13, On or about, June 23, 1997, Petitioner visited the Historicul WId Architccture Review
Board (HARB) of the Borough of Shippensburg, conccl'lling the proccdure for
dcmolition of a structure in the historic district of the Borough, lor usc as u parking
lot.
14. Mr. John Rinaldi, representing the Minncqua Social Club, was advised of the
procedure necessary to obtain permission to demolish u structure in the historic
district, specifically Chapter 78-48 of thc Code of the Borough of Shippensburg, A
copy of said Chapter is attached hereto as Exhibit "I",
IS, Further, at the mceting of HARB held on or about Junc 23, 1997, Mr, Rinaldi WQS
advised that u building permit is rcquircd belorc demolition of the building could
occur,
16, Minnequu Social Club, acting in violation of the Code of the Borough of
Shippensburg, on or about September 6, 1997 caused the structure in Apple Avenue
to be demolished,
17, The Borough, upon notice of the violation ofits Code, issued a cease und desist order
requiring Defendant, Minncqua Sociul Club to stop work on said sitc,
18, Defendant, has not submitted a land developmcnt plan for the use of said site to the
Borough or its Planning Commission us rcquired by the Borough of Shippcnsburg
and Land Development Ordinance, Ordinance No, 94-690,

Unless an injunction is issucd, Citizcns of the Borough willsuflcr irreparable loss in
that the Defendant wiil havc succeedcd in having its building dcmolished and the
area used for its original purposc, that is parking without complying to thc Codc and
Ordinancc of the Borough.

Myers, and Wlswers the Petition of Minnequa Social Club as follows:

9, It is admitted that the Respondent has refused to lin the stop work order, it is denied
that the Borough demanded payment of $8,000.00 to allow work to proceed, It is
admitted that the Borough Council discussed a settlement of all potential claims it
had against the Petitioner and requested that sum as reimbursement for the costs and
expenses the Borough would have as a reBult of the Petitioner's failure and refused
to comply with the Ordinances of the Borough.
10, Denied, On the contrary, the Code of the Borough of Shippensburg speeilically
requires the issuance of a permit for the razing of structures which includes the
removal of debris and grading and filling of .the site. In addition, and by way of

Bourd (HARI3) of the Borough of Shippensburg, concc1'lling the procedure for
demolition ofa structurc in the historic district oflhc Borough, for use us u purking
lot.
14, Mr. John Rinaldi, represcnting the Minncqua Sociul Club, was udvised of the
procedurc ncccssary to obtain pcrmission to dcmolish a structurc in the historic
district, spccifically Chapter 78-48 ofthc Codc ofthc 130rough of Shipp ens burg, A
copy of said Chapter is attachcd hercto as Exhibit" t",
15, Further, atthc mccting of HARB hcld on or about Junc 23. 1997, Mr, Rinaldi was
udvised thut a building permit is required beforc dcmolltion of thc building could
occur,
16. Minnequa Social Club, ucting in violation of thc Codc of the Borough of
Shippcnsburg, on or ubout Septcmber 6. 1997 causcd the structure in Apple A venuc
to bc dcmollshcd.
17, The Borough, upon notice ofthc violation of its Code, issucd a ccase and desist order
requiring Defcndant, Minncqua Social Club to stop work on said site.
18. Defendant, has not submitted a land dcvelopmcnt plan for thc usc of said site to the
Borough or its Planning Commission as rcquircd by thc Borough of Shippcnsburg
and Land Dcvclopmcnt Ordinancc, Ordinancc No. 94-690.
19, Unless an injunction is issucd, Citizcns of the Borough will sutler irrcparablc loss in
thalthc Dcfcndant will have succeedcd in having its building dcmolished und the
urea uscd for its originul purpose, that is parking without complying to the Code and
Ordinancc of thc Burough.
