AND NOW comes the Defendant Ace Auto Collision Experts and avers the
following in response to Plaintiffs Complaint:
Denied in part and admitted in part, It is denied that Plaintiffs claim that the truck
must be completely stripped and repainted as a result of insufficient and improper
preparation of painting by Ace. By way of further response, the Defendant is prepared
to compensate Plaintiff, and Plaintiff has accepted, an offer for the amount appealed
from the District Justice verdict in the amount of $1 ,753,85 in full and final seltlement.
The Plaintiff and counsel for defense will exchange selllement funds and a Release
within the next 10 business days.
WHEREFORE, Defendant prays that the Court will mark the case settled upon
filing of an appropriate praecipe after exchange of settlement proceeds,

Dear Judge Bayley:
In follow up to my telephone conference with your chambers of this morning; this is to
confirm that I did transmit by correspondence copied to you on November 10,1997 to the pro se
Plaintiff, a r'ilsident of Virginia, the settlement check, a General Release and a Praecipe for
Discontinuance, The Plaintiff, Mr, Hawthorne, had advised prior to my transmittal that he would
return the Release upon confirmation that my client's settlement check had cleared, I have left
a telephone message with Mr, Hawthorne today to get back to me with that confirmation.
I fully expect this case is settled, However, I do wish to request that the Court continue
the hearing scheduled for Monday, Nove,nber 24, at11 :30 a,m, generally so that the Court's
time is not unduly wasted, I am requesting a continuance at this time rather than filing a
Praecipe since Mr, Hawthorne is pro se and I do not wish to inadvertently cause any further
procedural concerns for the Court,

Dear Mr. Hawthorne:
Enclosed is the settlement check of K&H Ford for settlement of your action against Ace
Auto Collision Experts along with a basic Release and a Praecipe for Discontinuance.
As we discussod by telephone, 'lou will execute the Release and forward to me, I would
appreciate it also If you would forward to me the signed Praecipe, This is the document that I
will file with the Cumberland County Court formally closing this lawsuit. Of course, you should
only forward the Release and the Praecipe to me after you are satisfied that the settlement
check has cleared,
You will note that in the Release I have added a paragraph that confirms your
authorization to me to file that Praecipe since you are currently unrepresented by Pennsylvania
counsel,
By copy of this letter, I am confirming with Judge Bayley the terms of our settlement and
this transmittal to you of the settlement check and Release and will also advise the Court
Administrator that the hearing scheduled for November 24 may be canceled, Thank you for
your consideration,

22306 for and in consideration of the sum of One Thousand Seven Hundred Fifty-three
dollars and eighty-five cents ($1,753,85) to him in hand paid, the receipt whereof Is
hereby acknowledged, has remised, released and forever discharged, and by these
presents does for itself, Its successors and assigns, remise, release and forever
discharge Ace Auto Collision Experts, their officers, agents, servants and employees,
successors and assigns, and any and all other persons, associations and corporations,
whether herein named or referred to or not, of and from any and every claim, demand,
right, or cause of action, or whatsoever kind or nature, either In law or in equity, arising
from or by reason of any damages, known or unknown sustained by R. C. Hawthorne,
or others, as the result of a dispute described and filed at Cumberland County CCP
action No. 97-5175 for which RC. Hawthorne has claimed the said Ace Auto Collision
Experts and Kuhns-Harnish Ford, Inc, to be legally liable, but this release shall not be
construed as an admission of such liability.
By his signature hereto, R C, Hawthorne authorizes counsel for Ace to file a
Praecipe to Discontinue since he is unrepresented by Pennsylvania counsel.
