(,.) ~ (.0 the written notices forwardad to Defendant for non-payment of the rent are attached her&to and marked collectively as Plaintiff's Exhibit 'C', 8) In addition to the written late notices, the partners of the Plaintiff on repeated occasions had to stop personally to remind D~fendant of her overdue rental obligations and collect the same, 9) Late payment of the monthly rents is a breach of the prior lease and constitutes a default and Plaintiff's right to termination, 10) During the time of the appeal in the above captioned action, the Defendant has been required to pay the monthly rentals every thirty days from the date of the appeal. MELL, husband and wife, of 491 Petersburg Road, Carlisle, Cumberland County, Pennsylvania, as Landlord, and THOMAS H, SHELAR and JUDITH M, SHELAR, husband and wife, of 1521 Terrace Ave" Carlisle, Cumberland County, Pennsylvania, as Tenant, Landlord hereby leases to tenant a certain first floor commercial unit located at 49 w. High Street, Carlisle, Cumberland County, Pennsylvania, upon the following terms and conditions, to wit: 1. RENTAL TERM: years beginning the seventh 6th day of October, 1996. 2. MONTHL~ RENTAL: Rental shall be paid in advance of the monthly anniversary date in equal monthly installments of Six Hundred and "9/1"" ($6""."") Dollats. All such rental payments shall be due without demand therefor, Rental payments may be increased to reflect the change in the cost of living index (all products) as published by the U,S. Oept. of Commerce using the most current index avai lable as of September 1, 1986 and September 1 of each year during tho term hereof. Landlord shall be responsible for repairs to the structural elements of tho leased premises to the extent such damage is not the result of actions taken by tenant or tenant's subtenants or others on the premises with tenant's permission. 8. ALTERATIONS: Tenant shall make no alterations to the leased premises without having first obtained landlord's written consent thereto, and all additions, fixtures or improvements which may be made by tenant except movable fixture. not attached to the building shall become the property of landlord and remain upon the premises as a part thereof, and be suttendered with the premises at the termination of this lease, Provided, Tenant shall install at tenant's expense a separate furnace to serve the leased premises only which shall be maintained by Tenant. 9. LANDLORD'S WARRANTY: Landlord has ren ted the premises in their present "as is" condition and without any representations other than those stated in this lease. Landlord is under no duty to make repairs, alterations or decorations unless that duty Is set forth In this agreement. 10. DAMAGE TO TENANT'S PROPERTY: All personal property placed or moved in the premises above described shall be at the rilk of the tenant. or owner thereof, and landlord shall not be liable for any damage to said personal property, or to the tenant . DAMAGE OR DESTRUCTION OF PREMISES: In the event the premises shall be destroyed or so damaged or injured by fire or other casualty during the life of this agreement, whereby the same shall be rendered untenantable, then the landlord shall have the right to render said premises tenantable by repairs within ninety days therefrom. If said premises are not rendered tenantable within said time, it shall be optional with either party hereto to cancel this lease, and in the event of such cancellation the rent shall be paid only to the date of such fire or casualty. The cancellation herein mentioned shall be evidenced in writing. Rental during such term as the premises are totally or partially untenantable shall be abated in full or in part according to the degree of damage. 12. DEFAULT BY TENANT: If the tenant shall abandon or vacate said premises before the end of the term of this lease, or shall suffer the rent to be in arrears, the landlord may, at his option, forthwith cancel this lease or he may enter said premises as the agent of the tenant, by force or otherwise, without being liable in any way therefor, and relet the premises with or without any personalty that may be therein, as the agent of the tenant at such price and upon such terms and for such duration of time as the landlord may determine, and receive the rent therefor, applying the same to the payment of the rent due by these presents, and if the full rental herein provided shall not be realized by landlord over and above the expenses to landlord in such re-letting the said tenant shall pay any deficiency. Tenant agrees to pay the cost of collection and ten percent attorney's fee on any part of said rental that may be collected by suit or by attorney, after the same is past due. 13. BANKRUPTCY: If the tenant shall become insolvent or if bankruptcy peoceedings shall be begun by or against the tenant before the end of said term the landlord is hereby irrevocably authorized at its option, to forthwith cancel this lease, as for a default. Landlord may elect to accept rent from such receiver, trustee, or other judicial officer during the term of their occupancy in their fiduciary capacity without effecting landlord's rights as contained in this contract, but no receiver, trustee or other judicial officer shall ever have any right, title or interest in or to the above described property by virtue of this contract. . 14. INSPECTION: Lanfllord reserves the right to enter upon' the premises at reasonable time's and in a reasonable mariner to inspect the demised premises and to determine if repairs are needed, upon giving reasonable advanced notice of such intended entry.
