the custody of wife,
Husband is 41 years of age and resides at 16
Country Club Place West, Camp Hill, Pennsylvania, where he
lives alone. He has a Bachelor's degree and is currently a
financial planner for an insurance company. His net monthly
income as computed by the Domestic Relations Office, effective
August 1, 2000, is $1,527.28. Husband Ls not paying spousal
support presently but is paying child support monthly in the
amount. of $493.84. Husband has not raised any health issues.
Wifo is 40 years of age and resides at 12
Northern Dancer Drive, Dillsburg, Pennsylvania, where she
lives with the three children. She is a high school graduate
and has ten months training in a technical school. Currently
she is a food preparation shift leader at Messiah College.
Her biweekly net income is $621.22. Wife's medical insurance
coverage is through her employment with Messiah College, Wife
has not raised any health issues.
The support order has been appealed by wife
and a hearing is scheduled in support court some time in
August 2000. One of the issues that Mr. Schwartz is going to
raise is the claim that husband is under employed. The
Master requests that counsel provide him a copy of the judge's
order who hears the case and any determinations that are made
regarding husband's earning capacity. Perhaps a copy of the
transcript would be helpful in the alimony issue as presented
before the Master.
The parties own a home at 12 Northern Dancer
Drive, Dillsburg, Pennsylvania, which is subject to two
mortgages, Husband is sharing the payment of the second
mortgage; wife is paying the first mortgage and half of the
second mortgage. Because of the decrease in support which
wife is receiving, (currently no spousal support), she has
determined that she is unable to retain the residence and
would like to have the property listed for sale. Husband has
no objection to putting the house on the market and wife is
going to prepare and provide for husband's signature a copy of
a listing agreement so that the house can be placed on the
market immediately. The mortgages that are liens against the
house are with CUNA and Harris Savings Bank,
Husband is an obligor on a mortgage with PHH
Mortgage Services which is a lien against the house which he
purchased post separation. He is requested to provide a copy
of the settlement sheet for that property to wife's attorney.
Wife has some concern that the down payment and settlement
costs for that property were paid out of marital funds.
The parties have a 1992 Plymouth Grand
Voyager and a 1991 Olds Cutlass Supreme. Counsel are going to
determine if they want to have the vehicles appraised to
include values in the equitable distribution computation.
Husband had participated with his prior
employment wlth First USA Bank in a pension plan and a 401(k)
plan. The 40l(k) plan, according to Mr. DeArmond, has
approximately $48,000.00 in the account. The pension plan has
a value of around $18,500.00. Mr. DeArmond is going to
provide documentation to Mr. Schwartz regarding the pension
and 40l(k) plans and then Mr. Schwartz can determine whether
or not he wants to have the pension valued. Mr. Schwartz
also raised a question about whether or nct Mr. Helm has any
pension benefits with his prior employer Blue Shield. Mr.
Schwartz has propounded interrogatories to Mr. Helm and
perhaps the answers will provide the information Mr. Sch~artz
needs to resolve that issue.
When the parties separated it appears that
husband left the household tangible personal property in
wife's possession. Mr. DeArmond is going to check with his
client to see if he removed any property; counsel are going to
try to establish a value for the tangible personal property
and if they cannot, then the property will have to be
appraised.
There is a question about cash that was
available at separation in checking accounts and also in the
form of cash in an envelope or envelopes around the house.
Counsel are going to see if they can determine what cash was
available at time of separation and who received the benefit
of those monies.
The only marital debt is the mortgage with
CUNA and Harris Savings Bank. Counsel have indicated that
there is no credit card or other obligations that are owed by
the parties.
There is some question about the validity of
a separation agreement which husband claims was signed and is
binding on the parties dated June 5, 1997. In order to
determine how that agreement may affect the issues pending
before the Master, counsel are going to file a petition with
the Court requesting the Court's assistance in determining the
viability of that agreement.
A hearing is scheduled to take testimony on
the issue of the date of separation of the parties and the
factor of marital misconduct as that factor may affect wife's
alimony claim on November 30, 2000, at 9:00 a.m, Notices will
be sent to counsel and the parties.
A hearing is scheduled to take testimony on
the remaining factors that apply to alimony and equitable
distribution and the identification and valuation of assets on

approximately 20 years. However, only a portion of the Respondent's stated attempts to tlnd
new employment were even in Ihe computer field, and of these, Respondent admitted that he did
nol follow up after making only inilial contact or sending a resume. Respondent's stDted
justifications tor switching career fields was his inability to locate employment working with
compllter mainframes and his "virtually no" experience ill the personal computer realm.
Testimony revealed that Respondent has had a separate compuler consulting business since at
leBStl993, however, that involved both installation Dnd service of personal computers.
Respondent further teslitied that his monthly expenses have remained approximately the
same since switching career fields, and actllally excl~ed his current monthly income. Similar to
Ihe factor relied llpon by the Sllperior Court in Welser, this testimony supports the view that
Respondenl has fOllnd a way to continlle his standard of living despite Ihe signiticantly reduced
income and Ihe resulting pressure that it has placed llpon the Petitioner WId their children.
Pelitioner recognizes that assigning an earning capacity to Respondenl approximaling his
prior annual salary of $78,000.00 would clearly be burdensome. Nevertheless, Respondent's
volllnlary choice to change careers WId accept a greally reduced annual salary of $24,000.00 yet
mainlain the same slandard of living, is similarly burdensome to Petitioner and Iheir children.

The parties 'were married on June 21, 1980,
and as noted, the hearing today was to determine the date of
separation of the parties, Inasmuch as the parties have
reached an agreement, the Master will assume that they have
resolved the. date of separation issue,
The parties are the natural parents of three
child~en, all of whom are minors and who reside with wife.
An agreement is going to be placed on the
record in the presence of the parties, The agreement as
placed on the record will be considered the substantive
agreement of the parties not SUbject to any changes or
modifications except for correction of typographical errors
which may be made during the transcription.
The parties are going to return with counsel
on Monday DecembeJ; 18, 2000, at 1:30 p.m. to review the draft
of the agreement, make any changes with reference to
correction of typographical errors, and then affix their
signatures affirming the terms of settlement as placed on the
record at this time. Upon the agreement being placed on the
record, the parties will be bound by the agreement even though
the signatures have not been affixed affirming the terms of
settlement.
When the Master has been provided the
completed agreement, he will prepare an order vacating his
appointm~nt and counsel will then be able to file a praecipe
transmitting the record to the Court requesting a final decree
in divorce. Mr. Miller.
MR. MILLER:
1, With regard to the marital residence; Plaintiff ag,rees
to waive all right, title, and interest to the marital
.residence. It is the intent of the parties that the marital
residence be sold and the proceeds thereof be given to
Defendant. Plaintiff will cooperate in signing' a deed and
any and all other documentation required to effectuate such
sale. In the event sale of the residence is not possible,
Defendant agrees to make a good faith effort to refinance the
mortgages on said property and remove the obligation of
Plaintiff on those mortgages and in that event, Plaintiff also
agrees to sign a deed and any and all other documentation
necessary to transfer the property entirely into Defendant's
name.
2, Plaintiff currently has one IRA account which was
rolled over from a Pennsylvania Blue Shield 401(k) account to
a second 401 (k) account with First USA Bank and then into the
current IRA. The parties agree to divide the current balance
of that IRA believed to be approximately $43,000.00 and in
furtherance thereof, the parties agree to sign any and all
documentation necessary to effectuate the equal division of
that account. Defendant intends to establish an IRA account
in order to transfer her one half of the proceeds and thereby
avoid any negative tax consequences.
3. Plaintiff also has a pension account by virtue of his
employment with Pennsylvania Blue Shield. Plaintiff agrees
to transfer all right, title, and interest to said account to
Defendant and in furtherance thereof agrees to sign any and
all necessary agreements or documentation to effectuate the
transfer. The QDRO necessary to effectuate the transfer of
the pension account will be prepared by wife's counsel.
4. Both parties agree to cooperate with the other party in
the event one party desires to obtain a life insurance policy
on the life of the other which will include cooperation to
sign any and all documentation and provide blood testing.
5. With regard to alimony, Plaintiff agrees to pay
Defendant the amount of $400.00 per month to begin January 1,
2001, and to continue until their youngest child, Alexander
Helm, obtains the age of 18 years and graduates from high
school. Said alimony amount shall be non-~cdifiable and
shall terminate in the event Defendant remarries or cohabitf>
or the death of either party.
6, For purposes of clarification, the parties further
.gree that the amount Plaintiff has paid to Defendant toward
the mortgages on the marital residence shall be considered
spousal support and, therefore, taxable to Defendant and
deductible to Plaintiff. Wife shall be responsible for
paying the mortgages on the house and any taxes and insurance
a~d maintenance costs. The parties further agree that
Plaintiff shall not be responsible for additional
contributions toward the mortgages.
7. The parties mutually waive any right, title, and
interest to each other's automobiles. Furthermore, Plaintiff
agrees to sign any and all documentation necessary to transfer
title in the parties' 1992 Plymouth Grand Voyager to
Defendant.
8. The parties agree that the contents of the marital
residence and all other personal property have been mutually
divided to the satisfaction of the parties. Accordingly, the
parties agree to waive all right, title, and interest to the
household contents and personal property in the possession of
each party.
9. The parties shall be responsible for their own costs
and attorney fees and the parties mutually agree to waive any
requests for ccntributions of costs or attorney fees.
10. The parties agree that the alleged separation agreement
that they had previously entered into is not a viable
agreement and is superceded by the present settlement that has
been placed on the record.
11. Except as herein otherwise provided, each party may
dispose of his or her property in any way and each party
hereby waives and relinquishes any and all rights he or she
may now have or hereafter acquire under the present or future
laws of any jurisdiction to share in the property or the
estate of the other as a result of the marital relationship
including without limitation, statutory allowance, widow's
allowance, right of intestacy, right to take against the will
of the other, and right to act as administrator or executor in
the other's estate. Each will at the request of the other
execute. acknowledge, and deliver any and all instruments
which may be necessary or advisable to carry into effect this
mutual waiver and relinquishment of all such interest, rights,
