1. Plaintiff, MELLON BANK, N.A. AS SUCCESSOR TRUSTEE FOR
THE PENNSYLVANIA HOUSING FINANCE AGENCY, pursuant to a Tr'Jst
Indenture dated as of April 1, 1982 ("Trust"), through its
servicing agent PHPA, with its principal place of business at
2101 North Front Street, P.O. Box 8028, Harrisburg, Pennsylvania
17105.
2. Defendant, AVA L. PURDUE, is an adult individual whose
last known address is 225 BRIAN DRIVE, ENOLA, PENNSYLVANIA 17025.
3. On or about November 23, 1994, the said Defendant
executed a Promissory Note ("Note") i.n favor of Hart Mortgage
Corp. ("Original Mortgagee") in the principal amount of
$66,150.00, the proceeds of which were used to purchase a
residential property located at 225 Brian Drive, Enola,
Pennsylvania 17025, which Note is attached hereto and marked
Exhibit "A".
4. Contemporaneously with the execution of the aforesaj,d
Note, in order to secure payment of the same, Defendant, Ava L.
Purdue, made, executed, and delivered to Original Mortgagee, a
certain real estate Mortgage which is recorded in the Recorder of
Deeds Office of Cumberland County in Mortgage Book 1243, Page
382, on November 29, 1994, con~eying to original Mortgagee the
subject premises. The Mortgage was assigned to Corestates Bank,
N.A., as Trustee, for Pennsylvania Housing Financa Agency,
pursuant to the terms of said trust, and recorded as aforesaid in
Book Volume 486, Page 854, on November 29, 1994. The Mortgage
was further assigned to Mellon Bank, N.A. as Trustee, for
Pennsylvania Housing Finance Agency, pursuant to the terms of
said trust, and will be sent for recording. Said Mortgage and
Assignments are incorporated herein by reference.
5. The land subject to the Mortgage is: 225 Brian Drive,
Enola, Pennsylvania 17025 and is more particularly described in
Exhibit "B" attached hereto. The Defendant is the sole owner of
the said land.
6. The Mortgage debt is in default due to the fact that
Defendant has failed to pay the installment due on ""April I,
1997 and all subsequent installments thereon, and the following
amounts are due on the Mortgage:
(a) Unpaid principal balance
(b) Interest at $14.12 per day
from 12/1/96 to 10/1/97
(based on contract rate of 7.950~)

*Together with interest at the per diem rate noted in (b) above
after October 1, 1997 and other charges and costs to date of
Sheriff's Sale.
The attorney's fees set forth above are in conformity with
the Mortgage documents and Pennsylvania law, and will be
collected in the event of a third party purchaser at Sheriff's
Sale. If the Mortgage is reinstated prior to the sale,
reasonable attorney's fees will be charged that are actually
incurred by Plaintiff.
7. No judgment has been entered upon said Mortgage in any
jurisdiction.
9. Notice of intention to foreclose and accelerate the loan
balance pursuant to Pennsylvania Act No. 6 of 1974 is not
required in that the original principal balance exceeds
$50,000.00
10. Defendant is not a member of the Armed Forces of the
United States of America, nor engaged in any way which would
bring her within the Soldiers and Sailors Relief Act of 1940, as
amended.
11. Plaintiff has Complied with the procedures required by
Pennsylvania Act 91 of 1983 (Homeowners' Emergency Mortgage
Assistance Payments Program) and Defendant has either failed to
meet the time limitations as set forth therein or has been
determined by the Housing Finance Agency not to qualify for
asoistance.

1. Plaintiff, MELLON BANK, N.A. AS SUCCESSOR TRUSTEE FOR
THE PENNSYLVANIA HOUSING FINANCE AGENCY, pursuant to a Trust

PLAINTIFF'S MOTION TO SET ABIDE SHERIFF'S SALI
AND NOW comes Mellon Bank, N.A., as Successor Truf'tee for
Pennsylvania Houeing Finance Agency and moves to set aside the
Sheriff's Sale held June 3, 1998, as follows I
1. Pennsylvania Housing Finance Agency holds the first
mortgage against Defendant's property located at 225 Brian Drive,
Enola, Pennsylvania 17025.
2. On June 3, 1998, Sheriff's Sale was held at
Plaintiff's request wherein Mellon Bank, N .A., as Successor Trustee
for Pennsylvania Housing Finance Agency purchased the property for
costs.
3. The wi thin loan is insured by The Secretary of
Veterans Affairs (VA).
4. At the time of the scheduled Sheriff's Sale,
Plaintiff had not completed certain actions as required by the VA
prior to the Sale.
5. By setting aside the Sheriff's Sale, Defendant will
be able to continue to reBide in the propeJ;ty for at least three
additional months at no cost.
