On or about ,July I, 200", Defendant pushed Plaintirr into the eorree table and paeed baek and
rorth, mnKln~ his arms and hands in Plaintlrrs race; picked up a 3 ft. speaker and threw It In
rront or Plaintiff, and continued to hanK It up alld down on the floor repeatedly causing her to
rear ror her sardy. Defendant pulled baek his list in a threatening manner as ir he wen f(olnK to
hit Plaintiff, and poked her with his linKer in her race and mouth. and slapped her in the arm.
Defendant pushed Plaintlrr aKalnst the wall, pinched hH breasts repeatedly, grabbed and
squeezed her huttocks, and tried repeatedly to shove his finger throul\h her clothes into her
vaRina. Later that day, Derendant rorced his way into the residence. pushed his chest Into
Plaintirr, and shoved her Into the \tereo speaker several times, Derendant pushed Plalntlrr into
the door frame and threatened to hurt her more than anyone ever hurt her hefore. Plaintiff
called the pollee who tiled harassment eharRes against Derendant.

On or ahout .June 29. 20"0, Ilefendant grahhed and pinched Plaintiffs breasts and attempted to
rorce her towards him. When Plaintlrr pulled a\uy, Defendant pulled her hair and ears.
In or ahout May 2000, Derendant attempted to rorce Plaintiff to have sexual Intercourse and
pulled her hair. The rollowing day, Defendant called Plalntlfr approdmatcly 20 times, durlnK
which time he threatened he would find her and that she would see wilh her own eves what he
would do to her. .
Sinee approdmately 1996, Ilefendant has ahused Plaintiff in ways ineludinK the rollowhlR:
pushed, restrained, and pulled Plalntirrs hair; kicked. choked. and dapped her; and twisted her
wrists. On several occasions. Defendant has sexually assaulted Plaintiff. Plalntlrr has sufrered
rrom hrulses and pain on several occasions as a result of Ilefendant's abuse,

PROBABLE CAllSE BELIEF IS BASED ON TilE FOLLOWING FACTS AND CIRCUMSTANCES:
Your affiant Is a Detective in the Cumberland County District Attorney's Office, Criminal
Investigation Division and has been employed as such for the past 2 years,
On Thursday, 6 May, 1999 the Defendant arrived at the Plaintiffs home at approximately 1630
hours, remaining until approximately 1830 hours, The Defendant returned to the residence at210 N
2nd Street, West Falrview at approximately 2100 hours carrying (2) 6-packs of beer and appearing to
be Intoxicated, Plaintiff had been on the second floor of the residence listening to music when the
Defendant arrived, When Plaintiff realized the Defendant had been drinking she asked him to leave,
but he refused, Defendant told Plaintiff he was going to buy a ticket to Mexico and he would then kill
the Plaintiff In such a way that she would not be found right away, then he would flee to Mexico where
no one would ever find him, The neighbor began to knock on the wall, which is a sign to turn the
music down, Plaintiff turned down the music, Defendant turned the music back up, Plaintiff
explained that the music needed to be turned down or the police would be called, Defendant grabbed
stereo remote control from Plaintiff and turned music up again, Plaintiff walked toward the stereo to
manually turn it down and Defendant pushed her, knocking her into the stereo, Plaintiff again
explained why the music needed to be turned down, Defendant became confrontational and began
using profanity in reference to the neighbor, Defendant went to the neighbor's front door and rang the
bell in an effort to confront the neighbor, No one answered Ihe door, Defendant returned to the
Plaintiff's location and began to badger her stating that he knew why she did not want him around, it
was because she was interested in someone else, Defendant also stated to Plaintiff that he knew
she cheated on him while he was in jail, Defendant kept repeating these statements over and over
until the Plaintiff finally said she had cheated on him, Defendant then moved across the room toward
the Plaintiff and swung at the Plaintiff with;:) closed fist. Plaintiff saw the punch coming and moved to
avoid being hit. Defendant attempted to punch plaintiff a second time and again the Plaintiff moved to
avoid being hit. Defendant then got very close to the Plaintiffs face with his face and yelled loudly,
moving his hands quickly toward the Plaintiffs face, but not striking her, Defendant then laughed at
the Plaintiffs flinching reaction, Two individuals that were visiting in the residence, Kenny Jones and
Suraj Vyas, went to where the Plaintiff and Defendant were, after they heard the Defendant yell
loudly, and inquired as to what was going on between the pair, Defendant became confrontational
with Mr, Vyas telling him it was none of his fucking business, Mr. Vyas stated that he would not

an adult individual residing at 1107 Rana Villa Avenue, Apt. I, Camp Hill, Cumberland County,

3. The defendant has had an intimate relationship with the plaintilf
4, Since approximately December 1996, the defendant has attemp.ed to cause and
has intentionally, knowingly, or recklessly caused bodily injury to the plaintitT, has placed the
plaintiff in reasonable fear of imminent serious bodily injury, has knowingly engaged in a course of
conduct or repeatedly committed acts toward the plaintill'including following the plaintiff wi.hout
proper authorization, under circumstances which have placed the plaintiff in reasonable fear of

In or ubout the early hours of September I, 1997, the defendant returned '0
the plaintilfs residence, knocked on the door, demanded to be let in, and when the
plaintill'retuse(l, he charged the door using his shoulder to break it open, chased
.he plaintitl'up the stairs, and pushed her down the hallway and against the wall, A
neighbor who was visiting the plaintill' intervened and the defendant punched him
in the eye knocking him to the t1oor. The detendant followed the plain. iff who ran
to the kitchen, and repeatedly pushed her against the refrigerator, washer, and
dryer, The plaintitfs daughter again telephoned the police for help, and the
defendant left .he residence before the police arrived, The Pennsylvania State
Police charged the detimdant with harassment as a resuh of this incident, and he
was fined by District Justice Manlove.
b) On or about Augus. 30, 1997, when the plaintiff' allempted to protect her
6-year-old son from the defendan' who was screaming and cursing in the child's
face, the defendant grabbed and squeezed .he side of the plaintiff's neck, and
pushed her sideways, Fearing tor his safety, the plaintitf removed her son from the
room, bu. the defendant followed the plainlill' and the child and shoved the plaintiff
on her back causing her to stumble and lose her balance
c) On or abou. August 23, 1997, .he defendant bit .he plaintiff on her neck,
The plain. iff sustained soreness and bi.e marks as a result of this incident.
d) On or about August 16. 1997, .he defendant kicked the plaintiff in the
abdomen, leg, and jaw culling her chin. The plaintitrs daughter .elephoned the
police for help, and the dettmdant lell.he residence before Ihe police arrived The
plaintitl' sustained bruising and soreness about her legs, soreness about her
abdomen. and a lacera.ion on her chin as a resuh Oflhis incident.
On or about the morning of August 17. 1997, .he defendant returned to the
plaintitl's residence, entered her home through a kitchen window. Irigh.ened the
plaintitl' as she showered. and lhrea.ened her saying, '" f , ever go '0 jail because
you call the cops. when I get out, I'll kill you"
e) On or about August I, 1997, when the plainlill'tried to leave her bedroom,
the defendant used his chest '0 push her causing her '0 fall agains. the dresser and
closet door. blocked the doorway so she could not get out of the room, and
repeatedly shoved her on her ches. and shoulders causing her to fall onto the bed,
I) In or about June 1997, the defendant grabbed the plaintill's wrists tightly
and twisted her arms The plainlill' sustained soreness about her wrists. a lump
that has remained on her left wrist, and periodic numbness in the fingers of .hat
hand as a result of the injury during this incident.
g) On or about May 25, 1997. the delendant slapped the plaintitl' in .he face,

IS, The facts of the most recent incident of abuse arc as follows:
On or about July 1,2000, Defendant pushed Plaintiff Into the coffee table and paced back and
forth, flinging his arms and hands In Plalntlfrs face; Ricked up a 3 ft. speaker and threw It In
front of Plaintiff, and continued to bang It up and down on the floor repeatedly causing her to
fear for her safety, Defendant pulled back his fist in a threatening manner as if he were going to
hit Plaintiff, and poked her with his finger In her faee and mouth, and slapped her In the arm,
Defendant pushed Plaintiff against the wall, pinched her breasts repeatedly, grabbed and
squeezed her buttocks, and tried repeatedly to shove his finger through her clothes Into her
vagina. Later that day, Defendant forced his way Into the residence, pushed his chest into
Plaintiff, and shoved her Into the stereo speaker several times. Defendant pushed Plaintiff Into
the door frame and threatened to hurt her more than anyone ever hurt her before. Plaintiff
called the police who filed harassment charges against Defendant.
16, Prior incidents of abuse that the Defendant has committed against Plaintiff or the minor child/ren,
(including any threats, injuries, or incidents of stalking) are as lollows:
On or about June 29, 2000, Defendant grabbed and pinched Plalntlfrs breasl$ and attempted to
force her towards him. When Plaintiff pulled away, Defendant pulled her hair and ears.
In or about May 2000, Defendant attempted to force Plaintiff to have sexual Intercourse and
pulled her hair. The following day, Defendant called Plaintiff approximately 20 times, during
which time he threatened he would find her and that .he would .ee with her own eye. wbat be
would do to her.
Since approximately 1996, Defendant hu abused Plaintiff In ways includlnl! the following:
pushed, restrained, and pulled Plalntlfrs hair; kicked, choked, and slapped her; and twisted ber
wrists. On several occasions, Defendant has sexually assaulted Plaintiff. Plaintiff has suffered
from bruises and pain on several occasions as a result of Defendant's abuse.

including but not limited to any contact at Plaintiffs school, business, or place of
employment, except as the court may find necessary with respect to partial custody
and/or visitation with the minor child/ren.
e. Prohibit Defendant from having any contact with Plaintiffs relatives and Plaintiffs
children listed in this petition, except as the court may find necessory with respect
to partial custody and/or visitation with the minor child/ren.
d. Order Defendant to pay the costs of this action, including filing and service fees.
e. Order the following additional relief, not listed above:
_ Order Defendant to pay $250.00 to one of Legal Services, Inc.'s funding
sources for cost of litigation In this case.
-Defendant shall refrain from harassing Plalntlrrs relatives.

PROTECTION ORDER
AND NOW, this _~~.. day of September, 1997. upon consideration of the Consent
Agreement of the parties, the following Order is entered,
I, The defendant, Ruben Capetillo Ibarra, is enjoined lrorn physically abusing the
plaintiff, Robin Joy Parker, or Irom placing her in fear of abuse
2, The defendant is ordered to relrain Irom harassing and stalking the plaintiff and
from harassing her relatives and her minor children
3, The defendant is prohibited Irom entering the plaintitl's place of employment or
school.
4. The defendant is prohibited trom removing, damaging, deslroying or selling any
property owned by the plaintiff.
5, The defendant shall reimburse the plaintiffs out-of~pocket losses listed on attached
Exhibit A. resulting from the incident which occured on or about September I, 1997, The
defendant shall repay the total amount of $150,00 to tile plaintiff in the form of a money order
made payable to her mailed to her residence, The defendant shall repay the total amount of losses
within 60 days of the entry of the Protection Order. An award under this chapter shall not
constitute a bar to litigation for civil damages lor injuries sustained from the acts of abuse giving
rise to the award or a finding of contempt under this chapter,
6, Court costs and lees are waived
7, This Order shall remain in etlect lor a period or one ( I) year and can be extended
beyond that time if the Court Iinds that the delimdant has commilled IIn act of abuse or has
engaged in a pallern or practice that indicates risk of harm to the plaintitl', This Order shall be
enforceable in the same manner as the Court's prior Temporary Protection Order entered in this
case,
8. This Order may subject the defendant to i) arrest under 23 Pa,CS ~6113; ii) 8
private criminal complaint under 23 Pa,CS, ~6113, I; Iii) a charge of indirect criminal contempt
under 23 Pa.CS, ~6114, punishable by imprisonment up to six months and a line of $100,00-

This Order shall be enforced by the police who have jurisdiction over the plaintiffs
residence OR any location where a violation of this order occurs OR where the

Order, defendant shall be arrested on the charge of Indirect Criminal Contempt. An
arrest for violation of this Order may be made without warrant, based solely on
probable cause, whether or not the violation is committed in the prcsence oflaw
enforccmcnt.
Subsequent to an arrest, the law enti.lreemcnt oftieer shall seize all weapons used or
threatened to be used during the violation of this Order OR during prior incidents of
abuse. Weapons must fi)rthwith be delivered to the Sheriffs oflice of the county
which isslIed this Order, which oflice shall maintain possession of the weapons until
