PlaintiITnbove-namcd. by and through his attorney. John M. Glace, Esquire, who
respectfully presents this Complaint and. in support thereof. avers the following:
I. Plaintill'MICIIAEI. NIEVES, is an unnUlrried adult man who resides and
resided for all times relevant to this Complaint at 627 1I00t Owl Road. Monroe Township.
Boiling Springs. Cumberland County. Pennsylvania. 17007.
2. Delendanls. RITA and DWIGIIT GOCIIENAlIR. upon knowledge and belief.
are husband and wile and resided for all times relevant lor this Complaint at 1362 Indian
Peg Road. Monroe Township. Boiling Springs. Cumberland County. Pennsylvania 17007.
3. The lacts and occurrences hereinafter related took place on or about January 13.
1997 at approximately at approximately 8: 10 AM on Indian Peg Road. Monroe
Township. Cumberland County. Pennsylvania. Indian Peg Road is a private unpaved road
consisting generally of one and one-half(\ 1/2 ) lanes: but at some points the road is
narrower due to topography or overgrowth. This road is. however. in general use by the
multiple residents of Indian Peg Road and ofa branch spur called 1I00t Owl Road, their
invitees. and Ihe general public.
4. At that time and place, Plaintill'was traveling in an easterly direction from the
state road toward his residence at 627 lIoot Owl Road in his 1982 Chevrolet Cornaro
when he encountered the defendant RITA GOCHENAlIR driving, upon knowledge and
belief. a 1996 Oldsmobile ownedjoinlly by both the above Defendants. Defendant RITA
GOCIIENAlIR was driving the opposite direction (West) on the abovc described road.
S. It had recenlly snowed and the roadway of the above described unpaved private
road was packed down snow wilh no salt or other skid-reduction substances applied to
the road.
6. Delendant RITA GOC1IENAlIR at that time and place operated her allow
deseribed vehicle despite its sil.e and Ihe road conditions in such a manner that it collided

NEW MATTER
10. Plaintift: Michael Nieves, has failed to slate a cause of aClion against one or more of
the Defendanls.
II. Plaintiff's claim is barred and/or reduced by the doctrines of comparative and/or
contributory negligence.
12. Plaintitl's fl..'Covery for damages allegedly incurred to his 1982 Chevrolet Camero are
limited to the fair market value of the said vehicle, that being $1,500.00.
WHEREFORE, Defendants Rita Gochenaur and Dwight Gochenaur respectfully request that
Ihis Court enter judgment in Ibeir favor and against Plaintiff, Michael Nieves, and that the Complaint
be dismissed with prejudice.
COUNTER CLAIM
13. On or about January 13, 1997 at approximately 7:45 a.m., Rita Gochenaur was
operating her 1994 Oldsmobile owned jointly with Defendant Dwight Gochenaur, on Indian Peg
Road, Monroe Township, Cumberland County.
14. On or about this same time, Michael Nieves was operating his 1982 Chevrolet
Camaro on said Indian Peg Road, in an oppo~ite direction.
15. At said time and place, Michael Nieves operated his 1982 Chevrolet Camaro in such
a manner that it collided with Defendant Rita Gochenaur's vehicle, causing damage in an anlount
equal to $3,987.51. The foregoing collision and damages are the direct and proximate result oflbe
negligence, carelessness of Michael Nieves as follows:
(a) Operation of his vehicle at an excessive rate of speed undor Ibe ein:umstancesj
(b) Failure to have his vehicle under proper and adequate controlj
(c) Failure to apply his bl'akes in time to prevent a collision;
(d) Negligent application of his brakes;
(e) Failure to recognize and operate his vehicle in accordance wilb the exi.tin.
