JOHN E, MUMMA ,
IN THE COURT OF COMMON PLEAS OF
Plaintiff
V.
CUMBERLAND COUNTY, PENNSYLVANIA
NO, 97-5013 CIVIL TERM
MATTHEW DARR AND
ANGELINA QUERRY,
Defendants
ANSWER
COME NOW the defendants, Matthew Darr and Angelina Querry,
by counsel, Philip C. Briganti, Esquire, Legal Services, Inc"
and as their Answer to Plaintiff's Complaint, state as foll~ws:
1. Admitted,
2. Admitted.
3. Admitted.
4. Admitted.
5. Admitted.
6, The averments
set forth in Paragraph 6 of Plaintiff's
Complaint constitute a conclusion of law to which no response is
requirQd. In the event it is judicially determined that a
response is required, Defendants admit that the Lease Obligates
them to pay rent of $425.00 in advance of each month, but deny
the remaining averments in paragraph 6.
7, Admitted.
8. The averments set forth in Paragraph 8 of Plaintiff's
complaint constitute conclusions of fact and/or law to which no
response is required.
9. Admitted.
10, Admitted in part and denied in part. Defendants admit
all averments in paragraph 10, except they deny that there was
unpaid rent due before the hearing. Rather, Defendants aver that
they paid only late charaes which Plaintiff claimed were due
before the hearing.
11. Admitted.
12. Deniod. Because default by the Defendants is a
condition precedent to the bringing of this action under the
parties' Lease, and Defendants are not in default and/or any
alleged defaults have been cured and/or waived, all conditions
precedent have not occurred.
13. Defendants repeat and incorporate by referenced their
averments set forth above in Paragraphs 1 through 12.
14. Denied. Defendants deny that the sum of $425.00 plus
costs is due and unpaid. Pursuant to Pa. R.C.P.D.J. No. 1008(B)
and Rule 357 of the Cumberland County Rules of Procedure,
Defendants have deposited their October 1997 rent ($425.00) into
escrow with the Prothonotary. Moreover, Defendants deny that
Plaintiff is entitled to costs.
15. Admitted.
16. Defendants repeat and incorporate by reference their
averments set forth above in Paragraphs 1 through 12.
17. Admitted in part and denied in part. Defendants admit
that the Lease provides that Defendants shall pay the utility
charges for electric and heat. Defendants deny that the sum of
$282.02 for utility charges for the months of April, May and June
of 1997, plus costs and attorneys' fees are still due and unpaid.
As set forth below in Defendants' New Matter, because of a
"foreign load" on the electric meter for Defendants' apartment,
Plaintiff is responsible for these charges.
18. Admitted.
~KATTIlR
I. FOREIGN LOAD ON ELECTRIC METER
19. From prior to March 13, 1997, when Defendants assumed
occupancy of the apartment located at 30 West Glebe Avenue,
Newville, Cumberland County, Pennsylvania, until approximately
mid-July, 1997, there was a "foreign load" on the electric meter
serving said apartment, Le., the wiring for the hall
receptacles, hall lights and pole light serving common areas of
the apartment building were connected to this meter.
20. Pursuant to 66 P.B. Section 1529.1 (b) and (c),
Plaintiff is responsible for payment of the electric bill for
Defendant's apartment for the period of time there was a foreign
load on the meter serving it.
II. LEASE IS AN ADHESION CONTRACT
21. The parties' Lease, particularly in light of its
provisions requiring Defendants to pay Plalntiff's attorneys'
fees and excessive late charges, is unconscionable and
constitutes an adhesion contract with respect to the terms of
which Defendants had grossly unequal or no bargaining power.
WHEREFORE, Defendants request that the relief requested by
Plaintiff be denied, and that they be granted such other and
furttler relief as this Court may deem reasonable and just.
COUIlTIIRCLAIM
I. COLLECTION OF EXCESSIVE LATE CHA~~
22. Defendants repeat and incorporate by reference their
averments set forth in paragraph~ 1 through 21 herein.
23. Paragraph 3 of the parties' Lease provides that
Defendants' rent must be paid in advance on the la~t business day
of the preceding month. See Plaintiff's Exhibit "B".
24. Paragraph 5 of the parties' Lease provides that if the
rent is paid from the first day of the month through the fourth
day of the month, a late charge of $21.25 will be imposed, and
that if the rent is paid on or after the fifth day of each month,
a late charge of $42.50 will be imposed. See Plaintiff's Exhibit
"Bit.
25. The late fee provisions of this Lease are unenforceable
aD a penalty and unconscionable, in that the amounts they assess
are excessive and bear no rational relationship to actual or
reasonably anticipated losses incurred by Plaintiff due to the
late payment of rent.
26. Plaintiff, pursuant to these lease provisions,
collected $42.50 in late charges for each of the months of June,
July and August 1997, a total of $127.50.
WHEREFORE, Defendants request that this Court enter judgment
against Plaintiff in the amount of $127.50, as compensation for
excessive late fees collected from Defendants.
II. VIOLATIONS OF UNFAIR TRADE PRACT~
AND CONSUMER PROTECTION LAW
27. The averments set forth above in Paragraphs 1 through
26 are incorporated herein by reference.
28. The transactions between the parties involved "trade"
and "commerce," as those terms are defined in the Unfair Trade
Practices and Consumor Protection Law, 73 P.S. Section 201-1 tt
USL.
