STIPULATION AGAINST LIENS
WHEREAS, Capstone Capital of Pennsylvania, Inc" a Pennsylvania corporation with
offices at 1000 Urban Center Drive, Suite 630, Birmingham, AL 35242 ("Owner") is the owner
of that certain parcel ofland situate in Hampden Township, Cumberland County, Pennsylvania,
consisting of approximately 5.48 acres of land and more particularly described in Exhibit "A"
attached hereto and made a part hereof (the "Property"); and
WHEREAS, CCI Construction Co" Inc, ("Contractor") did covenant and agree with
Owner, through Owner's agent and, BCC Development and Management Co" to furnish all labor
and materials and perform all work necessary to construct a I 06-unit personal care facility, (the
"Improvements"), in the most substantial manner and to the satisfa~tion of Owner.
NOW THEREFORE, before any labor or materials have been provided or authorized or
any work commenced on the Property, Contractor hereby agrees and stipulates, for guod and
valuable consideration, the sufficiency and receipt of which is hereby acknowledged, that no
liens or claims shall be filed or maintained against the Property above-described by the
Contractor or any of its subcontractors, or by any of the materiahnen or workmen, or any other
person acting through or under him or them, for or on account of any labor or materials
purchased, or extra labor or materials purchased for, towards, in or about the erection,
construction, or design of the Improvements to the Property, the right to have, file and maintain
such liens or claims against the Property above-described, being hereby expressly waived by
