THIS AGREEMENT made and concluded this -.t:.f- day of September,
1997, between BARRY ~ CICCOCIOPPO and ANDREA M. CICCOCIOPPO. of
Carlisle. Cumberland County. Pennsylvania, party of the first part
(hereinafter called Owners). and HOME DESIGNS UNLIMITED by DAVID R.
THOMPSON and DENISE P. THOMPSON. of 144 Fields tone Drive. Carlisle.
Cumberland County. Pennsylvania. party of the second part (hereinafter
called Contractor) .
WHEREAS, the said parties have by a duly executed Agreement under
seal, dated May 16. 1997. entered into a writtp.n contract for the
construction and completion of a single-family dwelling located at Lot
No. 30. Cobblestone Estate. Carlisle, Cumberland county, Pennsylvania.
NOW 'rHIS AGREEMENT WITNESSETH, it is agreed between the parties
horeto that no lien shall be filed against the building by the
contractor, or any sub-contractor, nor by any of the material men or
workmen or any other person for any labor. or materials purchased. or
extra labor or materials purchased. for the erection of said building,
the right to file such liens being expressly waived. Contractor agrees
that he, his subcontractors, and material men, waive the right to file
mechanic's liens and will indemnify and hold harmless the owners in the
event any liens are filed against the subject property.
