10, The only "defense" offered by the Defendant for his
delinquency is his allegations that his income has decreased due to
the Defendants' separation and that he has requested a deed-in-lieu
of foreclosure.
11. The Plaintiff has no legal or statutory obligation to
accept a deed-in-lieu of foreclosure,
12. Upon Affidavit filed concurrently with this Motion, the
status of the mortgage payments made to and received by Plaintiff
is verified and reveals that Defendants are in default under the
terms of the Mortgage and that no cure has been effected.
13. The Affidavit further indicates that Plaintiff is the
owner and holder of the Mortgage Note dated September 30, 1996
executed by Defendants in the amount of $201,365.00 for real estate
situated at 6307 Valleybrook Drive, Mechanicsburg, Cumberland
County, Pennsylvania, of which Defendant is one of the record
owners.
14. By reason of the Defendant's foregoing admissions and the
documentation of default without an allegation that the default has
been cured or documentation thereof, there is no longer a triable
issue of fact or law.
15. There being no defense to Plaintiff's Complaint, judgment
shoul<;l be entered in favor of Plaintiff and against Defendant,
Robert A. Baldwin.

AS PLAINTIPP. PURSUANT TO Pa.R.C.P. 2352
AND NOW, comes Plaintiff, Homeside Lending f/k/a BancBoston
Mortgage Corporation and files the following Voluntary Substitution
and avers as follows:
1. Rule 2352 of the Pennsylvania Rules of civil Procedure
permits a substitution of a successor by the filing of record, a
statement of the material facts on which the rights of substitution
are based.
2. Homeside Lending, f/k/a BancBoston Mortgage Corporation,
which is the Plaintiff. herein, wishes to substitute Homeside
Lending, Inc. as the Plaintiff in the above-captioned action,
3. Material facts upon which the right of succession and
substitution is based are as follows:
On October 31, 1997, an Assignment transferring the
Mortgage from the original mortgagee, Barnett Mortgage
Company to Homeside Lending, Inc. was filed of record in
Book 560, Page 1120. A true and correct copy of the
Assignment is attached hereto. Homeside Lending, Inc. is
the current holder of the Mortgage for the premises
located at 6307 Valleybrook Drive, Mechanicsburg,
Cumberland County, Pennsylvania.

Elizabeth A. Gibney, being duly sworn, deposes and says!
1. 'I'hat she is the Vice President of Homeside Lending, Inc., which
has a business address of P.O. Box 44090, Jacksonville, Florida 32231,
and has personal knowledge of the facts hereafter set forth.
2. That Homeside Lending, Inc. is the Owner and Holder of a Note
dated September 30, 1996, executed by Robert A. Baldwin and Wendy L.
Baldwin, in the original amount of $201,365.00.
3. That said Note is secured by a Mortgage executed by Robert A.
Baldwin and Wendy L. Baldwin as recorded in Cumberland County Mortgage
Book 1344, Page 207, in the Records of Cumberland County, Pennsylvania.
Barnett Mortgage Company was the original Mortgagee. The Mortgage was
assigned to Homeside Lending, Inc. as recorded on October 31, 1997 in
Book 560, Page 1120. True and correct copies of the Mortgage and
Assignment are attached hereto.
4. That the present owners of record of the property are Robert A.
Baldwin and Wendy L. Baldwin, whose last known mailing address is 6307
Valleybrook Drive, Mechanicsburg, Pennsylvania 17055 and/or 2921 Grande
Rue, Allouez, Wisconsin 54301-1433.
5. That said Note is now in default, the due date of the last
installment being April 1, 1997.
6. That the out8tanding balance, exclusive of attorney's fees and
costs, as of November 30, 1997 is as follows:
