The plalntitl; by and through her attorney. moves the Court tor an Order generally
continuing the hearing in the above-captioned case on the grounds that:
I. A Temporary I'rotcction Ordcr was issucd by this Court on Scptember 2, 1997,
scheduling a hearing lilr October 7, 1997, at 10:00 a,m.
2. The Cumlx:rland County Sheriffs Department scrved a certified copy of the
Temporary Protection Order and Petition for Protection Order on September 30, 1997, at
approximately 3:06 p .m, at614 West Pine Street, 1'\.(1. Holly Springs, Pennaylvonia.
3. The defendant has n:tained Paul B. Orr to represent him in the matter.
4. The partics, by and through their cOUl1llel, agrce thai the healing Ix: generally
continued because the defcndant, who is in Roxbury Treatment Ccntcr locatcd at 601 Roxbury
Road, Shippcnsburg, Penn.'l)'lvania, is unable to attcnd thc hearing, and aL~o to afford the parties
times to negotiatc a consent agrcement.
S. Thc plaintiff requcsts that the Temporary Protection Order remain in effect for one
year or until modified or terminatcd by the court after notice and hcaring.
6. A ccrtified copy of the Order tor Continuance will be deliwRd to tho PcnnayMnla

Resumption or co-residence on the part of the plaintiff and defendant shall not nulll~ the
provisions orthe court ordfr.
This Order shall remain in etlect until modified or temtinated by the Court and can be
extended beyond its original expiration date if the Cow1 finds that the defendant has committed
another act of abuse or has engaged in a pattern or practice that indicates continued risk of hann to
the plaintiff.

g. On several different occasioll8 dwing the monlha of May,
JWle and July 1995, the defendant pWlched the p1alntift'in the head, ,
slapped her, and pushed her.
h. On or about April 21. 1995, the defendant backed the
plaintiff into a comer with hill body, held her with hill hand, and
repeatedly pWlched her in the head, face, arms and cheat call1ling
her 10 have two bruised eyes and bruises on her face, ann, and
cheal The p1alntiff struggled fi'ee rwming into another room, but
the defendant caught her, threw her down on a bed, repeatedly
pWlched her in the mouth and face causing lacerations in her mouth.
5. The plaintiffbclieves and therefore avers that she is in immediate and present
danger of abll8C from the defendant and that she is in need of protection from such abll8C.
6. The plaintiff desires that the defendant \xl prohibited from having any direct or
indirect contact with the plaintiff including, but not limited to. telephone and written
communications.
7. The plaintiff desires that the defendant be enjoined from har8S8ing and ataIking tho
plaintiff, and from harllllling the plaintiO's relatiws, or her minor child.
8. The plaintiff dcairea that the defendant be restrained from entering her pIKe of
employment the school of the minor child.
9. '{be plaintiff dc:sires that the defendant be: efliolned from rcmovin& damaaln&
destroying or acl1lng any property owned solely by the plaintiff.
B. EXCl.USIVE POSSESSION
10. lhe home from which the plaintitTia I18king the Court to exclude the defendant is
rented in the names of the plaintift. and the defendan~ but he his now living at his mother's
residence located at 416 W. Pine Street, Mt. Holly Sprin8/l. Pennsy1vania.
11. The plaintiff currently has no place to stay with her child exccptthe mutual home,
and the defendant has moved in with his mother.
12. The plaintiff desires poll8Cssion of the home so as to give the greatest dcgrcc of
continuity to the life of her child and to allow her to continue her education at her school IIId to
continue her school and social activities.
C, REIMBURSEMENT FOR COST OF CASE
13. The plaintiff asks lhat the defendant be ordered to pay $2S0.00 to reimbune one of
Lcp) Services, Inc. 's funding sources for the cost of litigating this case.
WHEREFORE, punuant to the provisions of the "Protection from Abuse Act" of October
7, 1976,23 Pa.C.S. ~ 6101 "~., as amended, the plaintiff prays this Honorable Court to grant
the foUowing relief:
A, Grlllt a Temporary Order punllant to the "Protection from Abuse Act:"
I. Ordering the defendant to refrain from abusing the
plaintiff or placing her in fear of abuse.
2, Ordering the defendanllo refrain from hlIving any
direct or indirect contact \\ith the plaintiff including. but not limited
to, telephone and written communications,
3. Ordering the defendant 10 refrain from harassing and
stalking the plaintiff and from harassing the plaintiffs relatives and
her minor child.
4. Prohibiting the defendant from entering the plaintift's
place of employmcnt and the lIChool of her minor child,
S. Prohibiting the defendant from removing, damaging,
destroying or selling pro)X'rty owncd solcly by the plaintiff.
6. Granting posscssion of the homc locatcd at 133
Ryegate l{oad, Mechanicsburg, Cumberland COWlty, PeIUlSYlvania,
to the plaintiff to thc exclusion of the dcfendant pending a fina1
order in this mattcr,
7. Ordering the defendant to stay away from any othcr
residence the plaintiff may establish. ,
B. Schedule a hearing in accordance with the provisions of the "Protection from
Abuse Act, " and, after such hearing, enter an order to be in effect for a period of one year:
