1. plaintiff in the initial complaint was seeking judgment in the
amount of $558.00 which was balance due on account. Aft.er testimony
in the hearing the plaintiff gave an estimate of $808.00 over the
telephone to do work on defendant's windows (quote was on defendant's
answering machine message) but later Clouse told Gleim the estimate
was $~08.00. This court has established that an estimate is
contractional and the initial estimate of $808.00 stands.
2. The customer, Lois Gleim, requested her garage roof be painted
the culor of redoxide. The painter, John Clouse, stated that this
was possible and that the paint could be mixed to obtain the correct
Coi0r. When the roof's final coat was put on it was not the color of
redoxjde and the customer was dissatisfied with the color and refused
to pay the balance of the bill for the roof job which was $450.00.
The evidence brought into the court was paint samples from both
customer and painter, this court has determined that the colors are
not Olle of the same. Due to the fac!t that the painter agreed to
paint the roof the redox ide color and another shade of paint was put
on the roof this court determines that the painter is responsible to
correct the mistake. Judgment in the counterclaim is for Lois Gleim
in the amount of $728.00 which was the lowest of two estimates
presented to the court as evidence.
