AND NOW. December 17. 1997, 4:15 p.m,. after hearing
ond considerotion of the testimony presented, we do moke the
Rule absolute and we do find the defendant to be in contempt of
our order of September 30, 1997. which he signed os a consent
order.
Having found the defendant in contempt. sentence of
the court is thot the defendont pay the costs of prosecution of
these proceedings, and that he undergo imprisonment in the
Cumberland County Prison for 0 period of not less than five doys
nor more than six months. We give the defendont credit for five
doys previOUSly served, and we now place him on parole to any
detoiners lodged against him. Condition of his parole sholl be
thot he be and remain on good behavior. comply with the
protection order entered September 30, 1997, and in addition to
thot order, that he hove no contact whatsoever, directly or
indirectly. or through third parties. with the plaintiff in this
case, Susan Kothleen Pontz.
Further. upon agreement of both parties, we modi~y the

OF INDIRECT CRIMINAL CONTEMPT
Jaime Keating, Chief Deputy District Attorney of Cumberland County,
Pennsylvania, brings the following Petition for a hearing on charges of Indirect Criminal
Contempt:
I. A Protection from Abuse Order was issued by the Court. A true and correct
copy of the Order is attached.
2. The defendant's violation of this Order is averred in the attached criminal
complaint.
3. The victim requests the filing of an Indirect Criminal Contempt Charge.
4. The District Attorney's Office approves the filing of this criminal complaint.
5. The Commonwealth is requesting a hearing on the charges oflndirect Criminal
Contempt pursuant to 23 Pa.C.S.A. 9 6113.
6. The plaintiffandlor the defendant may seek modification of the Order based on
the filing of this petition as the Court deems appropriate following the trial in addition to
any other sentence. 23 Pa.C.S.A. 96113.

On September 3D, 1997 a Protection from Abuse order was issued
and signed by the Honorable Judge George E. Hoffer prohibiting
Khaldun Baseer Rasheed from placing Susan Ponll of 59 West Main 51.
in fear of physical abuse, harassing Iler or stalkil\8 Iler. The order
prohibits him from this type of behavior towards her for a period of
one year,
At approx, 1855 hrs bn December 6, 1997 the Mechanicsburg Police
Deptl received a call from Susan PontI explaining that he had just
left her apartment after entering it uninvited and harassing her,
Susan advised she was on the phone with a friend in her bedroom when
Rasheed was suddenly outside the bedroom door yelling at her. He
was upset about money he thought she owed him and was demanding a
portion of it, Susan gave him $40 toward it and demanded that he
leave. He continued to yell and scream and she threatened to call
the police. He defied her to call and threatened that he would see
to it that she went to jail also if he did.
Rasheed left Susan's residence and we were not able to locate
him between her residence and his a block away. Later in the same
evening Susan says he began calling again and mocked her about not
being in any trouble ~ith the police. She claimed she repeatedly
hung up and he'd call back be,in'g nasty, calling her names and
cursing.
I phoneda neighbor of Susan's at 59 West Main St. and she
verified the loud yelling she overheard from a male in Susan's
apartment at around the time she reported.
At approx, 0530 hrs. on December 9, 1997 Susan received
several more harsssing calls from Rasheed. Neighbors a short
time later were awakened to him standing outside yelJing and
screaming up to her.

at tile Colonial !louse. 125 West Main Street, Apt 5. Mechanicsburg. Cumberland County,
Pennsylvania. is ordered to stay away from the plaintill's residence located at 59 West Main
Street, 2nd Floor Front, M~"haniesburg, Cumberland County, Pennsylvania, a residence leased
only to the plaintilf, and the defendant is ordered to stay away from any other residence the
plaintitT may in the future establish for herself
The defendant is ordered to refrain from having any direct or indirect contact with the
plaintiff or her relatives, including, but not limited to, telephone and wrillen communications.
A violation of this Order may subject the defendant to: i) arrest under 2.1 Pa.e.S. ~6113;
ii) a private criminal complaint under 2.1 Pa C S ~6113.1; iii) a charge of indirect criminal

The plaintiff. Susan Kathleen Pontz, by and through her attorney, Joan Carey of Legal
Services, Inc., states the following
I. The plaintilf filed a Petition for Protection from Abuse on September 19, 1997, in
the above-captioned case and a Temporary Protection Order was entered on the same date. By
agreement of the panies. a Protection Order was entered on September 3D, 1997 (see auached
F.~hibit A, incorporated herein by reference).
2. The plaint ill' requests a Modilication of the Protection Order for reasons including,
but not limited to, the following:
a) On or about November 17, 1997, the defcndant came to the plaintitrs
home uninvitcd, and whcn the plaintiff told him to Icave, he refused. The
defendant threatened to "take her out" if she called the police for help and he
endcd up in jail for a violation of the Protection Order. The defendant told the
plaintiff that he was not going to let her out of his sight and that he was not going
to leave her alone. The defendant follow,..d the plaintiff about her apanment,
argued with her, and swung his lisl al he; to pun~h her, bot she moved 10 avoid
being struck. The plaintill' telephoned the poli~e for help While wailing for the
police to arrive, the defendant threatened the plaintiff saying, "I'll wait until you're
asleep to pour boiling walCI' on you. I'll cut you up with kitchen knives, I'll stab
you with scissors. and I'll shool you while you're walking on the street" The
plaintitl' feared lor her safety and len the rcsiden~e tor her salcty and 10 avoid
abuse.
b) On or about No,.ember 14, 1997, after having dinner with the plainlilf, the
defendant lallowed her about her apanmenl verbally harassing her, stood in
doorways blocking her from leaving, pinned her down on the couch with the
weight of his body, grabbed her by the hair. pulled her head back, and told her,
"Vou will have to change"
c) On or about November 10, 1997, the defendant verbally harassed and
intimidated the plaintilT by telling her that despite the Protection Order she has
against him. he had the power and control, and he threatened to "get even" with
her for tiling the Protection From Abuse action.
d) Since approximately early November. 1997, the defendant has abused the
plaintiff in ways including, but not limited to. ~alling her names. verbally harassing
and intimidating her on a daily basis. telephoning her home in~essantly at all hours
causing her to haw to turn off the telephone ringer or unplug the telephone,
leaving messages on her answering machine, and leaving notes in her mailbox. In
addition, the dcfcndant has come to the plaintitl's home uninvited. refused to

Agreemenl of the panies, the following Order is entered:
I. The defendant. Khaldun Baseer Rasheed, is enjoined from physically abusing the
plaintiff, Susan Kathleen PontI, or from placing her in fear of abuse.
2. The defendant is ordered to refrain from harassing and stalking the plaintiff and
from harassing her relatives or her minor children.
3. The defendant is prohibited from removing. damaging, destroying or selling any
propeny owned by the plaintiff.
4. The defendant is ordered to relinquish to the sheriffs depanment any weapons
which he owns or possesses; it is further ordered that any weapons confiscated through the
Temporary Protection Order shall remain in the custody of the Cumberland County Sheriff s
Depanment for the duration of this Order and that the defendant shall not acquire or possess any
weapons for the term of the Protection Order.
5. Coun costs and fees are waived.
6. This Order shall remain in effect for a period of one (1) year and can be ex1ended
beyond that time if thll Court finds that the defendant has commiued an act of abuse or has
engaged in a pauem or practice that indicates risk of harm to the plaintiff. This Order shall be
enforceable in the same manner as the Coun's prior Temporary Protection Order entered in this

CONSENT AGREEMENT
-
This Agreement is entered on this;.r.. day of September, 1997, by the plaintiff, Susan
Kathleen Pontz, and the defendant, Khaldun Baseer Rasheed. The plaintiff is represented by Joan
Carey of LEGAL SERVICES, INC.; the defendant is unrepresented but is aware of his right to
have an attorney. The panies agree that the following may be entered as an Order of Co un.
I. The defendant, Khaldun Baseer Rasheed, agrees to refrain from abusing the
plaintiff, Susan Kathleen Pontz, or from placing her in fear of abuse.
2. The defendant agrees not to harass and stalk the plaintiff and not to harass her
relatives or her minor children.
3. The defendant agrees not to remove, damage, destroy, or sell any propeny owned
by the plaintiff.
4. The defendant agrees to relinquish to the sheriff's depanment any weapons which

7. Violation of the Protection Order may subjeclthe defendant to: i) arrest under 23
Pa.C.S. ~6113, ii) a private criminal complaint under 23 Pa.C.S. ~6113.1; iii) a charge ofindircct
criminal contempt under 23 Pa.C.S. ~6114, punishable by imprisonment up to six months and a
fine of SI00.00-S1 ,000.00; and iv) civil contempt under 23 Pa.C.S. ~6114. \.
WHEREFORE, the parties requeslthat a Protection Order be entered to reflcctthe above
terms.

A. ABUSE
I. The plaintilT, Susan Kathleen Pontz. is an adult individual residing at 59 West Main
Street, 2nd Floor Front, Mechanicsburg, Cumberland County, Pennsylvania 17055.
2. The defendant, Khaldun Baseer Rasheed, (SSN: Unknown}(DOB: 4/25/58), is an
adult individual residing at 59 West Main Street, 2nd Floor Front, Mechanicsburg, Cumberland
County, Pennsylvania 17055.
3 The defendant has had an intimate relationship with the plaintiff
4. Since approximately August 1997, the defendant has attempted to cause and has
intentionally, knowingly, or recklessly caused bodily injury to the plaintiff, has placed her in
reasonable fear of imminent serious bodily injury, has falsely imprisoned hcr pursuant to 18 Pa.
C.S. ~ 2903, and has knowingly engaged in a course of conduct or repeatcdly committed acts
toward the plaintifl'under circumstances which have placed her in reasonable fear of bodily injury.
This has included, but is not limited to, the following specific instanccs of abuse:
a} On or about Septcmber 16, 1997, the plaintiff and her 12 and l3-year old
children werc Icaving her apartment when the defendant appeared and demanded
that she let him into the apanment When the plaintitl' refused to let the defendant
in, he threatened to kick the door in and did so The plainlin's children were
traumatized as a result of this incident The plaintitT. fearinglilr her safety. left and
did not return to the apartment to avoid abuse
The next day upon returning to her apartment. the plaintiff found that the
defendant had left the doors unlocked and the safety stops on the windows
removed exacerbating her fear
b) On or about September 14. 1997. the defendant knocked a cigarelte out of
the plaintiff's mouth. yelled and swore at her, lollowed her about the apartment,
and when she tried to leave. the defendant stood in the doorway with both his arms
against the door jamb The defendant told the plaintilf that she had to listen 10
him, threatening that he would get the answers to his questions one way or
another. He further threatened that he would whoop her ass. and told her that he
knew the criminal sentence he would get if he beat her or the people who are
supportive of her, and threatened that he would "take her 01.1\". The defendant
also threatened to slash the tires 011 her car, put sugar in the gas tank, pull out the
wires, and smash the car windows. When the plaintiff stood up and tried to leave
the room, the defendant stood blocking the doorway. shoved her backward onto
the bed, stood over her as she was curled up in a fetal position and screamed at her
as he used both his hands repeatedly slapping the sides of her head back and forth.
When the plaintiff's downstairs neighbor came to her door to see if she was
allright, the defendant had one hand around the plaintill's lhroat and his other hand

clasped over her moulh so she was unable 10 answer The defendant yelled at the
neighbor through the door saying it was none of his business. The neighbor
telephoned Ihe police lor help. The Mechanksburg Police responded.
c) On or aboul September 13, 1997, the defendant followed the plaintiff about
the house demanding to know her whereabouts and whom she was with. The
defendant stood over her at the side of the bed when she got into bed and
threatened her saying, "You act like a bitch; I'll treat you like a bitch.", and called
her names. The plaintiff told the defendant that he was scaring her and that she
wanted to leave the house The defendant grabbed ber keys, stood blocking the
doorway, then allowed her to leave. Later when the plaintiff returned to the
apanment, the defendant grabbed her head and forced her to perform fellatio on
him.
d) On or about August 29, 1997, the defendant opened and retracted an
industrial box cutting razor in a threatening manner during an argument with the
plaintiff. The defendant wears the razor in a sheath on his belt regularly although
he no longer works at the job where it was originally used.
e) On or about August 27, 1997, the defendant stood in the doorway with his
arms spread across the door fi'ame and when the plaintiff asked him to let her pass,
he shoved her backward against the dresser causing her to strike her back and
elbow and her head to snap Lack. The delcndant threatened the plaintiff saying

I) Since dPproximatcly August 19<)7, the defendant has abused the plaintitf in
ways including, but not limited to, shoving, slapping, and grabbing her;
intimidating her by pointing his linger in her Iilce, and standing over her during
arguments; breaking into her apartment. The defendant causes the plaintilT 10 fear
by making tidse accusations, demanding that she divulge her every move,
contacting her throughout the day, monitoring her telephone calls. listening on an
extension telephone, screaming at the callers, erasing her messages from her
answering machine, not conveying messages left for her, and disconnecting the
telephone during her conversations, The defendant has threatened to beat the
i>laintilT several times and to kill her.
S, On or about September 13, 1997, the plaintitfleft her residence at S9 West Main
Street, 2nd Floor Front, Mechanicsburg, Cumberland County, Pennsylvania, lor her protection
and to avoid further abuse,
6, The plaintilT believes and therefore avers that she is in immediate and present
danger of abuse from the defendant and that she is in need of protection from such abuse,
7, The plaintitl' desires that the defendant be prohibited from having any direct or
indirect contact with the plaintiff including, but not limited to, telephone and written
communications.

defendant which is leased in the name of the plaintiff. Susan Kathleen Pontz. The defendant has
lamily in Harrisburg with whom he could reside,
C. REIMBURSEMENT FOR COST OF CASE
12 The plaintilT desires that the defendant be ordered to pay $250.00 to Cumberland
County, one of Legal Services, Inc.'s funding sources, in lieu of attorneys' fees, as reimbursement
for the cost oflitigaling this case and assess a $25,00 surcharge and court costs to the defendant if
the case goes to hearing,
WHEREFORE, pursuant to the provisions of the "Protection from Abuse Act" ofOclober
7, 1976.23 Pa,C.S. ~ 6101 ~~. as amended, the plaintiff prays this Honorable Court to grant
the following relief:
A. Grant a Temporary Order pursuant to the "Protection from Abuse Act:"
I. Ordering the defendant to refrain from abusing the plaintiff or from
placing her in fear of abuse.
2. Ordering the defendant to refrain from having any direct or indirect
contact with the plaintiff including, but not limited to, telephone and
written communications.
3, Ordering the defendant to reti'ain Irom harassing and stalking the
plaintilTand from harassing her relatives and her minor children,
4, Prohibiting the defendant from removing, damaging, destroying or
selling property owned by the plaintiff.
5. Ordering the def\lndant to stay away from the plaintilfs current
residence located at 59 West Main Streel. 2nd Floor Front,
Mechanicsburg, Cumberland County, Pennsylvania, and any other
residence the plaintifl'may in the future establish for herself.
6, Ordering the defendant to relinquish to the sherilfs department any
weapons which he owns and possesses (the industrial razor box cutter) and
prohibiting the defendant from acquiring or possessing any other weapons
for the duration of the Temporary Protection Order.
B. Schedule a hearing in accordance with the provisions of the "Protection from
Abuse Act," and, after such hearing, enter an order to be in elTect for a period of one year:
I. Ordering the defendant to retrain from abusing the plaintilT or from
placing her in fear of abuse,
2. Ordering the defendant to refrain Irom having any direct or indirect
contact with the plaintilT including, but not limited to, telephone and
written communications,
3. Ordering the defendant to refrain from harassing and stalking the
plaintilT and from harassing her relatives and her minor children.

Defendant appearing for arraignment on the petition for Indirect
Criminal Contempt, and having pled not guilty, the Defendant is
directed to appear for a hearing before Judge Hoffer on
Wednesday, June 3rd, 199B, at 10:00 a.m.
The Defendant is released on ROR bail on the specific
condition that he have no contact whatsoever, verbal, in
writing, by phone, or by eyesight with the victim in this case,
who is Susan Pontz.
