CIVIL ACTION - LAW IN MORTGAGE FORECLOSURE vs. EDWIN H. FLECK AND JUDYTH E. FLECK Defendants COM P L A I N T 1. Plaintiff, MELLON BANK, N.A. AS SUCCESSOR TRUSTEE FOR THE PENNSYLVANIA HOUSING FINANCE AGENCY, pursuant to a Trust Indenture dated as of April 1, 1982 ("Trust"), through its servicing agent PHFA, with its principal place of business at 2101 North Front Street, P.O. Box 8028, Harrisburg, Pennsylvania 17105. 2. Def.endant. EDWIN H. FLECK, is an adult individual whose last known address is 515 & 517 THIRD STREET, WEST FAIRVIEW, PENNSYLVANIA 17025. Defendant, JUDYTH E. FLECK, is an adult individual whose last known address is 515 & 517 THIRD STREET, WEST FAIRVIEW, PENNSYLVANIA 17025. 3. On or about August 31, 1994, the said Defendants executed a Promissory Note ("Note") in favor of Fulton Bank ("Original Mortgagee") in the principal amount of $38,000, the proceeds of which were used to purchase a residential property located at 515 & 517 Third Street, West Fairview, Pennsylvania 17025, which Note 1s attached hereto and marked Exhibit "A". 4. Contemporaneously with the execution of the aforesaid Note, in order to secure payment of the same, Defendants, Edwin H. Fleck and Judyth E. Fleck made, executed, and delivered to Original Mortgagee, a certain real estate Mortgage which is recorded in the Recorder of Deeds Office of Cumberland County in Mortgage Book 1231, Page 215, on September 1, 1994, conveying to original Mortgagee the subject premises. The Mortgage was assigned to Corestates Bank, N.A" as Trustee, for Pennsylvania Housing Finance Agency, pursuant to the terms of said trust, and recorded as aforesaid in Book Volume 481, Page 238. On January 17, 1995, a correction to the assignment was recorded in Book Volume 489, Page 624. The Mortgage was further assigned to Mellon Bank, N.A. and recorded as aforesaid in Book Volume 1277, Page 109 on November 26, 1996. Said Mortgage and Assignments are incorporated herein by reference. 5. The land subject to the Mortgage is: 515 & 517 THIRD STREET, WEST FAIRVIEW, PA 17025 and is more particularly described in Exhibit "B" attached hereto. The Defendants are the sole owners of the said land 6. The Mortgage debt is in default due to the fact that Defendants have failed to pay the installment due on April 1, 1997 and all subseqlJent installments tl,ereon, and the following amounts are due on the Mortgage: (a) Unpaid principal balance (b) Interest at $8.20 per day from 3/1/97 to 10/1/97 (based on contract rate of 8.200\) $37,148.18 1,754.80 (c) Late charges at $13.88 per month for 7 months 97.16 118.38 (d) Escrow Deficit (e) 5\ Attorney's Commission 1,857.41 $ 40,975.93 *Together with intere$t at the per diem rate noted in (b) above after October 1, 1997 and other charges and costs to date of Sheriff's Sale. The attorney's fees set forth above are in conformity with the Mortgage documents and Pennsylvania law, and will be collected in the event of a third party purchaser at Sheriff's Sale. If the Mortgage is reinstated prior to the sale, reasonable attorney's fees will be char~ed that are actually incurred by Plaintiff. 7. No judgment has been entered upon said Mortgage in any jurisdiction. 8. Notice of Intention to Foreclose has been sent to Defendants by Certified Mail, as required by Act 6 of 1974 of the Commonwealth of Pennsylvania, on the dates set forth in the true and correct copy of such notices attached hereto as Exhibit "CO. 9. Defendants are not members of the Armed Forces of the United States of America, nor engaged in any way which would bring them within the Soldiers and sailors Relief Act of 1940, as amended. 10. Plaintiff had Complied with the procedures required by Pennsylvania Act 91 of 1983 (Homeowners' Emergency Mortgage Assistance Paymentd Program) and Defendants have either failed to meet the time limitations as set forth therein or have been determined by the Housing Finance Agency not to qualify for assistance.
