The plaintiff above named, hereinafter referred to as
"Plaintiff", claims of the Defendant above named, hereinafter referred
to as "Defendant", the sum of $5,443.65 with interest thereon, upon the
following cause of action:
1. Plaintiff is Fibar, Inc. Defendant(s) is William Foust.
2. At the special instance and request of the plaintiff,
Defendant received as prepayment for materials $18,400.00, the
materials to be delivered over time to Plaintiff's customers. Of this
sum Defendant failed to deliver materials having a value of $1,101.65
as set forth in Plaintiff's statements of account, true and correct
copias of which are attached hereto, made part hereof, and marked
Exhibit "A".
3. Defendant, also in the course of the manufacturing and
delivery of goods to Plaintiff's customers, delivered defective product
having a value of $968.00 to a job in Sparta, New Jersey, entitled
"Kids Kastle". As a result of the defective material, Plaintiff was
required to employ a subcontractor named Mike Long to coordinate the
removal and installation of new wood material which charges amount to
$3,400.00, as more particularly set forth in Plaintiff's statements of
account and correspondence, true and correct copies of which are
attached hereto, made part hereof, and marked Exhibit "B".
