and a line orsIOO.OO-$I,OOO.OO: and iv) civil contempt under 23 Pa.C.S. ~6114.1.
This Order shall remain in eftect until modi lied or terminated by the Court and can be
extended beyond its original expiration date if the Court linds that the delendant has committed an
act of abuse or has engaged in a pattern or practice that indicates risk of harm to the plaintilf

COUNTY COURTHOUSE, CARLISLE, PENNSnVANIA.
The plaintift'may proceed without pre-payment of fees pending a further order after the
hearing.
The Camberland County Sherill's Department shall attempt to make service at the
plaintiffs request and without pre-payment of fees. but service may be accomplished under any
applicable rule or Civil Procedure
This Order shall be docketed in the oftlce of the Prothonotary and forwarded to the Sheriff
for service The Prothonotary shall not send a copy of this Order to the defendant by mail.
The Hampden Township Police Department shall be provided with a certified copy of this
Order by the plaintift's attorney. This Order shall be enforced by any law enforcement agency
where a violation occurs by arrest for indirect criminal contempt without warrant upon probable
cause that this Order has been violated, whether or not the violation is committed in the presence
of the police officer. In the event that an arrest is made, under this section, the defendant shall be
taken without unnecessary delay before the court that issued the order When that court is
jumped on the bed, threw his body ontop of the plaintill: and tried to bite her on
the chest The delendant broke the screen on the window. and when the plaintift'
tried to call lor help. he threw the telephone against the wall, and pulled the cord
trom the wall The plainlil1' tried to put the telephonc back together, but the
derendant grabbed her by the arm and restrained hcr When she got away from
him. he chased her down the hall. pushed her on hcr back causing her to fall to her
knees and onto her hands. As the plaintill'lay crying on the 110or. the derendant
kicked her on the inside of her thigh, smashed a clock, and threw a glass votive
candle hitting a picture on the wall shattering the glass. The plaintift'ran from the
apartment and telephoned the police lor help The Upper Allen Township Police
responded. arrested and charged the detendant with simple assault. harassment and
stalking. and took him to thc Cumberland County Prison. A preliminary hearing
was scheduled belore District Justice Klair on Tuesday, Septcmber 16. 1997; the
hearing was waived by the derendant and the case bound over for trial.
b) On or about August 29, 1997, the defendant threw several coins and a
lighter at her striking her on the forehead with one of the coins The plaintiff
sustained a red mark and wreness about her forehead. and had a headache as a
result of this incident
c) On or about August 15, 1997, the defendant. who was with the plaintiff at
a restaurant, poured a drink on the plaintiff's lap, followed her after she left and
went to see a friend, and insisted that she leave with him On the way out the
door, the defendant shoved the plaintilT into the door, kicked the side or the car
she was driving when they got into the parking lot. pushed her causing her to rail
down on her hands and side (The plaintitl' had had surgery on her right hand on
August 8. 1997. and had the cast removed on August 12th) A bystander
intervened and took the plaint ill' intu the building. The I.ower Allen Township
Police responded aller someone telephoned lor help The defendant was charlled
with reckless drivinll and harassment The plaintifl'sustained a contusion on her
side. and soreness ahuut her body and hands as a result of this incident
d) On or about AlIgu~t 9, 1997, the delendant threw coins. a Iillhter. pcns.
coasters. and keys at the plaintil1' as she sat on the couch watching television The
plaintiff left the rcsidence for approximately an hour to avoid further abuse. and
when she returned, the delendant harassed her, intimidated her by gelling close to
her race and leaninll over her, threw ubjects at her. slapped her on the back of her
head. pushed her down onto the 1100r, and punched her approximately 10 times in
the same place on her leg. The plaintifJ'sustained bruising about her leg as a result
of this incident
e) In or about January 1997. the delendantthrew a pen at the plaintiff striking
her in the temple. The plaintill' sustained a laceration and soreness on the side of
her head as a result of this incident.
t) Since approximately January 1997, the defendant has abused the plaintiff
on a weekly basis in ways including. but not limited to, pushing. shoving.
punching. slapping. kicking her (several times wearing steel.tocd boots). pulling
her hair. and biting her. The defendant has also broken and thrown objects and
household items at the plaintiff and about the residence. and punched walls and
doors. In addition, the defendant has threatened to kill the plaintiff, threatened
suicide. and has punched himself causing bruising
S. The plaintiff believes and therelore avers that she is in immediate and present
danger or abuse rrom the derendant and that she is in need of protection from such abuse.
6, The plaint ill' desires that the delendant bc prohibitcd lrom having any direct or
indirect contact with the plaintill' including. but not limited 10. tclephone and wriuen
communications.
7. The plaintilf desires that the delendant be enjoined from harassing and stalking the
plaintit't: and from harassing her relatives.
8. The plaintill' desires that the defendant be restrained lrom entering her place of
employment.
9. The plaintift' desires that the delendant be enjoined from removing. damaging.
destroying or selling any property owned jointly by the parties or owned by the plaintift~
B. EXCLUSIVE: POSSESSION
10. The residence rrom which the plaintill'is asking the Court to order the defendant to
stay away from located at 1104 Gunstock Lane. Mechanicsburg, Cumberland County.
Pennsylvania, is owned in the names of her parents. lIerbert and Jeanne Lenker, and the defendant
has never resided there. The plaintiff left the residence jointly leased by the parties at 6098. Apt.
26. Geneva Drive. Mechanicsburg. Cumberland County. Pennsylvania. on September 2. 1997. to
avoid further abuse and ror her safety The plaintiff does not seek to exclude the delendant from
his residence.
C. LOSSES AND REIMBURSEMENT FOR COST OF CASE
II. The plaintiff has suffered losses as a result of .mthe abuse by the defendant. The
losses are listed on Exhibit A attached
12 Ordering the delendant to pay $25000 to Cumberland County. one of Legal
Services. Inc.'s lunding sources. in lieu of attorneys' lees. as reimbursement for the cost of
litigating this case and assessing the $25.00 surcharge and court costs to the defendant if the case
goes to hearing
WHEREFORE, pursuant to the provisions of the "Protection trom Abuse Act" of October
7, 1976, 23 p, S, ~6l 0 I ~l ~. as amended. the plaintitl" prays this Honorable Court to grant the
following reliet':
A. Grant a Temporary Order pursuant to the "Protection IrOln Abuse Act"
I. Ordering the defendnnt to relrain from abusing the plaintil1' or Irom
placing her in lear of abuse
2. Ordering the delendant to refrain Irom having any direct or indirect
contact with the plaintitl' including. but not limited to. telephone and
written communications
3. Ordering the delendant to retrain lrom harassing and stalking the
plaintiff and from harassing her relatives
4. Prohibiting the defendant lrom entering the plaintitl's pi lice of
employment.
5. Prohibiting the delendant from removing. damaging. destroying or
selling property jointly owned by the parties or owned by the plaintiff.
6. Ordering the defendant to stay away lrom the plaintilfs current
residence at 1104 Gunstock Lane. Mechanicsburg. Cumberland County.
Pennsylvania. and ordering the defendant to stay away from any residence
the plailllitl' may establish for herself pending a 11nal order in this mailer.
B. Schedule a hearing in accordance with the provisions of the "Protection rrom
Abuse Act," and. after such hearing. enter an order to be in effect for a period of one year:
I. Ordering the defendant to rerrain lrom abusing the plaintiff or from
placing her in rear of abuse.
2. Ordering the delendant to relrain lrom having any direct or indirect
contact with the plaintif1' including. but not limited to. telephone and
written cOlllllluniclltions
3. Ordering the dcfendant to relrain lrom harassing and stalking the
plaint ill' and lrom harassing hcr relatives.
4. Prohibiting thc delendant from cntering the plaintiffs place or
employment.
S. Prohibiting the delendant lrom removing. damaging. destl'Oying or
selling properly jointly owned by the pllrties or owned by the plaintiff.
6. Ordering the delendant to stay away from the plaintiff's current
residence at 1104 Gunstock Lane. Mechanicsburg. Cumberland County.
Pennsylvania. and ordering the defendant to stay away from any residence
the plaintiff may establish tor hcrself pending a 11nal order in this matter.
7. Ordering the delendant to pay $250.00 to Cumberland County. one
of Legal Services. Inc's fu'lding sources. in lieu of attorneys' fees. lIS
reimbursement for the cost of litigating this case and assessing the $25.00
surcharge and court costs to the derendant if the case goes to hearing.
The plaintiff further asks that this Petition be 11 led and served without payment of fees and
costs by the plaintiff. pending a further order at the hearing. and that cenified copies of this
