PROVISIONS OF THB MUNICIPALITIBS PLANNING CODE
AND HOPEWELL TOWNSlIIP ZONING ORDINANCB - FAILURB
TO LIST SPBCIFIC VIOLATION(S)
5. Paragraphs 1 through 4 above are incorporated by reference
herein as though set forth in full.
6. The pennsylvania Municipalities Planning Code, specifically 53
P,S. 10616.1(C) (3), requires that an Enforcement Notice state nthe
speciflc violation wi th a descript ion of the requirements which
have not yet been met."
7. Section 13.01 (C) (3) of the Hopewell Township Zoning Ordinance
imposes the same obligation.
8. The Enforcement Notice fails to list the specific vehicles that
are allegedly on the premises in violation of the Ordinance.
9. For reasons stated in Paragraphs 6 through B abover the
Notice does not comply with the Municipalities Planning Code
, and the Hopewell Township Zoning Ordinance.
WHERBFORB, Defendants respectfully request that plaintiffs
Complaint be dismissed for fallure to comply with above-cited
sections of the Municipality Planning Code and the Hopewell
Township Zoning Ordinance citied above.

8. On or about December 06, 1996, Defendants. Joseph A, and Nancy Breski
were advilOd by the HopewlllI Township Zoning Officer, that they were in violation oflhe
Hopewell Township Ordinances for failure 10 obtain a building permit for an addition to their
property at 217 Zion Road, Newburg, lIopewell Township, Cumberland County, Pennsylvania.
6, Atlhe time of the Zoning Officer's December 06. 1996 conversation with
Defendant, Joseph A. Breski, concerning Ihe building permit violation, Defendant, Joseph A.
Breaki, was advised by the Hopewell Township Zoning Officer there are zoning ordinance
provialons prohibiting unlicensed, inoperable, or junked motor vehicles on his property st 217
Zion Road, Newburg, Hopewell Township, Cumberland County, Pennsylvania.
7. By leuer dated December 06, 1996, a copy of which is marked Exhibit
· A., incorporated herein by reference and auached hereto, the Hopewell Township Zonil'g
Officer advised Mr Breski that the Hopewell Township Zoning Ordinance does address
unlicensed or inoperable motor vehicles parked outside any structure, and that, in fact, such
storage of unlicensed, inoperable motor vehicles is specifically prohibiled under Section 11.03 (c)
of the zoning ordinance and provided copies of those provisions to Mr Breski.
8, The Defendants' property at 217 Zion Road, Newburg. Hopewell
Township, Cumberland County, Pennsylvania, lies completely within the agricultural zone as
shown and delineated on the Hopewell Township Zoning Map,
9. Under Section 11.03 (c), unlicensed, inoperable or junked motor vehicles,
or subltantial remnants Ihereof, are prohibited from being parked, stored, placed, or allowed to
remain on any lot within any zoning district for a period in excess of thirty (30) days, unlels luch

vehicles are parked, stored, or placed wllhin a completely enclosed building or slructure or within
a validly licensed junkyard,
10. The property al 217 Zion Road, Newburg, Hopewell Township,
Cumberland Counly, Pennsylvania, is a residential property and no junkyard license has ever been
IIOUght or issued fQr such property.
II, The vehicles which are unlicensed, inoperable or junked motor vehicles
IlXlated at 217 Zion Road, Newburg, Hopewell Township, Cumberland County, Pennsylvania,
have been parked, stored, placed or allowed 10 remain on the property for a period in excess of
thirty (30) days and are parked on the property in the lield, in the vicinity of the house. and at
locations which are not wilhin a completely enclosed structure.
11. Said vehicles have been inoperable, unlicensed or junked vehicles on the
property for a period in excess of thirty (30) days after the enaclment of the Hopewell Township
Zoning Ordinance on April 0 I, 1991, and are thus in violation of the township ordinance.
13. Hopewell Township Zoning Officer. Jel1l'ey A. Danner, notified Defendan
Joseph A. and Nancy Breski of violation of the provisions oflhe Hopewell Township Zoning
Ordinance 11.03 (c) by lellel' daled June 21, 1997. a copy of which is marked Exhibit "B".
attached hereto, and incorporated herein,
14. The zoning enflllcement notice dated June 21. 1997, and marked Exhibit
"0" is a valid and proper notice ohoning violation and was hand-delivered to Mr Joseph A.
Breski at 217 Zion Road, Newburg, Hopewell Township, Cumberland County, Pennsylvania, 01
June 21, 1997, u well u being mailed to Defendants.

18. At some time prior to July 22, 1997, Defendants Joseph A. Breski and
Nancy Breski, discussed the notice of violation dRted June 21, 1997, marked Exhibit "B" and
Incorporated herein by reference. with counsel os evidenced by Defendants' communication
through counsel to the zoning officer dated July 22, 1997. a copy of which is marked Exhibit "C",
attached hereto, and incorporated herein by reference.
16. On August 06, 1997. a civil complaint wu L1Ied by the Board of
Supervisors of Hopewell Township against Joseph A. Breski and Nancy Breski, citing them for
violation of the Hopewell Township Zoning Ordinance, Article XI, Section 11.03 (c) for storing,
placing and allowing to remain on their property at 217 Zion Road. Newhurg. Hopewell
Township, Cumberland County. Pennsylvania, multiple unlicensed, inoperable, or junked vehicles
which remained on the property for a period in excess of thirty (30) days.
17. A hearing on the civil complaint was scheduled for September 10. 1997, in
the office of District Justice Donald W. Daihl, 8] Walnut Dottom Road, Shippensburg, PennsylVlllia,
18, Richard L. Webber, Jr, attorney fur Joseph A. and Nancy Breski, notified the
District Justice of his appearance and representation of Defendants, Joseph A. and Nancy Breski.
19. On September 10, 1997, at approllimately noon. Ihree hours prior to Ihe
Diltrict Justice hearing scheduled September 10, 1997. at 03:00 o'clock P,M., Defendants Joseph
A. and Nancy Breski, filed an appeal from zoning officer decision and related enforcement notice
and proceedings with the Zoning Hearing Board of Hopewell Township, Cumberland County,
Pennsylvania, a copy of which is marked Ellhibit "D", attached hereto, and incorporated herein.
At the hearing September 10, 1997, at the district justice office, Defendants, Joseph A. Breaki and

Nancy Breskl, were found to b.: in violation of the Hopewell Township Zoning Ordinance, Article
XI, Section 11.03 (c) and a civil penalty assessed.
20. Appeal fTom the district justice decision of September 10, 1997, was llIed
in the Prothonotary's Office, Cumberland County Courthouse. Carlisle, Pennsylvania. and this
Complaint llIed in response to the said notice of appeal trom district justice judgment.
21. Defendants continue to have inoperable, unlicensed or junked vehicles on
their property at 217 Zion Road. Newburg. Hopewell Township, CUlnberland County.
PCMsylvanla, and are therefore remain in violation of the Zoning Ordinance each and every day
Iince September 10, 1997.
22. Hopewell Township has incurred attorney fees in connection with the
enforcement proceedings involved in this matter which are reasonable and which are costs to be
awarded against Defendants under Section 10617.1 of the Municipalities Planning Code,
WHEREFORE, PlalntiO', Hopewell Township Boant or Supervllon, requests
this Honorable Court to enter judgment in favor of the PlalntlO' and against Defendant, assessing
civil penalty in the arnount ofSis; Hundred and 00/100 (S600.00) DoOan, plus costs, plus
reuonable attorney fees incurred by the Board of Supervisors of Hopewell Township, in pursuing
enforcement as permitted under the Municipalities Planning Code.

As the owner of record of the above referenced properly, I am once again conlacling you regarding
the accumulation of inoperable, unlicensed, or junk motor vehicles allhis localion.

In December,1 visited your properly and could clearly sce Ihat ten unlicensed, inoperable, or junk
molor vehicles and pariS are parked in Ihe sideyard and backyard of your properly. On December
6, 1996, I senl you a !cller with copies of the wning ordinance informing you Ihatthe accumulation
of these unlicensed, inoperable, or junk 1II0tor vehicles is a violation of the Hopewell Township
Zonina Ordinance Article 11.03 C. (Page 66 & 67).

On June 21, 1997 , I visiled your property 10 verify the information in your zoning application for
the addition 10 your dwelling. At this time I could see thai at least ten or more complele or parts of
unlicensed, inoperable, or junk molor vehiclcs rcmainlocated in the sideyard amI backyard of your
property. These vehicles are clearly the same vehicles that I photographed in December 1996. The
keeping of these unlicensed, inoperative, or junk vehicle on your property for more than thirty days
is a violation of the about referenced Township Zoning Ordinancc ArLiclc 11.03 C ( a copy this
Article Is altached). The above referenced vehicle are not enclosed in any structure.
I am making you aware, by means of Ihis tellcr, that if these VIOlations are not corrected within
thirty days from receipt of Ihis notice, the Township will have no other choice thantu file a

(1) It fails to state facts sufficient to

therefore violates Sections 10616.1 (c) (3) of

Ordinance,
(2) It fails to state the time period in which
the Applicants/Appellants may appeal the
Zoning Officer's determination to the Zoning
Hearing Board and therefore does not fulfill
the requirements of Section 10616.1(c) (5) of

Ordinance; and
(3) It fails to "clearly t'escribe" the
potential sanctions resulting from failure to

Zoning Off icer inspected the property. Addi tionally,
sometime betweell JUlie 21, 1997 and August 6, 1997 the
Zoning Of f ieer and/or another representative from the
Township j IIspected the propel.ty. Determinations were
apparently 11\<1 de that Lhe use of the pl'operty by
Applicants/Appellants was ill violation of the Onlinance.
Both inspect.lona wet'e illvalid for the following reasons:
(a) The Zoning Officer and/or representative
failed to notify the Applicants/Appellants
prior to conducting the illspectlons;
(b) The Zoning Officer and/or representative
did not display identification prior to
conducting the inspections 1 and
(e) The latter illspectlon was not performed in
the presence of Applicants/Appellants.
The Zoning Officer and/or l'epresental:ives
thereof violated Section l2.0l of the Zoning
OrdInance on each occas..ion,
WHEREFORE, Applicants/Appellants seek,
(a) n determInation that the Enforcement
Notice is invalldr
(b) a delerm..inRtlOlI that the Zoning Officer
failed to register the use of the property as
valid and nonconfol'lning;
(c) a determination that the Zoning Officer
and/or 'rownshLp representatlve failed to
properly inspect the property; and
(d) dismIssal of the act.lon ant! proceedings
initiated by the Zoning Of f icer and Township.
8. Concerning t.he matters raised above, if the Board
rules agaInst Applicants/Appellants, then alternatively,
the grounds for their appeal/application al'e as follows,

As the owner of record of thc abovc referenced property, I am once again conlacling you regarding
the accumulation of inoperable, unlicensed, or junk motor vehicles at this location.
In December I visitcd your property and could clearly see that ten unlicensed, inoperable, or junk
motor vehicles and parts arc parkcd in the sideyard and backyard of your property. On December
6, 1996. I sent you a letter with copies of the lOlling ordinance informing you that the accumulation
of thesc unlicensed, inoperable. or junk motor whicles is a violation of the Hopewell Township
Zoning Ordinance Article 11.03 C. (Page 66 & 67).
On June 21, 1997, I visited your property to verify the information in your lOning application for
the addition to your dwelling, At this timc I could see that atleasL ten or more complete or parts of
unlicensed, inoperable. or jlJnk motor vehicles remain located in the sidcyard nnd backynrd of your
property. Thcse vehiclcs arc c1emly the same vehicles that I photogrnphed in Deccmber 1996. The
keeping of these unlicensed, inoperative, or junk vehiclc on your property for more thnn lhirty days
is a violation of the about referenced Township Zoning Ordinance Artiele 11.03 C ( a copy this
Article is attached). The above referenced vehicle are not enclosed in any structure.
I am making you aware, by means of this leller, that if these violations are not corrected within
thirty days from receipt of this notice, the Township will have no other choice than 10 filc a
citation wi!h !he District Justice.
You may appeallhis Zoning Enforcement Notice to the /lopewell Township Zoning /learing Board
