The Lease provides that Defendants shall pay the utility charges for electric and heat. To date, October 7, 1997, the sum of two hundred eighty-two dollars and two cents ($282.02) for utility charges for the months of April. FOREIGN LOAD ON ELECTRIC METER 19. From prior to March 13, 1997, when Defendants assumed occupancy of the apartment located at 30 West Glebe Avenue, Newville, Cumberland County, Pennsylvania, until approximately mid-July, 1997, there was a "foreign load" on the electric meter serving said apartment, Le., the wiring for the hall receptacles, hall lights and pole light serving common areas of the apartment building were connected to this meter. 20. Pursuant to 66 P.B. Section 1529.1 (b) and (c), Plaintiff is responsible for payment of the electric bill for Defendant's apartment for the period of time there was a foreign load on the meter serving it. II. LEASE IS AN ADHESION CONTRACT 21. The parties' Lease, particularly in light of its provisions requiring Defendants to pay Plalntiff's attorneys' fees and excessive late charges, is unconscionable and constitutes an adhesion contract with respect to the terms of which Defendants had grossly unequal or no bargaining power. WHEREFORE, Defendants request that the relief requested by Plaintiff be denied, and that they be granted such other and furttler relief as this Court may deem reasonable and just. COUIlTIIRCLAIM I. COLLECTION OF EXCESSIVE LATE CHA~~ 22. Defendants repeat and incorporate by reference their averments set forth in paragraph~ 1 through 21 herein. 23. Paragraph 3 of the parties' Lease provides that Defendants' rent must be paid in advance on the la~t business day of the preceding month. See Plaintiff's Exhibit "B". 24. Paragraph 5 of the parties' Lease provides that if the rent is paid from the first day of the month through the fourth day of the month, a late charge of $21.25 will be imposed, and that if the rent is paid on or after the fifth day of each month, a late charge of $42.50 will be imposed. See Plaintiff's Exhibit "Bit. 25. The late fee provisions of this Lease are unenforceable aD a penalty and unconscionable, in that the amounts they assess are excessive and bear no rational relationship to actual or reasonably anticipated losses incurred by Plaintiff due to the late payment of rent. 26. Plaintiff, pursuant to these lease provisions, collected $42.50 in late charges for each of the months of June, July and August 1997, a total of $127.50. WHEREFORE, Defendants request that this Court enter judgment against Plaintiff in the amount of $127.50, as compensation for excessive late fees collected from Defendants. II. VIOLATIONS OF UNFAIR TRADE PRACT~ AND CONSUMER PROTECTION LAW 27. The averments set forth above in Paragraphs 1 through 26 are incorporated herein by reference. 28.
